The protest of 11. S.•Pollard on assessments in Plater Imp. Dist. No. 3 was carried over.
The City Attorney reported his findings as to condemnation of No. 201 W. Lafayette as
follows: the property is not in the Fire. Zone but the Fire Chief might investigate as
to fire hazard: if a public nuisance, the Bofird of Health would have ,jurisdiction; if
a house of ill fame, the Police Dept. would have charge. Alderman Gregory moved that
the matter he referred to the Health Ifficer. Alderman Harding seconded the motion,
which received the entire vote of the Council.
Report: The Committee for investigating, ways and means for obtaining Government aid in the
erection of a Municipal building reported as follows; that they had met with Vincent
M. Miles, Regional Director, and find that application must be. in Washington before
December 2()th, 1933, and that municipal building, projects are among those favored by
the R. F. C. The Committee also recommended that the City Engineer and the City Clerk
prepare a statement as to outstanding obligations of the City, and the likelihood of
being gble to meet 'other obligations that might he assumed. The recommendation was put
in the form of a motion and passed unanimously.
Geo. A. Burst appeared before the Council XXXX" asking that a Board of Commissioners
to handle Fire and Police Departments according to Act 28 of the 1933 Assembly of Ark-
ansas be appointed. The Mayor requested the City Attorney to get an or'nion from the
Attorney General as to the legality of the referendum petition filed with the City
Clerk relative to the above matter.
The matter of checks from wholesale distributors of beer being, held by the City Collec
for was brought up. Alderman Gregory made a motion that the Clerk be instructed to no-
tify the wholesale dealers that their checks would be cashed and perr..i.ts issued on
Sept. 30th, 1933. This motion was seconded by Alderman Sanders and received the entire
vote of the Council.
Alderman Wages moved that the Council adjourn. Alderman Bvnum seconded the motion
which was duly passed by the Council and the Mayor declared the Council adjourned.

The followign bills were presented after their approval by Alderman Peal, Chairman of
the Auditing Committee: S. W. Gas & Flectric Co. $314.10, C. H. Bynum $>6.00, Ben Porter
±110.00, Guy Ititchell $$4.25, Bossemeyer & McBride $4.50, A. F. Shumate $$18.00, Bosse-
meyer & McBride x,+4.25. Alderman Harding moved that the hills he allowed as approved ane,
the Clerk he instructed to draw warrantB for same upon the proper funds. This motion
was seconded by Alderman Bynum and received the unanimous vote of the Council.

Re -assessment sof benefits in University Imp. Dist, No. 1, Duncan St. Imp. Dist.. No. 3E
and Water Imp. Dist, No. 3 were presented. By motion oiff Alderman Sanders seconded by
Alderman Peal and duly passed by the Council the assessments were ordered received and
filed.
Interest:
The Clerk called the attention of the Council to the fact that interest on overdrafts
due the First XXXT QXI National Bank to Sept. 19th amounted to $$1006.20. Alderman Wages
made a motion that the Clerk be instructed to draw a warrant for this amount payable
to the First National Bank. Alderman Harding seconded the motion, which received the
unanimous vote of the Council.

1"rs. "T. R. Lighton appeared before the Council asking that the City assAnt in cleaning
un the esnlana�de on Arkansas Avenue, and. stated that vd.th the money already donated
$5.00 would be sufficient to take care of the. matter. By motion of Al.dr.rman Hardin v,
seconded by Alderman Peal, and duly gassed by the Council, the. request was granted and
the Clerk instructed to draw warrant for $5.00.on the Street Fund.
Mayor Tribble called the attention of the Council to the fact that, the Flying Field
Fund and the Aviation Fund are and should be o�n�� and the same, and'askr.d that the
accounts be combined, in order that a 4$500.0(�RY he taken care of. Alderman Wages
made a motion seconded by Alderman Bynum tha�the Clerk be instructed to transfer
enough money from the Flying Field Fund to the Aviation Fund to take care of the bond.

Alderman Wailes moved that the Council recess, to come together again on Thursday, Oct.
5th, 19:1:5, at 7.30PM for the Purnose of Passing on an ordinance calling for an electio'
to vote on the proposed municipal building. Alderman Sanders seconded the motion which
rrceived the entire. vote of the Council, and the Mayor declared the Council recessed
till Oct: 5th, 1933.

Recessed meeting of the City Council of the City of Favettevi.l.l.e. Arkansas, held Thurs
day, October 5th, 1933,
Present:I Mayor T. S. Trihhle, City Clerk Otoe Phillips, City Attorney Virgil Ramsey, Aldermen
Bynum, Carter, Harding, Peal, Sanders, and Stanford. Absent: Aldermen (rreaory and Wanes.
Alderman J. F. Stanford introduced an ordinance to be entitled "An Ordinance calling a
snecial election to be held on the 14th day of November, 1033, at the several rolling
Places in the City of Fayetteville, Arkansas, for the purpose of determining by ballot
whether or not said City shall issue bonds to the sum of $,45,5n000n, with which to Pur.
chase a site and construct a building for a City Hall". The Clerk read the. ordinance
the first time in its entirety. Alderman Harding, moved that the rules he. suspended and
the ordinance placed on its second reading. Alderman Peal seconded the motion which
received the entire vote of the Council present. The Clerk then read the ordinance the
second time. After discussion, Alderman Sanders movrd that the rules be further sus-
pended and the ordinance placed on its third and final reading. Alderman Bynum secondee
the motion. On the Clerk's calling the roll the following vote resulted: Ayes: Bynum,
Sanders. Nays: Garter, Harding, Peal, Stanford. Absent and not voting: Gresory, Mages,
The Mayor dac].ared the motion lost as there were 2 Ayes and 4 Nays. The ordinance was
left on its second reading.

An opinion from. the Attorney Gene*•al's office given to Citv Attorney Virgil Ramsey was
read by the Clerk, as follows: that the referendum petition filed under the provi.siors
of Act 28, 19:13, will Prevent the Act from taking effect
A communication from I. L. Young of the Frisco Hailway relative to the constr-uction of
a walkway on viaduct over the main line at lAaole Street was read to the Council. Mr.
Young stated that as soon as the sidewalk construction ;vas started on either side of
this viaduct that, the railroad would do their part, and that he would be in Favett.e-
ville soon to confer with the City Officials on this project.

The Clerk presented a statement of $68.93 for taxes due on City nronrrty in Block 16,
Tax:
Original Town, in Alley Improvement District No. 40. By motion of Alderman Harding,
seconded by Alderman Stanford, and duly passed by the. Council, the Clerk was instruct-
ed to draw a warrant for this amount on the street
