Favetteville City Council met in regular session Monday April 23rd, 1934
Present: Alderman Bynum, Carter, Gregory, McAllister, Peal, Shook, and Stanford, City Clerk
Otoe Phillips, City 8hgineer E M.Ratliff,_.Chief Police Neal Cruse. Absent
Mayor T S Tribble, and Alderman Sanders.
The meeting called to order by Alderman Stanford. Alderman garter made a motion
seconded by lilderman Gregory that Alderman Stanford he elected Mavor protem. Upon the
motion being put by Alderman Carter-alll present and voting voted for the motion and
Alderman Stanford was elected Mayor Pro -tem.
Minutes of the meeting held April'16th were read arkpproved.

Bills The following hills were presented after their approval by "lderman Peal, lihairman
of the 4111diting Committee, S '.73 Gas and Mee Co. x$314.10, Joe'�aker X1.00,
Ben Porter $30.00, Gene 117ebb 84.00, Earl Stewart $8.25, Henry Vaughn $5.25 Oliver
Murray $1.50, A F Shumate 06.00. Alderman Gregory moved that the hills be allowed
as approved and that the Clerk be instrticted to draw warrants for the same upon
the proper funds. The motion was seconded by Alderman McAllister and duly passed
by the Council.
A L Easter asked permission of the Council to Construct a culvert and Driveway over
gutter at his Grocery Store on West Mountain. Alderman Bynum made the motion that the
j same, be allowed under the supervision of the City tng_ineer Alderman Carter seconded
the motion which was duly passed by the Council.
'Ir V Henderson asked permission of the Council to cut the curb for a drive way at his
residence at the Corner of Walnut and Davidson. By motion of Alderman Carter
seconded by Alderman Peal the same to be allowed under the Supervision of the City
I Engineer and the same to be constructed at Mr. Henderson's expense.

The First Nati.onal Bank requested the Council to issue a warrant for $"60.00 the
interest on over drafts the matter was carried over.
Reports The following reports for the month of March were read in their entirety by the Clerk:
for T. S. Tribble as Hurchasing Agent, Otoe Philli.pc as City collector, and as City Clerk,
March Clem Pearson as Police Judge, and Neal Cruse as 'hief of Police. By motion of
Alderman Bynum seconded by alderman Peal and duly passed by the Council, the reports
were received and filed.
Alderman Peal Introduced an ordinance entitled "An Ordinance granting to J. W. Shelley
Garbage a Citizen of Fayetteville, Arkansas.. Heirs, legal representatives, euoeessors or
Ordinanc assigns the right and nrivelepes to operate all the necessary equipments and other
-appliances, over the streets, avenues, allies and public grounds of the City of
Fayetteville, Arkansas, for the Purpose of removing all garbage from the City Limits,
of Payetteville, Arkansas. r'ixing and defining the terms and conditions of the said
grant. The Clerk read the ordinance the first time in its entirety. Alderman Bynum
moved that the rules he. suspended -ind the ordinance be placed on tis second reading.
Alderman `'arter 10ecb nded the motion which received the entire vote of the "ouncil.
The Clerk read the Ordinance the second time. The ordinance was left on its
second reading.
Tie Mayor Pro -tem called the Co+.zicil'8 attention to the fact that there had been an
offer to buy the old airport from the City. ^lderman McAllister made a motion that
the Finance `'ommittee'investigate the possi.bilties of cutting up the old airport into
tracts for sale.. Alderman garter seconded the motion which was duly passed by the
Council.
No further business Alderman Gregory made the motion that the Council adjourn, the
motion was seconded by °lderman Bynum and recieved the entire vote of the Council.

that the Clerk hs instructed to draw warrants for the same upon the proper funds.
The motion was seconded by alderman Carter and carried unanimously.
The Finance Committee investigation of the possibilities of cutting un the old airport
into tracts for sale,was carried over.
The garbage ordinance was brought up and read the third and final time by the Clerk.
The Mayor 1bon put the question 'Shall the ordinance pass' On the Clerk's calling the
roll the following vote resultedi Ayes Bynum, Carter, Gregory, McAllister, Peal,
Sanders, Shook, Stanford. The Mayor declared the ordinance passed as there were
8 Ayes and no Nays.

Ordinance No. 774
An ordinance granting to J V! Shelley, citizen of. Fayetteville, Arkansas, his heirs
legal representatives, suscessors or assigns, the right and privilege to operate all
the necessary equipment and other appliances over the streets, avenues, alleys and
Public grounds of the said City of r`ayetteville, Arkansas, for the purpose of removi.n
and disposing of all garbage from the city limits of said city of Fayetteville,
Arkansas, and, fixing and defining the terms and conditions of said grant.
Be it ordained by the City "ounell of the 6ity of Fayetteville, Arkansas,
Section 1. That the sAid J V; Shelly, his heirs, legal representatives, successors
or assigns shall hereinafter be designated by the worn "Grantee", and the said City
of Fayetteville, Arkansas, shall hereinafter he designated by the word "City", and
that the word "Garbage", Wherever it shall -appear in this Ordinance, shall he construed
to mean any and every accumulation of animal, vegetable and dineral. matter, whether
such matter. be collective or separate, composed of the refuse matter from kitchens, n
nantnies dining rooms, or other parts of Hotels, #estaurants, Roarding Houses, public
Institutions, dwelling ho-ases, Market houses, private hospitals, and, all animal refuses
from slaughter houses, all animal refuses from Butcher shops, the refuse matter from
fish stores, and the refuse matter froom retAil poultry store or concerns: also, any
filthy, suculent matter, dung,. boruen glass, peelings, cinders, nut hulls, newspapers,
paper advertisements., litter, boxes., tin cans, chips, and etc. or any trash
whatsoever found in the city limits of said city and state.
Section 2. That the said "GPANTFE° shall he designated as the city "Garbage" and
"SCAVFNG'y COLLECTOR": that said "GRANTFE" shall have full powers as an VEX OFFICIO"
Sanitary Police Officer and shall have full authority to enforce all the provisions
of this ordinance, and a prior ordinance number 313, of said City and state; and,
said RGRANTF.E" shall be directly under the orders of the City Health Officer in
carrying out the nrovisions of this ordinance and the said Ordinance 313, and such fu
orders as said City Health Officer shall direct.
Section 3. That said GRANTEE, before beginning the enforcements of this ordinance in
the city, and within 10 daps after this ordinance _Aha -11 ha-ve1become.jeffective, shall
Procure liability insurance. in legal form in the sum of $1,000.00 with..a reputahle
Insurance corporation, authorized to do business in the state of Arkansas, payable
to the city as tis interest may, apuear,and acceptable to the city council of the ci.ty
holding the city harmless from any damages or liability that may arise or he caused
by the operations of the Grantee. And there is hereby an additional. Insurance
required in the sum of $1,000.00 legal in form given by the grantee for the faithful
performance in carrying out the Provisions of this ordinance snd ordinance 313.
Section 4 The Grantee is responsible for the proper carrying out of all the
r.rovisions of this ordinance and ordinance 313 as set out in Section 1, in case the
Garbage is collected by some other party by any contract withowners of whatsoever
nature of this said contract.
Section 5. The term of this franchise shall.'he for a period of three (3) years from
the date of passage and approval of this ordinance but may he terminated at anv time
by a majority vote of the Council.
Section 6. It is not the purnose of this act to change in any respect, the ]saws and

heretofore existing and in force effecting this work.
Section 7. All laws and parts of laws in conflict herewith are hereby repealed and
owing to the necessity of said Garbage being removed, and emergency is hereby deglare
to exist, and this ordinance being necessary .for the immediate preservation of public
health, peace and safety, the same shall take effect and be in full force from and
after its passage. .

Published in the Fayetteville taily Democrat May 7th 1934.
Flec By motion of Alderman Stanford, seconded by Alderman barter and duly Passed by the
Signs Council the request of the Varsity Shop on Dickson Street to install an electric
sign and the White Kitchen on blest Mountain the same was granted and to be under the
supervision of the City Inpsector.
Alderman Stanford made:ia motion that the sum of $60.00 he paid the Virst National
Bank as Interest on overdrafts Itlderman Sanders seconded the motion which was dul.y
passed by the Council.
