Pavet�teville City Council met in regular session Monday, January S. 1934.
Present: Mayor T. S. Tribble, City Clerk Otoe Phillips, City Attorney Virgil Ramsey, City En
gi'neer E. M. Ratliff, Aldermen Bynum; Carter, Gregory, Harding, Peal, Sanders, Stan-
ford, Wages.
Minutes of the regular meeting held January 1st, 1934, were read and approved.
Bills: The following bills were 741411' presented after their approval by Alderman Peal, Chairman
of the Auditing Committee: Bohe Gro. $2.51, Henry Walker,,Clerk, $3.00, Mrs. H. L.
Pearson $5.00, Ben Porter $15.00 Allen Strain $2.00, Magnolia Pet. Co. $$74.97, Gene
Webb $1.20, Montgomery -Ward Co. 667.65, A. F. Shumate $18.00, Fayetteville Machine
Shop $0.50. Alderman Carter moved that the bills be allowed as approved and the Clerk
be instructed to draw warrants for same upon the proper funds. The motion was seconded
by Alderman Harding and carried unanimously.

The .financial report of North Lederett Improvement Dist. No. 1 for the latter half of
the year 1933 was presented. By motion of Alderman Bynum, seconded by Alderman Greg-
ory, and duly passed by the Council, the report was ordered received and filed.
The report of J. F. Stanford, Veterinarian, in compliance with Dairy Ordinance No. 762
was read by the Clerk. Alderman Harding moved that the report be received and filed.
The motion was seconded by Alderman Peal and received the entire vote of the Council.

to the above request. The motion was seconded by Alderman Peal and received the unan-
imous vote of the Council.
Alderman Gregory made a motion that the City Attorney be instructed to prepare a Res-
olution asking the Fact -Finding Tribunal to investigate the rates charged by the S. W.
.Bell Telephone Co, in the City of Fayetteville. The motion was seconded by Alderman
Bynum and carried unanimously.
No further business Alderman Sanders moved t1 -at the Council Adjourn. Alderman Wages
seconded the motion which was duly passed by the Council and the Mayor declared the

By motion of Alderman Harding, seconded by Alderman Peal, and duly passed by the
Council, the reports were ordered received and filed.
The resignation of D. A. Burson as member of Police force was presented. By motion
of Alderman Bynum, Seconded By Alderman Wages, and duly passed by the Council the
Resignation was accepted.
' Resol- A'resolution pertaining to obtaining aid from the Fact Finding Tribunal in figuring
�utton the basis of rates charged by the S. We Bell Telephone Co. was bro3ght up for Dis-
cussion. Alderman B:mum moved that the resolution be adopted. Alderman Peal seconded

WHERRAS, the.City of Fayetteville is desirous that the rates being charged as listed
above be investigated by the fact Finding.Tribunal, created under and by the virtue of
Act 72 of the Acts of the General Assembly of the StHte of Arkansas for the year
of 1933.
Now 'therefore, be it resolved by the City Council of the City of Fayetteville,
Arkansas, that this council hereby requests that Fact_ Finding Tribunal to make
an investigation, finding, and report upon the basis for rates charged the citizens
of Fayetteville, Arkansas, by the Southivestern Bell Telephone Company, and report its
findings to the city council at as early a date as is practical.
tBF"IT FURTHER R'SOLVED, That Mayor T. S. Tribble, is hereby designated as the Agent
of the City for service of all notices growing out of the investigation hereby reques

endurance contest and providing a penalty for the violation.hereof." Whereas, it has
been determined by th_s body that endurance contest; continuing for a lomg time is
injurious to health, Therefore:
Be it ordlined by the City council of the City of Fayetteville. Arkansas,
Section One: That it shall be unlawful for any person, organization, firm, or
corporation to conduct, promote, participate in, or cause to be conducted within
the corporate limits of the City of Fayetteville, Arkansas any endurance contest
wherein human beings are contestants therein, which contest lasts .for a longer period
than (12) hours.
Section Two. Anv person who shall conduct, participate in, or promote any endurance
contest within the corporate limits of the City of Fayetteville, Arkansas, in
violation of section one of this ordinance shall, upon conviction In Police Court
of this eity, be fined in any sum not less than twenty-five (t25) Dollars, nor more
than thirty-five ($55.00), and each such violation shall constitute a separate offence.
Section Three. This ordinance being for the protection of the public peace, health 0,
safety, and in the exercise fo the police powers of the Municipal Government, and eme
is hereby declared to exist, and this ordinance shall be in _full force and effect fro
and after its passage, approval and publication.

its third and final reading. Alderman Harding seconded the motion, which received the
unamious vote of the Council present. The Clerk then read the ordinance the third
and final time. The Mayor put the Question "Shall the ordinance be pass4"dOn the
Clerks calling the roll the following vote resulted. Ayes: Bynum, Carter, Harding
Peal, Stanford and k1ages. Nays: None. Absent and not voting Gregory and Sanders.
The Mayor declared the ordinance passed as there were 6 Ayes and no Naps.

According to Clerk's report the Bond Act lacked $400.00 needed to care for interest
due Feb late By motion of Alderman Wages, seconded by Alderman Carter, passed
by the Council the Mayor was delegated to investigate borrowing this amount.
By motion Alderman Wages, Seconded Alderman Stanford the City Attorney was
instructed to wire Washington County Legislatorsnon behalf of the City to vote for
the original Refunding Bill as first drafted.

Fire The need for additional hose for the Fire Department was brought to the
Hose attention of the Council. Alderman Harding made a motion seconded by M--derman Peal
that the City Attorney draw up an ordinance for purchase of 1200 feet of hose
and have the Board of Public Affairs to authorise such a purchase. The motion
was carried unamiously.
Present:
The Mayor Called the Council'S attention to the condition of child in destitute
eirctmstances stating that an operation was imperative. Doctors saying that they
would operate free of charge, if hospita3 'expenses be paid. Alderman Harding
moved that the City pay these .fees, Alderman Carter seconded the motion. The
motion receiving the entire vote of the Council.
A motion to adjourn made by Alderman Harding and seconded by Alderman Bynum
was duly passed by the Council and the Mayor declared the Council adjourned.

A F. Shumate $18.00. Alderman Bynum moved that the bills be allowed as approved and
the Clerk be instructed to draw warrants for the same upon the proper funds. The
motion was seconded by Alderman Harding and carried unamiously.
Permission was asked by Majestic Cafe, Armstrong Gro. and Peoples Bafe for
Electric electric sign. By motion of Alderman'Sanders seconded.jb7 Alderman Bynum, and duly
Signs. passed by the Council permission was granted, same to he under supervision of the
City Inspector.
R Gary presented a letter stating that the City Electric code had not been followed
in the repair work on the City Fire Station. By motion of Alderman Wanders, seconded
Gregory thatthis wiring be put in according to the code. Motion being duly passed
by the Council.
Alderman Stanford introduced an Ordinance entitled An Ordinance to Authorize and
Ordinance Direct the Board of Public Affairs of the City of Fayetteville, Arkansas, to
Purchase Twelve Hundred feet of Fire Hose". The ordinance was read the first time
in its entirety by the Ulerk, Alderman Harding made the motion seconded by Alderman
Ca^ter that the riles be suspended and that;.the ordinance he placed on its second
reading. Upon the question being put before` the.Cour.cil it received the unamiou,s
vote and the clerk read the ordinance the sepond time. Alderman Carter made the.'
motion that the ordinance he amended, and that the cost be struck out, the motion
seconded by Alderman Peal, and received the entire vote of the Council.
Alderman Sanders moved that the rules he father suspended and the ordinance he
Placed on its third and final reading. The motion was seconded by Alderman
Harding and received the entire vote of the Council. The Clerk then read the
ordinance the third an final time. The Mayor then put the question "Shall the
Ordinance nass." On the Clerk's calling the roll the following vote resulted:
Aves: Carter, Gregory, Harding, Pena, Stanford, Afes llages,Byrum and Sanders.
Absent and not voting none. The Mxvor declared the Ordinance passed as there were
8 Ayes and no Nays.
OPdinance No. 766
An Ordinance to be Entitled,"An ordinance to authorize and direct the Board of Public
affairs of the City of Fayetteville, Arkansas, to purchase twelve hundred feet of
fire hose."
Be it orddined by the City Co:mcil of the City of Fayetteville, Arkansas;
Section One. That the board of public affairs be, and they are hereby authorize
and directed to advertise and purchase twelve hundred (1200) feet of two and one
half (2'k) inch fire hose for the Fayetteville Fire Department, and to award a contract
for the purchase of the same.
Section 2. All ordinances and parts of ordinances in conflict herewith are hereby
repealed and this ordinance shall he in full force and effect from its passage,
approval and publication.
