Mayor A D McAllister, City Clerk Otoe Phillips, Acting Chief of Police Earl Hand, City Attorney Rex Perkins. Aldermen: Bronson, Bynym, Carter, Gregory, Peal,Sanders, Shook and Ucker. Absent: City Engineer E M Ratliff. The minutes of regular meeting Monday, July 15th,1935 were read and approved. The following bills were presented after their approval by alderman Peal, Chairman of the Auditing Committee: A. F. Shumate y�18.00; Ben Porter $15.00; Cole's Cash Store 'x`2.00; Campbell Grocery No.l $7.00; Alderman Ucker moved that the bills be allowed as approved and the Clerk be instructed to issue warrants upon the proper funds in payment of same. This motion was seconded by Alderman Bronson and received the unanimous vote of the Council. The matter of Post Dated Warrants held by McIlroy Bank & Trust Company,was presented. These Warrants numbering 141,319 to 141,324 inclusive for $135.00, payable to the Young -Bryan Construction Company do not bear the endorsement of the Young -Bryan Construction Company, and the McIlroy Bank & Trust Co., state that they are unable to secure the endorsement of Young -Bryan Con. Co., at this time; asking that the City of Fayetteville waive this endorsement and accept same when presented for pay- ment. Affidavit of.the McIlroy Bank :& Trust Co., to the effect that they are the lawful 'owners of said Warrants and that the Young -Bryan Construction Co., have no interest in said Warrants, and that they willprotect and hold harmless the City of Fayetteville in paying said Warrants, was also presented. Alderman Bynum moved that the matter be referred to the City Attorney for investiga- tion. Alderman Sanders seconded the motion and same was unanimously passed by the Council. • -A communication was received from the Fayetteville Civil Service Gommission;4commend- ing the present police force for their hard work and increased efficiency, end regretting that the depriving them�of free telephone service really amounted to a reduction in salaries, and requesting of,the City Council that the "cost of telephone; be taken care of insome other way as may be thought best". Alderman Carter moved that the matter be passed for.the present for,future consideration. Alderman Ucker seconded this motion which was unanimously passed by the Council. Ralph Lewis and Hugh Lawson, representing the Chamber of Commerce, Board of Governors; appeared before the Council with reference to the proposed New Parking Ordinance. Council members stated that the new Ordinance's objective is to hive local people who are down town all day, park their cars away from the business districts so that parking places will be left for shoppers. Police Judge Massie stated that he had not fined any country people for overtime parking. Alderman Sanders moved that the Ordinance be amended to exempt General Practicioners. Blderman Carter seconded this motion, and upon the Clerk's calling the roll resulted in the following vote: Ay.es:•.A1 Carter, Peal and Sanders. Nayes: Bronson, Bynum, Gregory, Shook and Ucker. The Mayor declared the motion lost as there were five Nayes and three Ayes. - - Police Judge Massie appeared bef orgy, the Council in the matter of Curb Pumps,stating that on the Huntsville Rd District -Highway 16 and 45 there were only two curb pumps and suggesting a price of $5.00 each for pumps located on highway 16 and 45 and suggested that Ordinance be amended by striking out State Highways 45 and 16. Alderman Sanders moved that this matter be referred to the Ordinance Committee. This motion " ' "aas seconded by Alderman Peal and was duly passed by the Council. Alderman Bynum, Chairman of the Street Committee, to whom had been referred the matter of permit for Electric Sign for Ozark Liquor,store, North College Avenue, moved that this permit be granted to be erected under supervision of City Inspector. The motion was seconded by Alderman Shook and received the unanimous vote of the Council. A request was received from the McIlroy Bank & Trust Company by E P Pyeatt for permission to cut curb at the Dixie Baldwin property on Highland Ave. for driveway. Alderman Sanders moved that this permit be granted to be done under supervision of City Engineer. This motion was seconded by Alderman Gregory and was unanimously passed by the Council. Alderman Gregory introduced an Ordinance.,entitled, "An Ordinance regulating signs hanging or extending over sidewalks of the City of Fayetteville and for other related purposes". The Ordinance was read the first time in its entirety by the Clerk. Alderman Sanders made'a motion which was seconded by Alderman Ucker that the rules be suspended and the Ordinance be placed on its second 'reading. Upon the question being put before the Council; thefollowing vote resulted: Ayes: Aldermen Bronson, Bynum, Carter, Gregory, Peal, Sanders, Shook and Ucker. Nayes: None; and the Clerk read the Ordinance the second time. Alderman Gregory moved that the rules be further suspended and the Ordinance be placed on its third and final reading The motion was seconded by Alderman Bronson, and upon the motion being put before the Council resulted in the following vote:Ayes: Bronson, Bynum, Carter, Gregory,Sanders, Shook and Ucker. Nayes: None; and the Clerk read the Ordinance the third and final time. The Mayor put the question "Shall the Ordinance Pass". On the Clerk's callin the roll, the following vote resulted: Ayes: Rlderman Bronson, Bynum, Carter, Gregor Peal,Sanders, Shook and Ucker. Yayes: None. NEXT PAGE.::'.: -:: 11 192 ORDINANCE Number 783, AN ORDINANCE'REGULATING SIGNS HANGING OR EXTENDUNG OVER SIDEWALKS OF THE CITY OF FAYETTF.VILLE, ARKANSAS, AND FOR OTHER RFLATrD PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE: That it shall be unlawful for any person, firm or corporat102 to erect, construct,maintain or hang from any building, or other support, any sign hanging or extending over the sidewalks of the city of fayetteville, Arkansas,unless such person, firm, or corporation comply with the following provisions. &ECTION TWO:That any person,firm or corporation who may desire to erect or maintain any'sign extending over or across any sidewalk or street in the City of Fayetteville, or extending more than leighteen (18) inches from the building_ to which it is attached,shall submit to the City Council an application for a permit to erect or maintain such sign together withthe design and specifications,showing thf size and construction of such sign, and the matter to appear thereon. If the City Council approve such application, design and specification such approval shall be made of record'in the proceedings of the Council, and the 6ity Clerk instructed to issue said permit on the condition that the work be done under the supervision and inspection of the City Building Inspector, and it shall thereupon be lawful for the applicant toerect or maintain such sign. Fee for permit $1.00, and fee for inspectic of construction arra. erection $1.50. SECTION THREE.: The City Council shall issue no permit unless the design and specifications of the sign to be hung shows .that it is to be of all metal construction with metal frame, riveted not less than every eight (8) inches; or if it be of porcelain face on steel plate base, it may be without frame. Size of sign not to exceed 22 feet by 6 feet; that said sign must clear the sidewalk by at least nine (9) feet, and that said sign is not to extend beyond the curb. SECTION FOUR: ELECTRIC SIGNS.SHALL BE OF ALL METAL CONSTRUCTION and shall conform to the requirements of Ordinance Number 250. SECTION FIVE: Any person,firm or corporation violating any provisions of this Ordinance shall be guilty of misdemeanor and fined in the sum of not less tha $5.00 nor more than $15.00 and each day the said provisions of this Ordinance is violated shall constitute a separate offense. SECTION SIX:Al1.Ordinances and parts of Ordinances in conflict herewith are hereby repealed, and this Ordinance shall be in full force and effect from and a its passage and publication. This motion was seconded by Alderman Peal and received the unanimous vote of the Counci Alderman Gregory introduced an Ordinance entitled, "An Ordinance to regulate parking ON CERTAIN STREETS IN THE CITY OF FAYETTEVILLE, AND OTHER RELATED PURPOSES, The Ordinance wasread in its entirety by theClerkwhereupon Alderman Sanders moved th; the rules be suspended and the Ordinance be placed upon its second reading. This motion was seconded by Alderman Bynum, and upon the Clerk's calling the roll, the following vote resulted: Ayes: Aldermen Bronson, Bynum, Carter, Gregory, Peal, Sanders, Shook and Ucker. Nayes: None. The Mayor declared carried end the Clerk read the Ordinance the second time. Alderman Gregory moved that the two hour Parking period be changed to read " between the hours of nine o'clock A M and five o'clock P M"instead of eight o'clock A M and six o'clock -P M. Alderman Bynum seconded this motion and on the Clerk's calling the roll, the following vote resulte, Ayes:Bronson, Bynum, Gregory,Peal, Sanders, Shook and Ucker. Nayes: Laderman Carter The Mayor declared carried as there were seven Ayes and one Naye; and instructed the Clerk to make this change in the Ordinance. After discussion, Alderman Bronson moved that the rules be further suspended and the Ordinance placed on its third and final reading. Alderman Gregory seconded this motion and upon the Clerk's calling the roll, the following vote resulted: Ayes: Alderman Bronson, Bynum, Carter, Gregory, Peal, Sanders, Shook and Ucker. Nayes:None. The Mayor declared carried and the Clerk read the Ordinance the third and final time. The Mayor put the question, shall the Ordinance passion the Clerkts calling the roll, the following vote resulted: Ayes: Bronson, Bynum, Carter, Gregory, Peal, Shook end Ucker. Nayes: None. The Mayor declared the Ordinance passed as there were eight Ayes and no Nayes ORDINANCE N0. 784 AN ORDINANCE TO REGUTATE PARKING ON CERTAIN STREETS IN THE CITY OF FAYETTEVIILE,AND OTHER RELATED PURPOSES. Be it ordained BY THE CITY COUNCIL OF THE CITY OF FAYETTEV ILLE,ARKANSAS: SECTION ONE: It shall hereafter be unlawful for any person or -persons to park any motor driven vehicle in the City of Fayetteville, Arkansas,upon either 'ter t E: Y i 193 side of gest,_^ Center street and Vlest Mountain street to the point where they intersect w,iltb Church Street, or upon either side of East Mountain street to the point where it intersects with College Avenue, or upon either side of North East street to the point where it intersects with Meadow street,or•:upon::either side of South East street and South Block street to the point where they intersect with Rock street for a period of time longer than two hours between the hours of nine o'clock A M and five 51clock P M upon all week days. Two. SECTION: Any person or persons violating any of the provisions of this Ordinance shall be deemed guilty of misdemeanor, and upon conviction thereof in the Police Court shall be fined in any sum not less than $1.00 nor more than $25.00 for each offense. SECTION: Three:iThis.Ordinance shall be cumulative to all,other traffic and parking Orin nces and shall repeal only such 'parts of Ordinances that are in direct -conflict herewith and shall be in force and effect from and after date of its passage, approval and publication. Declaring an emergency condition to exist,Alderman Gregory moved that this Ordinance shall take effect and be in force from and after its passage, .ep proval and publication This motion was seconded by Alderman Peal and received the unanimous vote of the Council.. The Committee appointed on L7onday July 15th, to meet with the Civil Service Commission reported that a man may be hired for a period of not to exceed 60 days without permanent affiliation with the Civil Service Commission. There being no further business to come before the Council, Alderman Sanders moved to adjourn. The 1,4otion was seconded by Alderman Gregory and received the unanimous vote of the Council. Absent and not, -voting: Alderman Carter.The Mayor declared carried as there were seven votes in favor of same. ack Rob- Jack Roberts asked permit to shoot rock on Vandeventer Ave., between Maple and Shade its Permit Avenues. Alderman Ucker moved th.t this permit be granted to be done under supervision pf City Engineer, with the understanding that Mrs D M Moore, owner of property on D M Moore 4vhich work is proposed to be done, be held liable for any damage that might accrue, as a result of said "Shooting". This motion was seconded by Alderman Sanders and received the unanimous.vote of,the seven Councilmen present. Tulsa, 0�-1EThe Clerk read a letterfrom Jno. C. Johnson,1001 Medical Arts Bldg. Tulsa, Okla., Letter: "offering the City a tract of land five miles southeast of Fayetteville on which a reservoir for water (as may be needed at some future time)might be constructed with P W A money. The only compensation asked of,the City is thatthe owners of the land might be allowed use of such reservoir and its shore line for fishing, boating and scenic effect, all of which will be subordinanted and subject to the need of Fayette ville for this water whenever such an emergency arises". Alderman Bronson moved that this letter be ferred to the City Planning Commission for their consideration. Alder -mai Ucker seconded this motion which was unanimously passed by the Council, Marathon A letter was read from Marathon Oil Co., asking for refund of two years curb pump Oil Co license on Station of Dixie Oil Co., Dickson st. Alderman Bronson moved that in view of the fact that the exact time of removal of said pumps Svithin the curb line, Refund that the City refund one ,years' license or $}20:00. Alderman Gregory seconded this one year motion which upon the Clerk's calling the roll, resulted in the following vote:Ayes: Curb Pump Alderman Bronson, Bynum, Gregory, Peal, Sanders, Shook and Ucker.
