Son $1.50, Ozark Station $6.25, Fav Yachine Shop C1. Alderman narding moved the bills he allowed as approved and that the Clerk he instructed to draw warrants for the same upon the proper funds. The motion was seconded by Alderman 6a.rter and carried unanimously. Cut Mr Benton ask permission of the Council to cut the curb at 109 Horth Block, Curb Alderman Harding made the motion xeconded by Alderman Peal that this be granted the same to be under the supervision of the City Engineer. The motion was carried uraminously. Communication from the State Highway Commission was presented to the Council "tating that there would have to be a 60ft right away from West Fountain Street to West Fouth Street before paving. Alderman Gregory made the motion that the City Attorney in conjunction with the City Engineer prepare the necessary papers declaring, School St. from Mount9into West South a Sixty foot Street. The motion was'seconded by •Alderman Peal and was passed unanimously by the Council. Herb Moore appeared before the Council requesting, pay for laying brick for repairing the r'ire Station. And for these services he would accept theileft over stone and his City Car license. Alderman Harding put this in a form of a motion and was seconded by Alderman Peal and carried unanimously. Muni- Tom Eads appeared before the Council relative to a Municipal Garden project, cipal Alderman Gre,gory made 'a motion that three or. four acres of the old aviation field be Garden allowed for this Purpose pipping power with the City Engineer in locating the plat. Ordinance pPrtalning to dogd running at large, which was on its second reading was brought to the attention of the Council. Alderman Harding moved that the Ordinance be placed on its third and final reading Alderman Bynum seconded the motion. On the Clerks calling the roll the following vote resulted. ryes, Bynum, 6arter,.Hardi.ng, Peal. Nays Gregory, Sanders, Stanford Wages. The vote resulting in a tie the Dog fcavor vote in affirmative there by untying the vote. The Clerk read Ordinance the Ordi.nancd third an final time.. The Mayor then put the question'shall the ordinance pass' On the roll call the following vote resulted. Ayes Bynum, Carter, Harding, Peal. Nays Gregory, Sanders, Stanford, Wasps. Mayor voted in affrimatS.ve thereby declaring the*Ordinance carried. The City Atk6rney called the Council's attention to the fact that as the emergency clausewas attached it would be. necessary for a special roll cal as an emergency clauce required a two thirds vote•.•lo -become off ,ctiva. Alderman Peal moved that the Council vote of the Emergency Blause Alderman IvNconded the motion On the Clerk's calling the roll following vote resulted. Ayes arter, Harding, Peal Bynum. Nays Gregory, Sanders, Stanford, Wages. Mayor declared the Pmergency clause lost as their four Nays and four Ayes. An Ordinance to be entitled, " An Ordinance to Prohibdt the Running at Large of Dogs to Provide for the Taking un and the Disposition thereof, and Providing, the Fines and Penalties for the Violation" • Be it ordained by the City Council of the City of Fayetteville, Arkansgs: 9Pction:One: That it shall be unlawful for the owner of any dog or dogs, or any person having charge of any dog or dogs, to allow or permit such dog or dogs to run at large upon any Premises or Street within the corporate limits of the City of Fayetteville, Arkansas, during the months of April, May, June, July, August and September of each year. i Section Two: It is hereby made the duty of each police(. officer of this City to take into custody any and all dogs that may be found running at large within the corporate limits of the said city during the months of April, May, June, July, August, September of each year, and to place the same in the City Dog pound, hereinafter Provided for. Section Three: It is hereby made the duty of the mayor of the City of Fayetteville to provide a suitable place to be known and designated as the "City Dog Pound" to carry out the Provisions of this ordinance. Section Four: After the expiration of five days after any dog has been placed in the City llog Pound, as herein provided ff)r, it shall be the dhty of the paiice officer in charge to kill such dogs and dispose of the carcase, and the day of taking unoof such dog shall he counted the first day. Provided the owner of any dog, may within the five days above provided for or at any time before the dog is kil&ed, redeem or claim sucb�717 dog and have, the same delivered to him upon the payment of the costs of such taking, up which is ascertained to be fifty cents (50e) for each day such dog has been in the City Dog Pound, to the officer in charge or the city collector. MI 2 Pres: 117 Section Six: Whenever any dog has been placed in the pound as provided for in sects (2) that hhs hn a collar bearing a City License Tag, it shall be the duty of the officer in charge of such dog to notify the owner or the person to whom the .license Tag was issued by the City Collector, if suchperson or owner can be found, that the dog has peen taken up and placed in the City Loa, Pound and will he killed within five days unless the fee is paid as provided in Section four (4) of this ordinance. Section Seven: It is ascertained by the City "ouncil that the Provisions of this ordinance are separate and independent, and if any word, clause, sentence or section should be declared void by a court of competent jurisdiction that it shall not interfere withthe remaining provisions hereof. Section Eight: Any person or persons violating any of the provisions of section of this ordinance, shall upon conviction hefore the police ,fudge, he deemed guilty of a misdemeanor and fined in any sum not less than Five Dollars nor more than Fifteen ''ollars. Section Nine; It is further decalred by the City Council that this ordinance is Intended to be accumulative to the ordinances now in force and repeals only such ordinances and parts of ordinances as are in direct conflict herewith. Absent Alderman Sanders, Minutes of the regular meeting were held April 2nd. were read an approved. Bills) The following bills were presented affter their approval by Alderman Peal, Chairman for Maple Street•betwwen of the Auditing, Committee: BhAir's Statione rs 80.50, Harley Gover $40,00, made the H L '"illiams $91.00, Ben Porter $15.00, -Magnolia Pet Co. 160.65, Bil].:Britt $2.50 and filed, the motion was seconded Dale Allen Auto Service ;36.80, A F Shumate 118.00, Goss Rogers Elec Co 9189.79 and was passed unanimously Lewis Bro $0.25, Salsbury Gen Shop $2.60, B L King $25.00. Alderman Bynum moved that H L'17illiams-nresented the hills be allowed as approved and that the Clerk be instructed to draw -warrants Election for the same upon the proper funds. The motion was seconded by Alderman Harding Bynum made the motion seconded by and duly passed by the douncil. Gregory that Parmiss4n App°lination: for permission to `cut the curb at -their -'residence was asked •by to , Roy 71 Roberts and Walter McWhorter. The motion was made by Alderman Wages and Icut curb! seconded by Alderman Bynum that this be granted the same to he under the i i supervision of the City Engineer. Res- Resolution •+vas presented to the Council asking that a side walk be put in along for Maple Street•betwwen College Avenue and Mission Street. Alderman Carter made the Side Wak motion that the resolution be received and filed, the motion was seconded by Alderman Gregory and was passed unanimously by the Council. H L'17illiams-nresented to the Council a bill for the expense of the General Election for the City field April 3rd,Alderman Bynum made the motion seconded by Alderman - Gregory that this amount be'allowed. Alderman Stanford intrRROAFV919 entitled "An Ordinance Establishing and fixing, The Width of South School Avenue, Fayetteville; Arkansas, and Dedicating the Same for Use by the Public." The Ordinance was read the .first time in its entirety by the Clerk. Alderman Gregory made the motion seconded by Alderman Peal that the rules be suspended and the ordinance he placed on its second reading. Upon the question being put before the Council it received the unanimous vote and the Clerk read the ordinance the second time. Alderman Carter moved that the rules he further suspended and the ordinance be placed on its third an final reading. Alderman Bynum seconded the motion which received the entire vote of the Council. The Clerk then read the ordinance the third and final time. The Mayor put the question 'Shall the Ordinance pass." On the Clerk's calling the roll the following, vote reuslted. Ayes Alderman Bynum, Carter, Gregory, Harding, Peal,c•Stanford, Wages. Nays none. Absent an not voting one.. The Mayor declared the Ordinance passed as there was 7 Aves and no Nays. ORDINANCE N0. 772 An Ordinance Entitled," An Ordinance Establishing and Fixing the Width of South School Avenue, Fayetteville, Arkansas, and Dedicating the Same for use by the Public." Be it ordained by the City Council of the Citv Of Fayetteville, Arkansas: Section 1. That the width of South School Avenue frpm the North line of west Mountain Street to the South line of Prairie Avenue, Favetteville, Arkansas, is hereby declared to be, is fixed and shall remain at sixty feet.
