Aldermen: Bronson, Bynum, Carter, Gregory, Peal, Sanders, Shook and Ucker. Acting Chief of Police M E Hand. Absent: Otoe Phillips City Clerk. City Attorney Rex Perkins acting as clerk 6f the session. Minutes of the previous meeting were read and approved. The following bills were presented after their approval by Alderman Peal, Chairman of the Auditing Committee: E h; Murphy 667 50; Linkway Stores $2.23;Harley Gover Sher: $101.00; Red Cross Drug Store $30.60; Southwest Gas & Electric Co. $$320.38; The Blair Stationers .61 cents; Rogers Electric Supply Co. 60;cents; Lewis Bros. Alderman Bronson moved that these bills be allowed as approved and the Clerk be instructed to draw warrants upoi the proper funds in payment of same. Alderman Bynum seconded this motion which received the unanimous vote of the Council. .ts:Permits to hang signs afere read from Laner Bros. ( sign to be hung at bheir place of business on North Block street, and from J T Taylor( for a Marquise awning at !'lard's Market on East Center st) . Alderman Sanders moved that these permits be granted, work to be supervised and passed upon by City Inspector. Alderman Ucker seconded this motion which was duly passed by the Council. The resignation of Walker Kelley as Commissioner. of Improvement District N0.35 to take effect immediately was tendered. Alderman Bynum moved that the resignation of Mr Kelley be accepted. The motion was seconded by Alderman Peal and carried unanimously. Mayor McAllister presented the matter of buying -a map of the City of Fayetteville showing lot divisions in xxit Blocks; same made by Burns & McDonnell,Erigineers of Kansas City; this to be a duplicate of a map made by this Company and now very much mutillatppe��d. Alderman`�'�vv�Nintroduced an Ordinance entitled "AN ORDINANCE TO REGULATE THE PRODUCTION, TRANSPORTETION, HANDLING, SAMPLING, EXAMIN�ITION, GRADING, LABELING, RE GRADING, AND SALE OF MILK AND LiILK PRODUCTS; THE INSPECTION OF DAIRY HERDS; DAIRIES AND MILK PLS+NTS: THE ISSUEING AMID REVOCATION OF PE RiITS TO MILK PRODUCERS AND DISTRIBUTORS: THE PLACARDING OF RESTAU R41NITS AND OTHER ESTABLISHMENTS SERVING MILK OR, MILK PRODUCTS: AND THE FIXING OF PENALTIES. The Ordinance was read in its entiretyby the Clerk, whereupon Alderman Sanders moved that the rules be suspended and the Ordinance placed upon its second read-ing�. This motion was seconded by Alderman Bynum, and upon the Clerk's calling the roll, the following vote resulted: Ayes: Aldermen: Bronson, Bynum, Carter, Greg©ry, Peal, Sand Shook and Ucker. Nayes: None, The Mayor declared carried and the Clerk read the Ordinance the second time. Alderman Gregory moved that the rules be further suspended and the Ordinance be placed upon its third and final reading. Alderman Bynum seconded this motion and upon the Clerk's calling the roll, the following vote resulted: Ayes: Aldermen Bronson, Bynum, Carter, Gregory, Peal, Sanders, Shook and Ucker. Naves: None. The Iriayor declared carried and the Clerk read the Ordinance the third and final time. The Mayor put the question Shall the Ordinance Pass:. Alderman Bynum seconded this motion which received the unanmous vote of the Council, -and the Mayor declared that the Emergency Clause be incorporated in the Ordinance. ORDINANCE 786, AN ORDINANCE TO REGULATE `IlIE PRODUCTION, TRANSPORTATION,PROCE3SING, HANDLING, SAMPLING, EXAMINATION, GRAE1 NG, LABELING, REGRADING AND SALE. OF MILK AND. MILK PRODUCTS: THE INSPECTIOPI OF DAIRY HERDS, DAIRIES AND MILK PLANTS: THE ISSUING AND REVOCATION OF PERP:IITS TO MILK PRODUCERS AA4D DISTFhIBUTORS: THE PLACARDING OF RESTAURANTS AND OTHER ESTABLISHMENTS SERVING MILK iOR MILK PRODUCTS: AND THE FIXING OF PENALTIES: The City of Fayetteville,ordains:- SECTION ONE: The Production, Transportation, processing, handling, sampling, exaraina tion, grading, labeling, Degrading and sale of all milk and milk products sold for ultimate consumption within the City of Fayette ille or its police jurisdiction,,the inspection of dairy herds, dairies, ard- milk plants, the issling and revocation of p mits to milk producers and distributors, the placarding of restaurants and other establishments serving milk or milk products, and the fixing of penalties; shall be regulated in accord with the'terms of 1934 edition of the U. S.'Public Health Service Milk Ordinance, a certified copy of which shall be on file in the office of City Clerk; provided that the blank spaces following the words "City of" in said Public Health Service Milk Ordinance shall be understood to refer to the City of Fayetteville; provided furth^r that in Section 8 of said Public Health Service Milk Ordinance the second alternative wording shall apply; provided further that Sections 18 and 19 of said Public Health Service Milk Ordinance shall be replaced, respectively by Sections 3 and 4 below. SECTION TWO: It shall be unlawful for any person, firm or corporation to sell or offer for sale in the City of Fayetteville,Arkansas, any milk or milk products+as defined in this ordinance, who does not possess an unrevoked permit from the said City. Each applicant for .permit, under tihis Ordinance, shall present to the City Clerk a certificate showing that each of his cows have been tested for T B. and in addition thereto, shall pay an annual inspection fee payable on or before February of each year, of $57:50 provided he has not over five (5) cows. If said applicant has more than five cows, he shall pay or cause to be_paid a fee of 50 cents for each additional cow from which such applicant obtains or proposes to obtain any supply of such milk or milk products. A maximum fee of $$100.00 is hereby established and in n event is any applicant required to pay in excess of said maximum -fee. 7 r 41 by and: xecutive Session: x:99 ORDINANCE 786 -continued -- SECTION 3.: Any person, firm or corporation violating any provision of this Ordinance shall upon conviction bd pAmished by a fine in anysum not less than $10.OQ, nore more than $100.00, or by any imprisonment in the City jail for not more than thirty (30) days, or by both fine and imprisonment. . SECTION 4.: All Ordinances and parts of Ordinances in conflict with this Ordinance are hereby repealed; and this ord finance being necessary to protect the health, peace and safety of the Citizens -'of Fayetteville, Arkansas,an emergency is hereby declared to exist and this Ordinance shall be in full force and effect from and of its passage, approval and publication. Passed and approved this 2nd, day of September 1935. Published in the Fayetteville Daily Democrat September 6th,1935. at "CliTy"c7erk Mayor. The subject of the illness of Shelby Holland was presented. After some discussion, Alderman Sanders moved that the City shall agree to pay Dr. A. S. Gregg for medical services to be rendered Shelby Holland during the months of September, October and November 1935. Alderman Ucker seconded this motion and same received the unanimous vote of the Council. The matter of attorneys fees in the Troy Stockberger case was brought to the attentic of the Council. Alderman Carter moved that a Committee with power to act be appointed by the Mayor to confer with Mr Greenhaw in regard to fee for this case. Thi motion was seconded by Alderman Bynum, and upon the question being put before,the Council resulted in the following vote: Ayes: Aldermen Bronson,Bynum, Carter,Qregory, Peal, Sanders, Shook and Ucker. Nayes: None, The Mayor declared carried. Report of Committee to confer Stith Civil Service Commission with reference to Policemans serving J.P.papers, reported that while off duty t' -ie City's Policemen might serve these J.P.papers and keep the Fee; but if on duty when serving these papers, the Fee would belong to the City . Alderman Sanders moved that the "Snooker" question be deferred until Monday night, September 9th,. This motion was seconded by Alderman Ucker and was carried unanimously. Alderman Sanders; moved that the Council go into Executive session. This motion was seconded by Alderman Ucker. and upon the Clerk's calling the roll, the folloig vote resulted. Ayes: Alderman Bronson, Bynum, Carter, Gregory, Peal, Sanders, Shook and Ucker. Nayes: None. The Mayor declared.the Council in Executive sessio Alderman Gregory moved that the Council go out of Executive Session. Alderman Carter seconded this motion which received the unanimous vote of the Council; and the Mayor declared the Council in regular session. Jity Alderman Sanders moved that a secret ballott be taken on the action of the City Library of Fayetteville in applying for Federal Aid in building a City Library. Alderman ederal Bronson seconded this motion which upon the question being put resulted in the following vote.: Ayes: Bronson, Bynum, Carter, Gregory, Peal, Sanders, Shook and id Ucker. Nayes: None. The Mayor declared Carried. Alderman Sanders then offered -- a Resolution that the City of Fayetteville apply for Federal Aid in building a City Library. Alderman Bronson seconded this motion and upon the question being put before the Council, the following vote resulted: Ayes: Two. Nares: Six. The Mayor declared the resolution lost as there were six Nayes and two Ayes. There being no furthor business, Alderman Ucker moved to.adjourn.
