Alderman Bynum moved that the bills be allowed as approved and the Clerk be instructed to draw warrants upon the proper funds in ppayment of same. This motion was seconded Alderman Shook and was duly passed by the �'ouncil. The Mayor declared carried, Fire Pulp:Upon presentation of total cost of Fire pump, Alderman Peal moved that the City pay $3.46 which withthe previously authorized expenditure would complete payment of the Pump. This motion was seconded by Alderman Shook and carried unanimously. Electio Board Bili,,: A bill was presented from Washington County Election Board coveringcost of recent City General ---=-Election• Alderman Sanders moved that the bill be returned to be itemized. Alderman Bynum seconded the motion which received the unanimous vote of the Council. City Clerk Otoe Phillips asked to be re-imbursed for part of the money he had paid his substitute during the Summer and Fall of1934. Alderman Sanders moved that the Council allow an amount of 4$75.00 to assist the CityClerk in this expense. Alderman Peal seconded the motion and upon the question being put, resulted in the following vole: Ayes:Aldermen Bynum, Peal, Sen dors, Shook and Stanford. Nayes: Alderman Ca er and. Gregory. The Mayor declared carried, Alderman mSanders introduced a resolution as follows: RES 0 LUT I Old, WHEREAS, An indictment has been returned in the Federal Court for the Western District of Arkansas against the present City Attorney, and the `'ouncil realizing that the said indictment should not in any way reflect upon the guilt or innocence of the City Attorney, but realizing further.that his ability to properly fulfill the duties of said office is seriously handicapped by reasonof said indictment, and will tontinue to be so until said ch^rge is finally disposed of: NOCI,THEREFORE, BE IT RESOLVED by the Council of the City Bf Fayetteville, Arkansas, that Rex Perkins as City Attorney be and he is hereby requested to take a leave of absence from his duties as City Attorney, pending the outcome of the hearing on the indictment found against him in said Federal Court. Alderman Sanders moved the adoption of tiis resolution, and same was seconded by Alderman Carter. Before the vote was taken, City Attorney stated that he would not ask for a leave of absence, as he was not guilty. Upon the question being put, the following vote resulted: Ayes: Aldermen: Carter, Gregory, Peal, Shook and Sanders. Nayes: Aldermen Bynum and Stanford. The Mayor declared Resolution adopted, Notice ©f dismissal of Neal Cruse Chief of Police by Civil Service Service Commissi m was read. Aldeman Carter moved that the notice be received and filed. This motion was seconded by Alderman Gregory and received the unanimous vote of the Council. The recommendation of JA Peterson, Commissioner in Water Improvement District No.2, that J 0 Montgomery be appointed a Commissioner of said District to fill vacancy created by Mrs Salina Reap moving away was read. Alderman Stanford moved that J 0 Montgomery be appointed to fill. this vacancy, They motion was seconded by Aldeim an Sanders., and the Mayor declared J 0 Montgomery a Commissioner in Plater improvement District No.2 and the Clerk ^las instructed to notify Mr Montgomery, asking that he come in and file his Oath as Conm;issioner. A request was read from A. L. Eastep askingp s ion to cut curb for South entrance to 400 West Mountain street. Alderm. 9d that this request -be granted, workt,o be done tinder supervision of City Engineer E M Ratliff.This motion was seconded by Alderman Bynum and carried unanimously. A letter was read from Dr. P. L. Hathcock, stating 'that ,if the City would pay hospital bill for one Ardrett Mitchell, that any one of several surgeons in town wouldperform an operation which would put the man in shape to earn a living for him family whereas at the present time, he was unable to do anylkind of work. AldermanCa moved that the City agree to pay for hospital case in tl:is case. The motion was seconded by Alderman Peal and received the unanimous vote of the 6ouncil. The report of County Election Board coverin,• results of recent City General Election was read. Alderman Shook moved that thisrelectionceertificate be redeived and filed. This motion was secondedeby Alderman Stanford, and was unanimously carried. 0 168 Bronson, Bynum, Carter, Gregory, Peal, Sanders, Shook & Ucker. Nayes: None. On rea.uest of out -going Mayor„T S Tribble„ a rising vote of appreciation) for their_servicesiwas given by.the City Council to the out -going officers:Dr J F Sta: who has served the City for eight years as Alderman from Ward One.Mr. A. D. IcAll: who resigned as Alderman from Ward Three to become a Candidate for Mayor and Poli( Judge Clem Pearson who has served the City for two years as that officer. On motion of Alderman Gregory, the Council gave Mayor Tribble a rising vote of thanks also. Mayor Tribble,in reply,thanked the members of the Council for their faithful co-operation with him as Mayor, stating that any achievements that have been attained are due to the co-operation of the members of the Council. Mayor Tribble stated th t his biggest regret is that the steel viaducts which have been promised over Maple and Lafayette streets have not been.built, , Alderman Carter then made a motion that the Council adjourn Sine Die. This motion was seconded by Alderman Peal. (Police Judge J C Massie took his Oath of Office Tuesday morning April 9th). Mayor McAllister then expressed his appreciation of the honor the Citizens of Fayetteville had bestowed upon him and stated that he would do his utmost to be worthy of this honor. Mayor McAllister named the following -Standing Committees for the year 1935: Finance Committee: Aldermen, -Shook, Peal and Gregory. Audit_* A —%irmen: Peal, Carter and Sanders. Ordinance: Aldermen, Gregory, Bronson and Carter. Street Committee: Aldermen: Bynum, Ucker and Shook. Fire and Water Committee: Street Cleaning:Aldermen Bronson, Bynum and Gregory. Street Lights: Aldermen: Ucker, Sanders and Peal. Sewer Committee: Aldermen: Sanders, Bronson an ook, A,ldermen: Carter, Bynum and Ucker. Superintendant City Water Plant F M Ratliff presented report of the operations of the plant for the ,year 1934. Alderman G T Sanders introduced ah:. -Ordinance.-; authorizing the application to the Administrator, Federal-Dmergency Administration of Public Works,for a loan on or purchase of the bonds under Section 202,203,207,and 208 of.the National Industri Recovery Act, approved June 16,1933. This Ordinance was read the first time in its entirety. Alderman/moved that the rules be suspended and the Ordinance be placed on its second reading. Alderman Carter seconded this motion which upon' the-question'.being`put.,_resuit ed in' -the fbllowing"vote`: Ayest Bronson, Bynum, Carter, Gregory, Ucker, Peal, Sanders and Shook. The Ordinance was then read the second time. An Ordiance of the City of Fayette)ille, Arkansas,authorizing and directing that necessary steps be taken for the installation of extensions and improvements upon the Sewer System for the City of Fayetteville, Arkansas, and authorizing the procurement of necessary funds from the Federal Emergency Administration of Publi )Works organized under an act of the Congress of the United States and all proceed ings incidental thereto. Be it ordained by the City of Fayetteville, Arkansas: ter Section 1: In accordance with the National Industrial Recovery Act,approved June 116,1933; indicating the conditions under which loans will be made by that Body in communi- ties for the installation C of Public Corks. Now,be itordained, by the City III 169 Council of the City of Fayetteville, Arkansas,in regular session assembled,do hereby direct the City Engineer of Fayetteville, Arkansas, to prepare plans in accordance with the requirements of the State Board of Health, the laws of the State of Arkansas, Court Orders and the requirements of the City of Fayetteville, Arkansas. Section 2: Be it further ordained that the City Attorney of the City of Fayetteville Arkansas, is hereby authorized•a nd directed to act as legal Council for said City of Fayetteville, Arkansas,in the matter of'extensions and improvements to said Sewer System. Section 3.: Be it further Ordained that the expense of said engineering and legal service shall be paid from Funds furnished by the Federal Emergency Administration of Public Works,as,if, and when secured. a Section 4: Be it further Ordained that'the said Council proceed at once to have necessary reports prepared and open negotiktions for securing of funds for the purpose of installing the said Sewer extensions. Section 5: Be it further Ordained that upon the approvall.by the Federal Emergency Administration of Public Works that a loan will be made for the installation of said Sewer Extension, that this Council binds itself to proceed to the issuance of the proper Revenue Bonds or other evidences of indebtedness exclusively against the Plant and income therefrom, and will accompany said application with the complete engineering plans, estimates, legal and financial data and all other required exhibits. Section 6: Be it further Ordained that the passage of this Ordinance is necessary for the welfare and peace and health of the community, an emergency is hereby declared to exist, and this Ordinance shall take effect andbe'in force from and after its passage and publication, and all Ordinances and parts of Ordinances in conflict herewith are hereby repealed. Alderman Gregory moved that the emergency clause be voted on separateln Alderman Carter seconded the motion, and upon the question being put before the ouncil.the s carried unanimously. Therebeing no further business to come before the Council, Alderman Sanders moved to adjourn. This motion was seconded by Alderman Carter and received the unanimous vote of the Council. The Mayor declared the rt.eting adjourned.
