There being no further business, Alderman Brosnon moved to a djourn. Alderman
Gregory seconded this motion which carried unanimously, and the Mayor declared
the Council Adjourned,

Fayetteville City Council met in regular session Monday May 20th,1935.
esent: Mayor A D McAllister, City Clerk Otoe Phillips, City Engineer E M Ratliff, Aldermen:
Bynum, Bronson, Carter, Gregory, Peal, Shook and Ucker. Absent: Alderman Sanders.
Minutes of the regular meeting held May 13th,1935 were read and approved.
Bills: The following bills were presented after their approval by Alderman Peal, Chairman
of the Auditing Committee: Faus Gar, 16.65;Campbell Grocer Co. #1 $6.00; A F Shumate
:;18.00; Sure Stop Traffic Sign Co. $68.60; Ben Porter 5,15.00; Reed's Grocery $4.00;
Farmer's Market $$11.50; Fayetteville Lumber & Cement Co. 5S73.58;1VVinkeleman's Print
Shop $6.50; Shipley Baking Co. 85 cents;R & R Paint & Adv Co $1.75; Clyde Hight $,20.
Alderman Bynum moved that the bills be allowed as approved and the Clerk be instructe
to draw warrants for the same upon the proper funds. The motion was seconded by
Alderman Carter and received the unanimous vote of the Council.
MarathoJ The Clerk read a letter from the Marathon Oil Co., asking for refund of $20.00 each
Oil Co. for the two annual payments on Curb Pumps, 312 West Dixon st., ,years ending November
lst,1934 and November 1st, 1935, stating that these payments were 'issued in error
as Curb Pumps were removed to Company property on or before November 5th,1933,
Alderman Bronson moved that the City ask for a sworn statement in proof of this
removal. This motion was seconded by Alderman Peal and carried unanimously.
A bill was presented by S P Rogers for $1.00, for work : the last general election
in malting boothscwhich was not included in the bill from the General Election Committ e.
Alderman Ucker moved that this bill be allowed. The Motion was seconded by Alderman
Carter and was duly passed by the Council, and this bill was ordered paid.
Garbage: The matter of Garbage disposal was brought up for discussion. Alderman Bynum moved
that a Committee be appointed to investigate the situation and make report. Alderma
Bronson seconded this motion which carried unanimously. The Mayor appointed on this
commission: Aldermen: Bronson, Gregory and Bynum, and requested this Committee to
consider also a Per Capita Street Tax.
City I . The matter of an Ordinance Creating a City Planning Commission was broughYup, and
Plarning Alderman Bronson moved that the Ordinance be placed on its Third.and final reading,
Commislr which motion was seconded by Alderman Ucker and carried unanimously. The Ordinance
was they_ read the third time. After some discussion, the Mayor put the question:
"Shall the Ordinance Pass " On the Clerk calling the roll, the following vote
resulted: Ayes: Alderman Bronson, Bynum, Carter, Gregory, Peal, Shook and Ucker.
Nayes: None. Absent and not voting: Alderman Sanders, The Mayor then declared the
Ordinance passed as seven Aldermen were present and voted in favor of same.
Alderman Gregory moved that the Emergency Clause be adopted. Alderman Peal seconded
this motion which was duly passed by the Council and the Mayor declared carried.

AN ORDINANCE CREATING A CITY PLANNING COMMISSION, PRESCRIBING THE NUMBER AND QUALIFI-
CATIONS OF ITS MEMBERS AND DEFINING ITS DUTIES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYLT TEVILLE, ARKANSAS, as follows:
SECTION 1: PURPOSE: In order to direct the future development of the City and
encourage its social and economic improvement in accordance with modern City planning
principles and to insure the orderly, efficient and economic arrangement and develop-
ment of future public works projects, there is hereby created a Commission to be
known as the City Planning Commission,
SECTION 2: MEMBERS:The City PlanningCgmmission shall consist of nine (9) members,
including the Mayor ( or City Manager), City Engineer, and a member of the City
Council, the latter to be selected by the City Council from among its memebrs. The
other six (6) members shall be citizens qualified by knowledge or' experience to
act upon matters pertaining to the physical, social, and economic development of the
City. The Citizen members shall be appointed by the Mayor and in the first instance
three (3) members shallbe appointed for a period of two -years (2),threa (3)for four
(4) years, and thereafter all appointments shall be made for terms of four (4) years.
Appointments to fill vacancies shall be for unexpired terms only. Any 4:ember of the
Commission, extent the member of the City Council, may be removed by the Mayor at any
time for due cause shown. All members shall serve without compensation.
SECTION 3:PROCEDURE:The Commission shall elect from among its citizen members its
own Chairman, Vice -Chairman, Secretary, and Treasurer and may,from time to time, adop
such rules and regulations, not inconsistent with existing laws of the State,for its

own orYanization and procedure as it may deem%proper.
SECTION 4: DUTIES: The duties of the Commission shall be to prepare a comprehensive
plan or plans showingits ideas and recommendations for the physical development of thl
City; to provide such programs, drawings, maps or plans covering the whole or any pori
of said City and of any lands outside of said City which,in the opinion of the
Commission, bears relation to the development or welfare of the City and said plan
or plans shall show the Commission's ideas and recommendations relative to the loca-
tion, width, and arrangements of streets, alleys, bridges, grade separations,
parks, parkways, playgrounds, schools, public institutions or other public grounds or
improvements; the grouping of public buildings, the design and placing ofmorials
or works of art; transportation facilities,such as railroad, railway, and motor;
street appurtenances,including lighting standards,street name signs, poles and wires,
projecting signs and the like;zoning plan and ordinance for the classification^and
regulation of land uses and open spaces about buildings; and anyother matters pertain:
to the physical, social and economic improvement of said City or any portion thereof.1
SECTION 5: SUB -DIVISION OF LAND.All plans and plats for the sub -division or re-subdivs
ion of land into streets and /or building:.lots shall besubmitted to the CityPlanning
Commission for its recommendations before final acceptance or approval by the City.
Such recommendations by the Commission shall be mads w ithin fifteen (15) days and
failure to do so shall constitute a waiver of its rights to pass upon such plan or
plat.
SECTION 6: PUBLIC WORKS PROGRAM.It shall
be the fluty of
the City
Planning Commission
to prepare and submit an annual public works
program to
the Mayor
and City Council
on the first of January each year, and it
shall also be
the duty
of each and every
City department or agency to furnish the
Commission,upon
request,
any data, plans,
estimates, or programs and to collaborate
with said Commission
in
the preparation of
such public works programs.
SECTION 7: REPORTS.The Commission shall make an annual roport during the monthr.df
February .to the Mayor and City Council covering their investigations, transactions,
and recommendations,and such other reports relative thereto, as it may deem proper or
as requested by the Mayor or City Council and said Commission may employ such City
planners, engineers, architects, clerks, and other persons, whose salaries and compen
sations and other necessary expenses of said Commission and its members shall be
provided for at the discretion of the City Council by the proper appropriations or
ordinances and said City Council is hereby authorized to do so in any manner not
inconsistent with the laws of the State of Arkansas.
SECTION 8: LEGISLATION. It shall also be the duty of the Commission to prepare and
recommend such national,state and municipal legislation as may be necessary in
carrying out the recommendations or suggestions of the Commission.
SECTION 9: EFFECT. This ordinance shall take effect and be in force from and after
passage and approval by the Mayor.

shall be a member of the City Planning Commission, he would move that Alderman
Gregory be this member. Alderman Carter seconded this motion which when put before
the Council resulted in the following vote: Ayes: Aldermen, Bronson, Bynum,Carter,
Peal, Shook and Ucker. Nayes: Alderman Gregory. Absent and not voting: Alderman
Sanders. The Mayor.,declared carried as there were six Ayes and one Naye.
As there was no further business, Alderman Peal moved to adjourn. This motion was
seconded by Alderman. Bronson, and carried unanimously, and the Mayor declared the
Council adjourned.
