Section Six: Whenever any dog has been placed in the pound as provided for in secti
(2) that has bn a collar bearing a City License Tap„ it shall be the duty of the
officer in charge of such dog to notify the owner or the person to whom the
license Tag was issued by the City Collector, if suchperson or owner can be found,
that the dog has been taken up and placed in the City Loa, Pound and will he killed
within five daps unless the fee is paid as provided in Section four (4) of this
ordinance.
Section Seven: It is ascertained by the City council that the Provisions of
this
ordinance are separate and independent, and if any word, clause, sentence or
section should be. declared void by a court of competent that it
shall no
,jurisdiction
interfere withthe remaining provisions hereof.
Section Fight: Any person or persons violating any of the provisions of section
of this ordinance, shall upon conviction before the police judge, he deemed
guilty of a misdemeanor and fined in any sum not less than Five Dollars nor
more than
Fifteen Lollars.
Section Nine, It is further decalred by the City Council that this ordinance
is
Intended to be accumulative to the ordinances now in force "and repeals only
such
ordinances and parts of ordinances as are in direct conflict herewith.

Minutes of the regular meeting were held April 2nd. were read an approved.
The following hills were presented afker their approval by Alderman Peal, Chairman

the bills be allowed as approved and that the Clerk be instructed to draw"warrants
for the same upon the proper funds. The motion was seconded by Alderman Harding
and duly passed by the douncil.
Anpliza.tion:for permission to 'cut the curb at•their.'residence was asked,by
Roy CI Roberts and Walter McWhorter. The motion was made by Alderman Wages and
seconded' by Alderman Bynum that this be granted the same to he under the
supervision of the City Engineer.

Res- Resolution was presented to the Council asking that a side walk be put in along
for I Maple Street•between College Avenue and Mission Street. Alderman Carter made the
Side Walk motion that the resolution he received and filed, the motion was seconded by
I Alderman Gregory and was passed unanimously by the Council.
H"L'Williams"rresented to the Council a bill for the expense of the General Election
for the City field April 3rd," Alderman Bynum made the motion seconded by Alderman
Gregory that this amount be°allowed.
Alderman Stanford intrPROciphngg entitled "An Ordinance Establishing and fixing,
The Width of South School Avenue, Fayetteville; Arkansas, and Dedicating the Same .
for Use by the Public." The Ordinance was read the first time in Its entirety
by the Clerk. Alderman Gregory made the motion seconded by Alderman Peal that the
rules he suspended and the ordinance be placed on its second reading. Upon the
question being put, before the Council it received the unanimous vote and the Clerk
read the ordinance the second time. Alderman Carter moved that the rules be
further suspended and the ordinance be Placed on its third an final reading.
Alderman Bynum seconded the motion which recei-ved the entire vote of the Council.
The Clerk then read the ordinance the third and final time. The Mayor put the
question 'Shall the Ordinance pass." On the Clerk's calling the roll the following
vote reuslted. Ayes Alderman Bynum, Carter, Gregory, Harding,, Peal,ti'Stanford, Wages.
Mays none. Absent an not voting one. The Mayor declared the Ordinance passed as
there was 7 Ayes and no Nays.
ORDINANCE N0, 772
An Ordinance Entitled," An Ordinance Establishing and Fixing"the Width of South
School Avenue, Fayetteville, Arkansas, and Dedicating the Same for use by the Public'."
Be it ordained by the City Council of the City Of Fayetteville, Arkansas:
Section 1. That the width of South School Avenue frpm the North line of West
Mountain Street to the South line of Prairie Avenue, Fayetteville, Arkansas, is
hereby declared to be, is fixed and shall remain at sixty feet.

Section 2. That the Mayor of the City of Fayetteville, Arkansas, is hereby
authorized and directed to cause to be prepared a plat.showing the width of said
School "venue in accordance with this ordi;iance and when the same is prepared to file
the same, in the office of the Circuit Clerk and ex -officio Recorder of Washinston
County, Arkansas.
Section 3: That the said Street designated in gection One hereof is hereby dedicated
to the public for its use and benefit as a public thoroughfare, subject to the rules,
regulations and requirements of the statutes of the State of Arkansas.
Section 4. All ordinances or parts of ordinances in conflict herewith are hereby
repealed.
Section 5. It is ascertained and declared that the herein before Street is a part of
a Federally recognized State Highway; That the Rules of the rederal Bureau of Public
Roads require that Streets shall be sixty feet in width before they are elligible for
improvements by use of Federal Funds; that this Section of Street and Highway is
elligible for and has been approved for improvement pending the dedication 6f a
sixty foot width: that the present condition of the Street is in a state or repair
which renders it dangerous -to the traveling public and by this ordinance the way is.
cleared for removing this dangerous condition. It is., therefore, decRIred that an
emergency exists, that this ordiannce is nesessary for the immediate preservation of
the Public Peace, Health, and Safety, and that this ordinance shall take effect and
bein force from and after its passage, approval and publication.

This is to certify that the following City officers were elected at the General

John Bynum without opposition. The Annexation of the territory composing the site of
the Veterans Hospital'carried ry a vote of 230 to 18. Act 28 carried by a vote of
194 to 57. Alderman`Harding made the motion that this report,he received and filed
lderman Peal seconded the motion and was carriedunanimouslyby the Council.

E M Ratliff reported to the Council on the widening of School St. stating that it was ne
necessary to obtain easement from Mrs. Mc Cullon. Mayor Tribble stated he had paid
one dollar for such easement. Alderman Harding made the motion that the Mayor he
raid the dollar the motion was seconded by AldermanAar,d carried unanimously.
Alderman U^•e ory introduced an.Ord1nance entitled an "Ordinance Electing, Three
Members of the Board of Civil Service Commissioners of Fayetteville, Arkansas, and
Designating the Period for Which they Shall Serve as Such Commissioners, all in
Accordance with Act Ho. 28 of the Acts of the General Assembly of the State of
Arkansas for the Year 1933". The Ordinance _was •read. -the first time in its entirety

as there was six Ares and one Nay. And. the Clerk read the ordinance. the third and

An ordinance to he Entitled "An Ordinqnce Electing Three Members of the Hoard of
Civil Ser-7ice Commissioners of Fayetteville, Arkansas, and Designating the Period
for Plhich they shall Serve as such Commissioners, All in Accordance With Act No. 28
of the Acts of the General Assembly of the State of Arkansas for the Year 1933"
Whereas the 1933 General Assembly of the State of. Arkansas has by Act no 28, created
a board of Civil Service Commissioners in cities of the first class having an
organized police and fire department, and
Whereas, under said Act it is the dirty of the City Council to elect three members to
such a hoard of commissioners for the term of two, four, six years, respectively.
Therefore, be it ordained by the City Council of the City of Fayetteville, Arkansas,
Section One: That C W Guisinger is hereby elected for the term of two years:
C P Dodd is hereby elected for the term of Four years; Dr. Harrisi6nnHale is hereby
elected for the term of six years to serve as members of the 'board of Civil Service
Commissioners of Favetteville.
Section Two: The immediate necessity of complying with the provisions of the state
law in regard to the organization of the police and fire departments in Cities of th
first class created an emergency requiring that this ordinance shall become opprati.v
1mmedtately anon its passage approval and publication.
Section Three: Th -4t all ordinances or parts of ordinances in conlict herewith are
hereby are -pealed.

A rising, vote of thanks was Fiven,the retiring Officials blderman Harding,
Wages and Citv Attorney Virgil Ramsey for -past services rendered, at the suggestion
of the Mayor.
Alderman Stanford made a motion that the City Attorney file the necessary papers
with the County Court concerning the Annexation of the Veterans Hospital Site
which was..voted upon in the General Election. The motion was seconded by
Alderman Carter and carried unanimously.
Alderman Pages then made the motion that the Council adjourn Sine Die. This motion
was seconded by Alderman Peal and Pecevi.ed the unanimous vote of the Council.
• The Mayor declared the Council adjourned Sine Die.

The Mayor then called the new Council together. Mayor 'C S Tribble administered
the oath of office to the newly elected officers as follows: City Clerk, Otoe
Phillips, Alderman Ward 1, Witt Carter, Ward 2, Earl Shook, Ward 3, A D McAllister,
Ward 4 John Bynum. City Attorney Rex Perkins.
Alderman Carter made the -motion seconded by Alderman Stanford and carried
unanimously by the council that E M Ratliff have charge of the rental of the
old Aviation Field.
Alderman Peal made the motion that the Mayor declare the week beginning with April 16t]
as Clean up week the motion was seconded by Alderman Carter and -carried-.unanimously.
Alderman Carter made IT..e motion seconded by Alderman Gregory and passed unanimously
by the Council that the Mayor, Citv Engineer and the Chairman of the Street
Commissioners have charge of marki.,g of -the Streets.

Fayetteville City Council met in regular session Monday April 16,1934.
Present: Alderman Peal, Carter, Stanford, Mc Allister and Shook, City Engineer E M Ratliff,
Chief of Police Neil Cruse, Absent Mayor T S Tribble, City Clerk Otoe Phillips,
Alde*man Bynum, Gregory, and Sanders.
The meeting was called to order by Alderman Stanford, Alderman Garter moved that
Alderman Stanford be elected Mayor pro tem. The motion was seconded by Alderman
Peal. Upon the motion being put by Alderman Carter all present qnd voting voted
for the motion and Alderman Stanford was elected Mayor pro -tem. The ]Mayor Pro -tem
tl•en asked the City `ngineer E M Ratliff to act as clerk of the meeting and record
the minutes.
The minutes of the me�ting�held April 9th were read and approved.
Mr. J E Brewer presented a request to the Council for permission to:erect an electric
sign on the Bates building on west 'ickson Street. Alderman "hook moved that the
request be granted suhiect to the approval and supervision of the electrical.
inspector. The motion was seconded by Alderman Carter and received the entire vote
of the Council. Mayor protem declaredthe motion carried unanimously.
A communication from the Highway Dept w4s read for imformation. Alderman Cabter
introduced a resolution and moved its adoption. the motion was seconded by
Alderman Peal. Upon roll call all present voted aye- absent and not voting
Alderman Bynum, Gregory, and Sanders. The copy of the resolution 4s as follows:

constructing State highway No. 71 through the City of Fayetteville and is desirous
of routing, the traffic through the City of Fayetteville over School St., Mountain
Street., and College Ave. from the South to the North 'jorporate Limits and across
all intersecting streets.
Whereas, the State "ighway Commission of the State of Arkansas is desirous of
receiving Federal aid for the improvment of said highway; and,
r1b ereas, the Eureap of Public Roads of the Department of Agriculture of the United
States of "merica will not participate in the construction of said highway until and
unless the City of Fayetteville will agree to refrain from permitting, enroachments
upon the right of way of said above mentioned route, and until and unless the City
of Fayetteville still agree to refrain from passing ordinances or laws fixing
unreasonable "speed limits in the said above mentioned route, and tnti.l and unless the
City of Fayetteville will agree to refrain from erecting signs semaphomes end si.F,nals
that will give preference to local routes or that will hinder or delay traffic on
said above route.
Therefore, be. it resolved, by the Mayor and City CouDcil of the "ity of Fayetteville,
"rkansas the, for and in consideration o^ the State Highway Commission of the tate
of Arkansas and the Bureau of Public "oads of the 'ep9rtment of Agriculture of the
Un'ted states of America constructing said highway adoacent to the City of Fayettevil]

and routing the traffic through the City of Fayetteville over the above described
route and.across all intersecting streets. It hereby agrees with the St to Highway
Commission of the State of "rkansas and the Bureau of Public haods of the Department
of Agriculture of the United States of America that it will not in the future permit
enroachments upon the right of way of said above mentioned route, nor will it pass
any ordinances or laws fixing__ unreasonable speed limits on the above mentioned rout(
nob that will slow up, hinder or delay traffic on said above mentioned route.

Claude Atkinson appeared before the Council regarding, the condition of the road to
the Uity dump aroland. This matter was refered to the Street committee and City
Fngi.neer.
Mr. B. B. Bronson appeared before the Council and called attention to the drainage
being done to Locust street by recent rains. No action taken.
Alderman McAllister moved that the Council go into execution session. This motion
was seconded by Alderman Shook,.and received the entire vote of the Council and
the Mayor Protem declared the Council in execution session. This session
consisted of inforffal.discussion and no act was taken.
There being no further business Alderman Carter made a motion seconded by 441derman
Peal that the, Council adjourn. Upon Putting the motion the Mayor Protem declared .1
