The report on the samples of the Gity milk, suripl.y which were run on October 11th, 1633
by Wm. L. Bleocke.r, Bacteriologist, was read in its entirety. Al.dermgn Wages made e me
tion that the .report he received, published, and filed. The motion was seconded by Al-
derman Bynum, and received the unanimous vote. of t.be Council.
Alderman J. K. Gregory introduced and ordinance entitled "An Ordinance to amend Ordi-
nfl"Ce No. 3l.i as amended by Ordinance No. 442, as amended by Ordinance No. 757, of the

itary dairy conditions". The ordinance was read in its entirety by the Clerk. Alderman
Grer>ory moved that the rules he suspended and the ordinarce placed on its second read-
ing. Alderman Bynum seconded tl�e motion, which received the entire vote of the, Council
Present. The Clerk then read the ordinance the second time. Alderman (:reeory moved tha

centimeter as many as three times in twelve months shall he revoked. Aldermar Harding
seconded the motion, which received the entire vote of the CO1)rCil present. After fur-
ther discussion, Alderman Carter made a motion that the rules he further suspended and
the ordinance be Placed on its third and final reading. Aldnrmeln Bynum seconded the mr
tion, which received the unanimous vote of the Council Present. The Clerk then read th
ordinarce the. third and final time after which the Irayor out the question "Shall the

An Ordinance to he entitled "An Ordinance. to amend Ordinance 1?0. 313 as amended by
Ordina;rce No. 442, as amended by Ordinance Vo. 7572 of the Ordinances. of the City of
Fayetteville, Arkansas, and to provide for more sapitary dairy conditions".
Be it ordained by the Gitv Council of the City of Fayetteville, Arkansas;
Section One; Amend Ordinance No. 313 as amended by Ordinance No. 442 as amended by
Ordinance No. 757 to read ar follows, to -wit:
1. That a1.1 floors in dairy barns and autt.ers sha1.1 he corstructed of concrete. or oth
er water tia*bt materials and the same shall not he dirt or clay and no other live
stock shall be housed in the dairy barn.
2. That no Permit; shall he granted or license issued to any person, firm or corpora-
tion to sell mi1lr in the Citzr of Fayetteville, Arkansas, until. dairy barns are so con
structed and the terms of the Ordinances of said Cite gra, strictly complied with.
3. That the license fee to sell milk in the Citv of Fayetteville, Arkansas, shall be
as follows: The license fee shall he at the rate of x;;2.00 Per year, Per cow, payable
in advance on the 1s1; day of January of each year, or at the time when such cow (or
cows) Is added to the herd or the milk is offered for sale.
4. All the, tests Provided for by this Ordinnrce shall he paid for by the City Collect
or out of the funds derived from dairy license fees.
5. That al.l cattle used in supplying milk to the City of Fayetteville, Arl•ansas, in-
cluding those cattle sun.Plvi.nF milk to any nasteurizfng Plant and all, dealers and mar.-
ufacturers of any by-product to he sold or resold in the City of Fayetteville, Arkan-
sas, and to dairymen, he subject both to the Tuberculi.ne and Abortion tests before any
new Permit shall. be granted and that all cattle so furnishing milk to the City of Fay-
etteville, Arkansas, shall he. annually tested during the months of September, October,
November, a'd December for Tuberculosis and' contagious and infectious Ahcr tion. Pro-
vided that this Ordinance shall not apply to butter, buttermilk, cottarre cheese, or
cheese.
6, That, milk must be bottled in a senarate riilk house from that of the home or' resi-
d,nce of the family and in the manner rrovided for in the City Dairy Ordinance now in
force and effect.
7. That the milk of all dairymen which is now subject to a b'ICter'ial gest shall show
by said test to contain more than 200,000 bacteria Per cubic centimeter shall he Pub-
lished in some newsnaper Published in the City, and that the Accredited Veterinarian
shall furnish a cony of all hactPrial tests to the. City Council.
8. That -the license of all dairlrmen whose milk shows bAr bacterial tests to conta=in
more than 200,00() bacteria Per cubic centimeter as many as three times in twelve
months shall he revoked.
Section Two: Ordinance No. 313 is hereby amended as follows: In Sections 8, 9, and 10
of said Ordinarce 313 shall hereafter read "City Collector" where it now reads "City
Health O''ficer". Section 13 of said Ordinance No. 313 is amended to read "That all. cov
and herd hulls two years of ape and over shall he tested by an Accredited Veterinariat
annually durinlr the months of Sevteelher, October, Navernhar, and December for Tuhercu-
losis at a Price not to exceed eighty-five cents per }'lead and shall at once., after cot
nletion of said test, supply the City Collector with a copy of the test chart form:
T. C. Revised No. 22 U. S. Department of Agriculture, Bureau of Animal Industry, and
the City Collecter shall then pay to the Accredit;ed> Veterinarian making said test not
more than eighty-five cents per head for each animal tubercular test". Sections 19,20.
-and 21 of Ordinance No. 313 are amendedto read "Accredited Veterinarian or Police
Ofricer" instead of "City Health Officer".
Section. Three: All owners of two or less cows vithi_n the corporate lirilits of the City
of Fayetteville, Arkansas; and all owners of one or more cows outside the City limits
of Fayetteville, Arkansas, who sell mill: within the City limits 'to any Person, or to
or to any dairyman, pasteurizer, or anv milk Products COmnany to he resold and consum
ed within said City of Fayetteville, Arkansas, shall make anpl.ication to the City
Collector for a nermit as provided for in Section 8 of Ordinance 313. The City Col.lec•
tcr shall then furnish the applicant with the names of Accredited Veterinarians, and
when cows are tested as provided for in Section One of this Ordinance shall. he issued
a permit by the City Collector as Provided for herein, and shall he subject to a].1 thl
provisions of Section 6 of this Ordinance.
Section Four: All dairy cods and bul-Is as provided for in this Ordinance, Sections 3
and 4, shall he tested for i.rifectious or contagious Abortion when the Accredited Vet-
erinarian finds by his inspection that 2% of the cows in said herd are aborting.
Section Five: All Accredited Veterinarians shall present to the Citv Council on their

the possession of liquor". The Clerk rend the. Ordinance the, first time in its entiret,

Section Seven; Any nerson violating any of the Provisions of this Ordinance shall he
deemed guilty of a misdemeanor, and upon conviction thereof before the Police Judge,
shall he fined in any sum not -less than sin .00 nor more than Y100.00, or by imprison-
ment in the City Jail for not more than thirty days, or by both fine and imprison-
ment.
Section Eight: All Ordinances and parts of Ordinances in conflict herewith are hereby
renealed and this Ordinance shall take effect and he in force from its passare,
approval and Publication.
