Pierce. Aldermen: Bronson, Bynum, Carter, Gregory, Peal, Sanders, Shook and Ucker. Acting Chief of Police M E Hand, Absent: City Clerk Otoe,Phillips. City Atty., Rex Perkins acting as Clerk of the Session, Minutes of the regularmeeting Monday October 21st;. were read and approved, Bills! The following bills were presented after their approval by Alderman Peal, Chairman of the Auditz}g Committee. J W Shelley $6.50; Western Union Telegraph Co. 3.61; Ben Porter $15.00; A F Shumate $18.00; Guy Roberts $12.00; Elmer Weir $$12,50; McAllister Shoe Store, $5.95. Alderman Gregory moved that the bills be allowed as approved and the Clerk instructed to issue warrants upon the proper funds in payment of same. This motion was seconded by Alderman Bynum, and received the unanimous vote of the Council. After discussion of the offer of the United States of America to aid by way of loan and grant in financing the constructtion of a Sewage Treatment Plant and Outfall Sewers with appurtenances, the following Resolution, numbered 358, was proposed by Aldermsn Sanders and read in full. A Resolution entitled: A RESOLUTION ACCEPTING THE OFFER OF THE UNITED STATES TO AID BY WAY OF LOAN AND GRANT IN FINANCING THE CONSTRUCTION OF A SEWAGE TREATMENT PLANT AND OUTFALL SEWERS AND APPURTENANCES, RESOLUTION NUMBER 358. `RES- A RESOLUTION ACCEPTING THE OFFER OF THE UNITED STATES TO THE CITY OF FAYETTEVILLE, #358 ARKANSAS TO AID BY WAY OF LOAN AND GRANT IN FINANCING THE CONSTRUCTION OF A SEWAGE TREATMENT PLANT AND OUTFALL SEWERS WITH APPURTENANCES: BE IT RESOLVED BY THE CITY OF F.AYE'TTEVILLE, ARKANSAS., SECTION ONE: That the offer of the United States of America to the City of Fayetteville, Arkansas, to aid by way of loan and grant in financing the construction of a Sewage Treatment Plant and Outfall Sewers with Appurte- nances, a copy of which offer reads as follows: FEDERAL EMERGENCY ADMINISTRATION OF PUBLIC WORKS. Washington, D. C. October 9,1935 State File No. Ark. 1014. City of Fayetteville., Arkansas. Fayetteville, Arkansas. 1. Subject to the Rules and Regulations (PWA Form No.166,July 22,1935, as amended to date) and which are made a part hereof, the United States of America hereby offers to aid in financing the construction and equipping of a sewage treatment plant and outfal sewers (herein called the "Project"),substa ntially in accordance with P. W. A. Docket Arkansas, 1014 by making a grant to the City of Fayetteville, Arkansas, in the amount of forty-five (45°x) per centum of the cost of the project upon completion, as determin ed by the Federal Emergency Administrator,of Public Works, but not to exceed,in any event, the sum of $45,000, and by purchasing, at the principal amount thereof plus accrued interest thereon, from the City of Fayetteville,Arkansas,obligations of the description set forth below (or such other description as shall be mutual lly satis- factory) in theaggregate principal amount of $55,000,,, less such amount of such obligation, if any, as the City of Fayetteville, Arkansas,may,with the consent of the Federal Emergency Administratdrr:of Public Works, sell to purchasers other than the United States of America: (a) Obligor: The City of Fayetteville, Washington County, Arkansas; (b) Type: Negotiable, special obligation, sewage revenue, serial, coupon bonds; (c) Denomination: X1,000.; (d) Date: November 1,1935. (e) Interest rate and interest payment dates: 4% per annum, payable semi-annually on May 1st, and November 1, each year; (f) Place of payment: At the office of thetCity Treasurer of Fayetteville, Arkansas; (g) Registration privileges: As to principal only. (h) Maturities: On November lst, in the amounts and years as follows: J ,000. in each of the years, 1937 to 1953; both inclusive; ; ,000, in each of the years,1954 to 1960, both inclusive, (i) Security: Payable as-to.both principal and interest only from and secured by a first charge upon the entire income and revenues of the Project,remaining after deduction only for reasonable operation, repair and maintenance expenses of the Project. I 2062 2. This offer is conditioned upon the City's adopting a satisfactory Ordinance establishing adequate and reasonable rates for the services and facilities afforded by the Project. Federal Emergency Administrator of Public Works, By Hoatio B Hackett Assistant Administrator. 3esolutioi SECTION TWO: That said City of Fayetteville, Arkansas, agrees to abide by all the rules and regulations relating to such loan and grant, a copy of which X358 rules and regulations were annexed to the Government's offer and made a part thereof. SECTION THREP:That the Mayor be, and is hereby authorized and directed forthw— itT h to send to the Federal Emergency Administration of Public Works three certified copies of this Resolution and three certified copies of the proceedings of this Council meeting in connection with the adoption of this Resolution, and such further documents or proofs in connection with the acceptance of said offer as may be requested by the Federal Emergency Adminis- tration of Public Works. SECTION FOUR: Whereas, the Chancery Court of Washington County, Arkansas, has or eere3 .EEe_'_City of Fayetteville, Arkansas, to construct a Sewage Treatment Plant and Outfall Sewers, with appurtenances thereto, in order to protect the health of the Citizens of said City of Fayetteville, Ark ansas, and it is necessary that the City immediately take such steps- as will enable it to comply with the Orders of said Court;therefore, an emergency is declared to ex and this Resolution is necessary for the immediate preservation of the public peace, health, and safety, and the same,therefore shall be in full force and e from and after its passage and approval. The above Resolution was seconded by Alderman Ucker and was adopted with the following voting Aye: Aldermen: Bronson, Bynum, Carter, Gregory, Peal, Sanders Shook and Ucker, and the following voting nay: None. Thereupon, the Mayor declared the Resolution adopted. Alderman Bynum declared an emergency condition to exist, and moved the adoption of the emergency clause Section four. Alderman Bronson seconded this motion, and upon the question being put before the Council resulted in the following vote: Ayes: Aldermen Bronson, Bynum, Carter, Gregory, Sanders, Shook and Ucker; and the following voting Nay: None, The Mayor thereupon declared the Emergency Clause of Resolution Number 358 carried and the Mayor and the City Clerk thereupon signed the Resolution in approval thereof. The Mayor suggested that consideration should be directed to the question of establish ing rates or charges for the use of the proposed sewage treatment plant and outfall sewers, with appurtenances, for said City of Fayetteville, Arkansas. After discussion by the Council members, Alderman Sanders introduced an Ordinance entitled "AN ORDINANCE ESTABLISHING JUST AND EQUITABLE RATES OR CHARGES FOR THE USE OF 'ublica- AND THE SERVICE RENDERED BY THE PROPOSED SEWAGE TREATMET T PLANT ASID OUTFALL SEWERS ion of WITH APPURTENANCES, to be constructed by the City of Fayetteville, in the County of iotice of Washington, State of Arkansas; and providing for.the collection of said rates or charges"; and moved that the same be read in full. This motion was seconded by .earing o Alderman Ucker and upon the question being put before the Council, resulted in the stablish'ngfollowing vote: Aye: Aldermen: Bronson, Bynum, Carter, Gregory, Sanders, Shook and rates of Ucker. Nays: None. The Mayor declared the motion carried and the Clerk read the Ordinance in its entirety. service: Alderman Carter then moved that the rules be suspended and the Ordinance placed on its second reading; This motion was seconded by Alderman Peal, and upon the motion being put before the Council, resulted in the following vote: Aye: Aldermen: Bronson, Bynum, Carter, Gregory, Peel, Sanders, Shook.and Ucker, Nay: None. The mayor declared carried and the Clerk was instructed to read the -Ordinance the Second time. The Clerk then read the Ordinance the second time. Alderman Ucker then moved that the Mayor prepare and give notice of hearing on said Ordinance to be held on the 9th, day of November 1935,setting forth the proposed schedule of rates or charges by one Publication in a newspaper published in the City of Fayetteville, Arkansas,and having a general circulation therein, at least ten days before the date fixed in such notice which is to be November 9th,1935. This motion was seconded by Alderman Carter. "!hereupon, the Mayor put the question on the adoption of said motion, and upon the roll being cal led, resulted in the following vote: Ayes: Aldermen: Bronson, Bynum, Carter, Gregory; Peal, Sanders, Shook and Ucker. Nays: None. The Mayor declared the motion duly passed as there were eight ayes and no Nays. Notice is hereby given that there has been introduced in the City Council of the City of Fayetteville, Arkansas,an Ordinance fixing the following rates for services of the proposed sewer treatment pland and outfall sewers, with appurtenances for said City: MONTHLY RATE. Residences ---------------------- Business Houses, "9Ffices and larger users,including Fraternity and Boarding Houses - ------------------ Hotels------------------------------ University and Veterans' Hospital ---------------------- .50 each per month 1.QQ each per month 5.00 each per month 10.00 each per month Any.person interested may appear before said Council upon the 9th, day of November 1935 at 7:30 P. Moat its usual meeting place at the City Hall, in Fayetteville, Ark- ansas,and be heard concerning the proposed rates. At such hearing all objections and suggestions will be heard and said rates, either as originally introduced or as modified and amended at said meeting, shall be passed. Alderman Ucker seconded this motion and upon the question being put before the Council, the following vote to Sewer resulted: Aye: Alderman Bronson, Bynum, Carter, Gregory, Peal, Sandefs, Shook and 1 Assess- Ucker. Nay: None. The Mayor declared carried and appointed the following Committee Aldermen Carter, Ucker and Bynum. lent Final report of ';?est Mountain Improvement District No.l by -C:. D. Carmichael, Secy., West Mtn was read. This report showed all obligations of the District paid and a check to the City of Fayetteville for $30.80 balance in the Treasury, to be used as the Final City Council sees fit; and asking that the Commissioners A. H. Markle and C. D. F7eport: Carmichael be discharged. Alderman Sanders moved that this report be received and filed, tie $30.80 be placed to the Credit of Street Fund, and the Commissioners discharged from further duties in the above District. Nay: Aldermen:Bronson, Bynum, Carter, Gregory, and Shook. The Mayor declared the motion lost.as there were Five Nays'and three Ayes. There being no further business to transact,Alderman Ucker moved to Adjourn. Alderman Bynum moved that this report be received and filed. This motion was seconded by Alderman Carter and was duly passed by the Council.
