Protest of Vlallcer Kelley on assess�ner,t in Duncan Street Improvement District #35 was read. Alderman Sanders moi ed that Monday Feby llth,be set as the time to hear this complaint. Alderman Bynum seconded this. motion and uoon the motion being put, resulted in the following vote: kyes: Alderman Bynum, Carter, McAlliste Peal, Sanders, Shook, Standfordand Gregory. Nayea; None. Alderman Sanders seconded the motion and the same was duly Passed by the. gouncil. A bill from Troy Clark was Presented covering damage to his car in the sum of $$S.25. After some discussion, Alderman Bynum moved that the claim be disallowed. This motion was sedonded by Alderman Carter and upon the question being put, resulted in the unanimous vote of the Council. Renort of Civil Service Commission covering men on duty and entitledto pay was read. Alderman Gregory moved that the retro rt be. received and filed. Alderman A McAllister seconded the motion and was duly passed by the 6ouncil. The Mayor declared carried. A requost from Mrs A Marinoni to give grade and cut; -curb at 617 West Ma4)le street was read. Crlderman Sanders moved that City 71-i1-ineer give grade at this property and that permission to cut curb be granted, vroNrk to be done under direction of City Engineer E M Ratliff. Alderman Carter seconded this motion and received the unanimous vote of the Council. The;ror declared carried. The resolution of S m thwest Bell Telephone Co., carne un for consideration and the Finance Committee requested additional time for consideration and study on this subject, and the matterwas carried over. Alderman Shook presented the matter of charge of First National. Bank for interest on overdrafts of the City General Fund to Jany 9,1935 X173.25 and CityFire Fund �' $380.08' to Jany- j � 9th ,1,935'. Alderman McAllister moved that the same be approved and entered on January1935 Cash;Journal Transactions. Alderman seconded the motion, and received the unanimous vote or the Council and the Clerl; was instructed to enter on Cash Journal as stated. The matter of Fire equipment came up for discussion. Alderman Gregory moved that the Fire Department be allowed an extra $50.00 to buy "Boostr-.r Pump". This motion was seconded by Alderman Carter and carried unanilmously. Alderman Gregory hrour-ht to the Attention of the Council the influence of the Fact Finding Tribunal on Public Service utility mates and the fact that while a bill ha.dhaen proposed to the present State Legislature to make this Fact Finding Commission -permanent, another hill had bean introduced to do away with the Tribunal, and offiered the following resolution: H S 0 L U T 'I 0 N. VniEREAS,;The State Fect-Finding Tribunal, a Bureau of the Corporation Commission of Arkansas, has, during the Past year, by hearings ar.dnegotiations with F,lec- tric Utilities of the State, secured reductions in residential and commercial rates, totaling a\saving to the citizens of 0390,000. annually, as reported to the Governor. -in the annual report of the Tribunal, and WHEREAS: Fayetteville and other towns in Northwest Arkansas served by the Southwest Gas 8: Fler,tri.c Co. are now enjoying lower rates for electricity because of t1le Tribunal's efforts, and V11iEREAS:Legislation now pending in -the General Assembly, if enacted into law,, would greatly retard or destroy public service utility regulations in the State: THEREFORE BE IT RESOLVED by the City Council of the Cit? of Fayetteville, in regular session assembled', that it is the judgment of this body that any propos- ed laws tending to delay or stop Public Utility regulations should not be passed,as it is a step backward., Vie, believe tl:a.t Public Service Corporations that have dedicated their capital and services to to public use should be allowed to earn a fair return, and�no mom, on their investments an(, that to safeguard their investments, as well as the. interests of the public, all rates charged for public service should be under the control of an imnartial Public service commission. This motion was seconded by Alderpan McAllister and carried nanimously., No further business Alderman Sanders moved that the Council adjourn. Alderman Bynum moved that the bills be el lowed as approved, and the Cale rk be. instructed to issue warrants for the amounts, charging same to the proper funds. Alderman Carter seconded this motion and received the unanimous vote of the C ounci 1. The Mayor declared carried. Application was read from Brewer Flectric Co., askinglpermission to hang an Electric sign at Monarch Eat Shops on East Center st. Alderman Carter moved that this be I anted, sameto be done under supervision of electrical Inspector. trlderman Peal seconded this motion, and. the same was duly passed by the `'ouncil. .I A letter was read from Dr. Kenneth 0 Warner stating that he hoped the City would take steps to establish a City Planning Commission. In order to meet the demand for asb.1'stAn6enalong this line, the Arkansas Municipal League is establishing a planning division. In cooperation with the Amerldan Municipal Association, the Arkansas Municipal League will be, able to provide Arkansas Cities with model I rdinances creating a Citv Planning Commission and indicating the scope and duties to be performed by the Commission, Alderman Gregory, of the Ordinance Committee :rill write Dr. Warrnr. . Mr. PlalkerKellev appears before the Council protesting his assessment on Improve- ment District No.35 ( Duncan street). Alderman Sanders moved that a Committee be I ppointed to inspect Mr Kelley's prorerty and report to Council Monday night Fehry 18th. Alderman McAllister seconded this motion which carrie'duunaftinously. The t?avor appointed Aldermen Shook, Sanders and Bynum a Committee to make this investi- eation and rev.ort. Dir. Kelley brought to the attention of the Council an abandoned house at; 606 Rest ;Center st which is unfit for habitation and is considered a fire hazard. Mayor Tribble appointed the same committee as above to investiFat.e the condition of this house and report. Alderman Gregory and his Committee were retained for further service in connection with property covering, eastern extension of Highway #62. Report of Finance Committee relative to recent Resolution offered by Southwest BP1.1 Telephone Comneiny: Committee suggests that matter be deferred indefinitely. Alderman Bynum movedthat thisrerort be received and '.Aecdpted• alderman Sanders seconded this motion and .upon the question being put, received the unanimous vote of the Council. There being no further business, Alderman Gregory moved the Council adjourn. Aldermenli Shook seconded the motion and was unanimously passed by the Council. The Mavor declared the CoU ncil adjourned.
