Fayetteville City Council met in regular session August 20,1934.
Present: Mayor Tribble, City Attorney Rex Perkins,dity Engineer E M Ratliff, Aldermen: Bvnum,
Gregory, McAllister, Peal, Sanders, Shook, Chief of Police Neal Cruse, Chief of Fire
Department Clvde Walters, Absent: Aldermen J FStanford and Witt Carter, City Clerk
Otoe Phillips: ji M Ratliff acting as City Clerk.
Minutes of the meeting of August 14th, inst, were read and approved.

motibn,which wars seconded by Alderman Gregory that thebills be allowed as approved,
and the Clerk be instructed to draw warrAnts for same upon the proper funds. This
motion received the unanimous vote of the Council and the Mayor so declared.
Alderman Gregory introduced an ordinance entitled " An ORDINANCE TO REGULATE AND CON-

PURPOSES.
The ordinace was read in its entirety by the Clerk, whereupon, Alderman Bynum moved

that the rules be suspended and the ordinance be placed on its second reading. The

Clerk then read the ordinance the second time. After discussion, it was decided that
an emergency condition existed and it wats suggested that an emergency clause be
incorporated in the Ordinance. Alderman Sanders moved that the rules be further
suspended and that the Ordinance be placed in its entirety on its third and final
reading. Alderman Peal seconded the motion which received the unanimous vote of the
eouncil,. and the Clerk read the Ordinance the third and f R l time. The Mayor put
the Question-"Shal•1 the Ordinance Pass". On tha Glerk'a call>�gg er roll, the follow-
ing, vote resulted:. Ayes: Aldermen Bvnum, Gregory, McAllister, Peal, Sanders and
Shook. Nayes: None. Absent and not voting: Aldermen Stanford and Carter. The Mayor
declared the Ordinance passed.

An Ordinance to be entitled "An ORDINANCE TO REGULATE AND CONTROL MARKETING OF FRUITS,
VEGETAPLM AND LIKE PRODUCTS ON COLLFGF.AVENUE IN THE CITYOF FAYETTT7jrJILLE, ARKKANSAs,
from THE INTERSECTION OF SPRING STREET AND COLLEGE AVENUE TO THE INTERSECTION OF
DAVIDSON STREET AND COLLEGE AVENUE, AND FOR OTHER RELATED PURPOSES.
WHF,REAS, College Avenue in the City of Fayetteville, Arkansas, between the
intersection of Spring street and College Avenue and the intersection of Davidson
street and College Avenue is a residential section and the main Highway leading North
out of said City, and

certain
markets for the
sale of fruits, vegetables and like products
havebeen selling
from the
curb and from
improvised stands, and
whereas, numerous trucks park at said stands, block traffic,
arming said stands is unsightly and unhealthy, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF FAYETTEVILLE,ARKANSAS:
and the refuse,
Section 1. It shall be unlawful for any person, firm or corporation to market any
fruit, vegetables or carry on any commercial business whatsoever in the4ity of
Fayetteville, Arkansas, between the intersection of Spring street and College
Avenue and the intersection of Davidson street and College Avenue, from any stands,
markets or under any improvised shelter.
Section 2. Itshall be unlawful for any owner •, trustee or agent' of said owner, of
any lot or lots to rent, lease, or asign the same to any person, firm or corporation
for the purpose of carrying on the marketing of said fruits,vegetahles or any
commercial business whatsoever in the manner as described aforesaid, on said avenue
between the said intersections.
Section 3. Any person,firm or corporation violating any provisions -of this ordinance
shall be deemed guilty of a misdemeanor and shall be fined in any sum not less than
$25.00, and not more, than $100.00 for each violation and each day any person, firm
or corporation shall conduct or carry on the marketing, or business aforesaid, within
said limits, shall be deemed a separate offense.
Section 4. It being•evid•mt that such marketing from stands is affecting the public
health, peace and safety of the Citizens of Fayetteville, Arkansas,an emergency is
hereby declared to exist, and this ordinance is to take effect from and after its
Dasssage, approval and publication.

Oakland A petition from the Arkansas Pi Beta Phi House Association to the Fayetteville
Avenue City Council, asking that a sidewalk be ordered laid on Oakland Ave., on
gidewcilk: adjacent lots 3,10, 11 ofrH C Evans' subdivision of Blocks 3 and 4 of Oakland
Place Addition was read. Alderman Sanders made a motion that said sidewalk be
ordered in and that the City Attorney be directed to issue the necessary notices
and orders and have the same served. This motion was seconded by Alderman
McAllister. On the Clerk's calling theroll,the following vote resulted: Ayes:
Aldermen Bynum, Gregory, McAllister, Peal Sanders, and Shook. Nayes: None. Absent
and not voting Aldermen Stanford and Carter. The Mayor declared the motion carried
The Mayor reported a Municipal League meeting to be held in Fort Smith on
August 21,1934, at 2:30 P M. and urged that Council members attend.
There being no further businees,a motion to adjourn was made by Alderman
Peal which was seconded by Alderman McAllister and duly passed by the Council.
The Mayor declared the Council adjourned.

seconded by Alderman Shook that the bills be allowed as approved and the Clerk be
instructed to draw warrants for the same upon the Proper funds. This motion received
the entire vote of the Council present and the Mayor declared carried.
A letter of appreciation..from Fsyetteville Associated Relief,J J Pyeatt Treas., for
offering "Caddy House" for -Thrift House service was read.
Mrs Moor.- A request from Mrs. D. M.Moore, Director of Ozark Mountain Crafts, asking the use of
hrtn Craft : the Caddv house on the old City Golf Course for use :pith the Mountain Crafts, was
presented. Alderman Gregory made a motion which was seconded by Alderman McAllister
that the request be filed for further consideration. This motion was duly passed
by the Council and the Mayor so declared.
Municinal A Bulletin published by Arkansas Municipal League outlining object of League and
League terms of membership in same was presented. A motion was made by Alderman McAllister
and seconded by Alderman Peal that acti n o this be deferred unti

Chi Omegt Mr. G. C. Ylade, Mrs Ashton Vincenhel ler, R P Pyeatt and 1'1 J Re•lnolds appeared before
the Council in behalf of Chi Omega sorority, asking re -consideration of order to lay
sidewalk as described. No action was taken.
Fair Mr. Karl Greonhaw appeared in behalf of Washington County Fair Ass n, asking the
.rounds City to furnish gravel to � d sidewalks on Fair Grounds property, stating that the
idwalk work would require 600 cu Ut of gravel, and asking use of truck for assisting in
work on grounds. A motion as made by Alderman Gregory and seconded by Alderman
Sanders that this help be given at a cost not to exceed 036.00. The motion carried bl.
a•unanimous vote, and the Mayor declared carried.
The resignation of ^ Gary as City Inspector was read. A motion was made by Alderman
Sanders and seconded by Alderman Gregory that, Mr Gary's resignation be accepted. Th'
motion carried unanimously and the Mavor so declared. The. following filed applica-
j tion for the place madevacant by 'resignation of Yr Gary: Pt 11 Fishbaek,R F U'ages,Lewi:
Davidson, Oliver Lollar aril J B Hutchinson. A motion that these applications be
filed for consideration at'the meeting of September 10th, was made by Alderman
Gregory and seconded by Alderman Carter. This motion received the entire vote of
the membe "s present.
A motion to adjourn was made by Alderman Peal and seconded by Alderman Sanders. Thi:
motion was duly passed by the Council and the Mayor declared the session adjourned.
