Absent Hlderman "anders. Minutes of the regular meeting held Monday May 21st were read ary\8pnroved. Bills: The following bills were presented after their approval by Alderman Peal, `'hairman of the auditicommittee: Washington Transfer x}1.13, Ben Porter 115.00, A F Shumate 00, Overhead Door Co. $k45.01. Alderman Gregory moved that the bills be allowed as ;proved and that the Clerk be instructed to draw warrants for the same upon the Proper funds. The motion was seconded by alderman McAllister and carried unanimously. Arkansas Ice and Cold Storage asked permission of the Council to erect an Electric sign at the Magestic Cafe, Alderman Mcallister made the motion seconded by Alderman Peal which carried unanimously that this be allowl3d the same to be under the supervision of the City Inspector. Alderman Stanford introduced an ordinance entitled and Ordinance"Levying a privilege tax on the privilege of using and exhibiting in the City of Fayetteville, Arkansas, Scales and weighing Devices, Marble Machines and other mechanical games for amusement, and which are not within themselves gambling devises; providing for the collection of such tax; fixing penalties for vioation of this Ordinance declaring an emergency and for other related purposes. The ordinance was read the first time in its entirety by the Clerk. Alderman Bynum moved that the rules be - suspended and the ordinance be placed on its second reading. Alderman Carter seconded the motion which was carried unaniinoulsy and the Clerk read the Ordinance the second time. Alderman McAllister made the motion that the rules be futher suspended and that the ordinance be placed on its third and final reading. Alderman Saanford seconded the motion which carried unanimously anti the clerk read the ordinance the third and final time. The Mayor put the question'13hall the ordinance pass." On the Clerks Calling the roll the following vote resulted Ayes Bynum, Carter, McAllister, Shook, Stanford. Nays Alderman Gregory,.Peal. Absent an not voting Alderman Ganders. The mayor declared the ordinance passed as there was five Ayes and two frays. The emereenev Clause carried as there were six Ayes and L nay. Aves. Bvnum, Carter, McAllister, Peal, Shook,nStanford. Nays Alde^man Gregory. Absent and not Voting Alderman Sanders. ORDINANCE NO, 776. An Ordinance Entitled: Ab Ordinance leving a privilege tax on the Privilege of using and exhiniting in the City of Fayetteville, Arkansas, Scales and "eighing Devices, Marble Machines and other mechanical games for amusemefit, and which are not within themselves gambling devic,s: providing for the collection of such tax; fixing penalties for violation of this Ordinance declaring an emergency and for other related Purposes. BE IT ORDAINED BY THF. CITY COUNCIL OF THF CITY OF FAYFTTFVILLE. ARKANSAS: i ! Ssetionl. That every person, firm or corporation owning operating, or exhibiting scalls or weighing devices or marble machines, or other mechanical machines for amusement, and which are not within themselves gambling devices, by whatever name celled, shall pay for the privilege of exhibiting the same in the City of Favetteville, Arkansas, for the Privilege of such exhibition, the sums hereinafter set out on each said machine so used or exhibited; .Scales and Weighing Devices..........$5.00 per annum- Marble Machines and like devices as above described .6800.6660.6..608810.00 Per "nnum j Section 2. Before any person, firm or corporation shall he permitted to operate any of, th the said machines, as aforesaid, he shall first procure from the Clerk of the City of Fayetteville, Arkansas, a license or permit, which said license or permit shall show that the license tax on each machine has been Paid, and shall state the period of tine during which said machine may he operated in said city and state. From the Passage of this act until the beginning of the fiscal year, January 1,1935, the Clerk of the City of Fayetteville, Arkansas, may issue a license or permit and collect for each machine +i^e full annual license fee. Section 3. That upon the payment of said tax, the City Clerk of the City of Fayetteville, Arkansas, shall deliver to the one paving the same, a sticker showing the payment of said tax, the date thQreof and the expiration date of the same, which said sticker shall, at all times thereafter, be prominently displayed upon the macine or device, and a failure to attach and maintain -said sticker as herein required shall he Prima facie evidence that the tax on said machine exhibited with the said sticker, has not been paid. Section 4. That any person, firm or corporation exhibiting said machine or machines as aforesaid, shall Pay, in addition to the said privilege tax to the said city, to t American Legion "uxiliary of Fayetteville, Arkansas, .5percent of the gross receipts of the, amounts taken in during the exhibition of said machines: that the said Auxiliary shall furnish their own collector in regard to the collection of such gross receipts. Section 5. That if any section or sections of this Ordinance he declared invallid by a Court of Competent Jurisdiction, it shall not affect the remainder of this ordinance Section 6. That any person, firm or corporation violating the provisions of this ordinance shall be fined in the sum of klifteen Lol.lars ($?15.001 for each sePerate violation and each day of tre continuous violation of the provisions hdreof shall 'p deemed•'And considered a separate and distinct offense. 1 I 126 : Section 7. That by reason of,the large number of machines defined in this Ordinance wh4.ch.are being operated in.the.City of Fayetteville, Arkansas, without the payment of a privilege tax, and the immeddate necessity of raising additional taxes to defray the necessary expenses fo the City of Fayetteville, Arkansas, an emergency is hereby declared to exist, and this Ordinance shall take effect and.be in force from and after its passage, an approval and publication. The motion was seconded by Alderman Gregory and carried unanimously, Alderman Carter made the motion seconded by alderman Bynum that action on the hill presented by Mrs. Laura Yeater.be carried ovei3 the Motion carried unanimously. Keck was carridd over until next meeting, No fut+ther business Alderman Gregory made the motion seconded by alderman Bynum that Adjourn the Council adjourn.
