Iver llar City Spector The Mayor reported receipt of a check for $1.56 from Gulf Refining Co., refund on Gasoline used at h4inicpal Air Port during the month of June. This check was turned to City Clerk for credit arid, Deposit to credit of Air Port Fund. Alderman Sanders moved that the original Committee, substituting Alderman Bronson for Alderman Stanford have complete authority to settle the Dowell and�Easorrccondemndt proceedings covering land used in straightening Highway #162. Alderman Bynum seconded this motion which upon the question being put resulted in the following vote: Ayes: Aldermen Bronson, Bynum,.Gregory, Peal, Sanders, Shook and Ucker. Absent and not voting: Alderman Carter., The,Mayor declared carried. The matter of specially marked parking places was brought to the attention of the Council, Alderman Sanders moved that the IJlayor and•dhief of Police be given authority to mark any special parking spaces in the City. The motion was seconded by Alderman Ucker and received the unanimous vote of the seven Councilmen,; present. A communication was read from Jas Dinraiddie, former City Inspector,bringing to the attention of the Council the need of a new Plumbing Ordinance. No action taken, Alderman Sanders moved that the Council go into Executive Session. The motion was seconded by Alderman Bronson and carried unanimously; and the Mayor declared the Council in Executive Session: Applications from the following were read, making application for the office of City Inspector of Fayetteville. -Oliver lollar, W M Fishb�. Felix Anderson; Lewis Davidson, P C Richardson, J W Diggs; also a letter from M J Brun, Chief of Fire Department, Fort Smith, stating that his observation had been that the Fire Chief acting in,the capacity of City Inspect -or in small towns had proven very satisfactory.j= s:o]it3c tcawaxs. After consideration of these different applicants, Oliver Lollar was elected by ballott. A Resolution defining Double Parking was introducedor as follows: BE IT RESOLVED BY THE CITY,COUNCIL OF FAYETTEVILLE, ARKANSAS: SECTION ONE:That moving a vehicle from one parking space to another parking space on the same street,within the restricted areas set forth in Ordinance Numbers 708 and 639, unless such removal be the result of necessary or legitimate use of said vehicle as it is ordinarily used, shall not exempt the owner of said vehicle from the penalty_ prescribed in said Ordinances. No action taken. The report of C F Armistead, Receiver for North �everett Imp District Noel was carried over until regular meeting August 5th,1935. Absent: City Engineer E M Ratliff. The minutes of the regular meeting July 29th, 1935 were read and approved. Alderman Bronson moved th4,t the bills be allowed as approved and the Clerk be instructed to draw warrants upon the proper funds in payment of same. This motion was seconded by Alderman Sanders and was unanimously passed by the Council. Jail The matter of expense of feeding prisoners was again brought to the attention of the Problem: Council. Alderman Gregory moved that the Mayor appoint a Committee to look further into the advisability of the City owning or maintaining a place to care .for City prisoners. Hudson Rogers Electric Supply Co.,, asked permission to harp a Neon Electric sign at Liquor Hudson Liquor Store, l'lest Mountain street, the sign to be 3 x 5 ft, weighing approxi - tore mately 125 pounds, double-faced. This motion gas -Pub icwas seconded by Alderman Peal which received the unanimous vote of the Council. t"lorks' Alderman Gregory introduced an Ordinance entitled, "An ORDINANCE REGULATING THE SALE Service: OF INTOXICATING LIQUORS AND FOR OTHER RELATED PURPOSES': This Ordinance was read the first time in its entirety by the.Clerk. Alderman Bynum made a motion which was seconded by Alderman Peal that the rules be suspended and the Ordinance placed on its second reading. Upon the question being put before the Council, the following vote resulted: Ayes: Bronson, Bynum, Carter, Gregory, Peal,,,S edS4 J ook akXd Ueke X. Mayor declared carried as there were eight Ayes and n ayesn 1 erman an ers hen made a motion amending the original Ordinance to read as follows: -"shall be fined not less than Fifty (4$50.) nor more than One Hundred (4$100.) Dollars for the first offenm and for the second and subsequent offense not less than One Hundred (4$100) nor more than Two Hundred (4$200.) Dollars or confinement in jail from one to sixty days, or both fine and jail sentence at the Discretion of the Court". Alderman Carter seconded this motion, and upon the Clerk calling the roll,'the following vote resulted:Ayes: Aldermen Bronson, Bynum, Carter, Gregory, Peal, Sanders, Shook and Ucker. Mayor : -_, McAllister declared carried as there were eight Ayes and no Nayes.. Alderman Gregory moved that the Emergency clause be incorporated in this Ordinance. This motion was seconded by Alderman Bronson, and upon'theClerk's calling the roll resulted in the following vote: Ayes: Aldermen Bronson, Bynum, Carter,Gregory, Peal, Sanders, Shook and Ucker. The Mayor declared carried as there were eight Ayes and no Nayes. Alderman Bronson moved that the rules be further suspended and the -Ordinance placed on its third and final reading. Alderman Peal seconded this motion, and upon the motion beingmput before the Council resulted in the following vote: Ayes: Bronson, Bynum, Carter, Gregory, Peal, Sanders, Shook and Ucker. The Mayor declared carried as there were eight Ayes and No Nayes.; and the Clerk read the Ordinance the third and final time. The Mayor then )put.the question: shall the Ordinance pass. Upon the Clerk's calling the roll, the following vote resulted: Ayes: Aldermen: Bronson, Bynum, Carter, Gregov Peal, Sanders, Shook and Ucker. No Nayes. The I+Iayor declared carried as there were eight Ayes and no Nayes. ORDINANCE NUMBER 785. AN ORDINANCE REGULATING THE SALE OF ITITOXICATING LIQUORS ARID FOR OTHER RELATED PURPOSES, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS, SECTION ONE:Any person who shall by himself or his employer, or servant or agent, for himself or any other person, keep or carry around on his person, or in any vehicle, or leave i& place for another to secure, any intoxicating alcoholic liquor fifth intent tosell the same in violation'of an Ordinance or Ordinances of the City of Fayetteville, Arkansas, or who shall -within this City in any manner, directly or indirectly, solicit, take or accept any order for the purchase, sale, or shipment or delivery of intoxicating liquor for beverage purposes in violation of the require- ments of the Ordinance or Ordinances of the City of Fayetteville,shall be guilty of misdemeanor and shall be fined not less than Fifty (4$50) Dollars nor more than One Hundred ($100.) Dollars for the first offense, and for the second and subsequent offenses, he shall be guilty of a misdemeanor and shall.be subject to a fine of not less than One Hundred (4$100.) nor more than Two Hundred (4$200.) Dollars or confine- ment in jail from one to sixty days or both fine and jail sentence at the discretion of the Court. SECTION TING, :This Ordinance shall be cumulative to all other Ordinances concerning or regulating the sale of intoxicating liquors in the City of Fayetteville, Arkansas, and in views of the fact that "bootleggers" are selling liquor in violation of the laws of said City and ,it being necessary for the preservation of the peace, health, and safety of the Citizens of said City, an emergency is declared to exist, and this Ordinance shall be in full force and effect fromand after its passage, approval and publication. Passed and ApW oved this 5th, day of August 1935. n Attest: City C erk Mayor. Published in the Fayetteville Daily Democrat August 7th,1935. An Emergency condition being declared to exist, Alderman Gregor{t moved that this Ordinance shall take effect and be in full force from and after its passage, approval and publication. This motion was seconded by Alderman Carter and upon the Clerk's calling the roll resulted in the following vote: Ayes: Aldem-en': Bronson, Bynum, Carte: Gregory, Sanders, Peal, Shook and Ucker.
