Fayetteville City Council met in regular session Monday May 29th, 1933.
Present: IAayee T. S. Tribble, City Clerk Otoe Phillips, City Attorney Virpi.l Ramsey; City
Engineer E. M. Ratliff; Chief of Police Neal Cruse.,'Aldermen Bynum, Carter,' Gregory,
Harding, Peal, Sanders, Stanford, and Wages. Absent, none.
Minutes of the regular meeting held May 22nd, 1933, were read and approved.
Bills: The following bills were presented after their aprroval-by Alderman Peal, Chairman, of
the Auditing Committee; S. W. Bell Telephone Co. 9;40.03, Willis Strange x'2.40, Bill
Haves A2.40,'r. S. Stonesifer $2.40, lied McGuire $2.40, Earl Stewart 9.;2.40, Z. M.
Bar.icom 62.40, A. F. Shumate $$18.00. Alderman Carter made a motion that was seconded
by Alderman Bynum that the hills be allowed as approved and t'•e Clerk be instructed
to draw warrants for same upon the proper funds. This motion received the following
vote; Ayes, Bynum, Carter, Gregory, Harding, Peal, Sanders, Stanford. Nays, none.
Alderman Wages riot voting.
Dairy I The attention of the Council was called to the proposed dairy ordinance which was on
Ordinance: its second reading. Ald.eriivt Gre& y moved that the Ordinance be amended as follows;
That the license fee be ?..50�fc�r each cow .from which milk is sold in the City of
Fayetteville, Arkansas. Alderman Carter, seconded the. motion which received the folio
ing vote: Ayes, Gregory, Harding, Peal, Stamford, Bays, Bynum, Carter, Sanders, Mage
Mayoribble voted Nay, therehy defeating the motion. Alderman Grepory tl:en offered
the follow^ g amendment: That the license fee for three cows or more shall. be 82.50
for each cow, and the bacterial test shall he compulsory and paid for by the City
from these funds. The Council voted unanimously that the amendment be embodied in th
Ordinance. A106rrE n Fvnum made a motion seconded by Alderman Sanders that the Ordi-
nance he placed on its third and final reading. This motion was duly passed by the
Council and the Clerk read the Ordinance the third and final time. The Mayor the put
the question "Shall the Ordinance pass". Upon the Clerk's calling the roll the folio
ing vote resulted: Ayes, Bynun , Carter, Gregory, Harding, Peal, Stanford, and l7ages
Nays, Sanders. The Mayor declared the Ordinance passed.
Ordinance No, 757,
An Ordinance to be entitled "An Ordinance to amend Ordinance No. 313 as
amended by Ordinance No. 442 of the City df Fayetteville, Arkansas, and to provide
more sanitary dairy conditions";
Be it ordained by the City Council of the City of Fayetteville, Arkansas:
Section One; Amend Ordinance No. 313 as amended by Ordinance No. 442 to read
as follows: 1. That all. floors in dairy barns and gutters shall be constructed of
concrete or other water tight materials and the same shall not be, dirt or clay and
no other live stock shall be housed in the dairy barn.
2. That no permit be granted or license issued to any person, firm or
corporation to sell milk in the City of FayettevErlle, Arkansas, u:•til dairy barns a
so constructed and the Ordinance strictly complied with.
3. That the license to sell mil.k in the City of Fayetteville, Arkansas,
shall be as follows: The license fee .for three cows or more shall be $2.50 for each
cow, and the bacterial test shall be compulsory and paid for by the City from these
funds, said license to he paid in advance.
4. That all cattle used in supplying milk to the City of Fayetteville,
Arkansas, including those cattle sunplvinA milk to any pasteurixirpp plant and sil
dealers and manufacturers of any by-product to be sold or re -sold in the City of
Fayetteville, Arkansas, and to dairymen, he subject both to the Tuberculine and the
Abortion tests before any new permit'shall be granted, and that all cattle so furni

ng milk to the City of Fayetteville, Arkansas, shall be a•lnual.ly tested during the
months of April and May for Tuberculosis and contagious and infectious Abortion.
5. That milk must be bottled in a separate milk house from that of the
home or residence of the family and in the manner provided .for in the City dairy
;Ordinance now in force and effect.
6. That the milk of all dai omen which is now subiect to a bacterial.
test shall show by said test to contain more than 200,000 bacteria per cubic centi-
meter shall he published in some newspaper p•iblished in the City, and that the City
Health Officer shall furnish a copy of all bacterial tests to the Citv Council,
Section Two: All Ordinances and parts of Ordinances in conflict herewith are
hereby repealed, and this Ordinance shall take effect and be in force from and after
its passage, approval and publication.

After discussion, Alderman Gregory made the following motion: That the Council go on
record as stating that it will not oppose the action of the Yater Commission of the
City of Fayetteville, Arkansas, in racquiring the contract now existing between the
Citizens Committee of the Garment Factory and Ely -Walker Dry Goods Co, providina the
total amounts expended only cover principals and do not exceed $6,546.16: Also acqui
ing warranty deed and title to the Plater Plant of the Western Methodist Assem}ly, ex
renditures not to exceed $5,447.15; The above amounts covering the following items:

Lights; Resolution of the City Council of the City of Fayetteville, Arkansas, directing,

Whereas, in the interests of economy and for the efficiency, and in order to es-
tablish a permanent solution of the financial Problems with respect, to our streF
livhts: and in order to carry out the orders of the FinPrce Committee to keep the ex-
pense of the City within its revenues,
Whereas, the revenues of the City of Fayetteville, Arkansas, have been greatly
reduced due to a great many who have let their taxes go delinquent because of inability
to pay, therefore
Be it resolved by the Citic Council of the City of Fayetteville, Arkansas,
That the Manager and other proper officials of the South-Vlestern Gas & Electric
Co. furnishinc± electricity to the City of Fayetteville, Arkansas, be directed, and
they are hereby ordered and directed to reduce the candle power of all lamps used in
the City of Fayetteville, Arkansas, according to the following schedule;
All 100 3i➢iXXX candle power lamps reduced to 60 candle power;
All 250 candle power lamps reduced to 100 candle power.
That the provisions of thds resolution shall take effect immediately after its
rlissage and approval.
Passed and approved the 29th day of May, 1933.

Ord inan e Alderman Senders introduced an ordinance entitled "An Ordinance to amend. Section One
110. 758. of Ordinarce No. 439, passed and aprroved the 18th day of November, 1921, as amended
by Ordinance No: 440, by the City Vouncil of the Gity of Fayetteville, Arkansas".
The ordi arce was reap, the first time in its entirety by the Clerk, whereupon Alderman
Sanders moved that the rules be, suspended and the ordinance be placed on its second
reading. The motion was seconded by Alderman Harding and received the entire, vote of
the Council. The Clerk then read the ordinance the second time. Alderman Bynum moved
that the, rules be further suspended and the ordinance be. placed on its third and fi-
nal reading. Alderman Peal seconded the motion vrhich received the unanimous vote of
the Council, and the Clerk .read the oddinance the third and fi.ral time. The Mayor put
the question "Shall the Ordinance pass". On the Clerk's cnll.inv the roll the follow-
inr. vote resulted: Ayes, Bynum, Carter, Gregory, Harding, Yea 1., Sanders, Stanford, and
Wages. Nays, none. Absent and riot voting,, none. The Mayor declared the Ordinance Passed

An Ordinance to he. entitled "An Ordinance to amend Section One of Ordinance
Number 439, passed and approved the 18th day o" Yovem}ler. 1n21, as amended by Ordina

Section One; Amend Section "One" of Ordinance Number .439, as passed and apnroe
ed the 18th day of November, 1921, as amended by Ordinance Number 440 to rPrid as $ffi xa
follows: That from and after the 1st day of July, 1933, and on the same date of each
year thereafter; each person., firm or corporation owning, leasing, or using any elec-
tric power pole, telegraph pole, or telephone role either individually or ,jointly, lo-
cated within any street or alley within the corporate limits of the City of l'ayette.-
vi.11e, Arkansas, shall pay an annual City license tax which is hereby fixed*at the
rate of Fifty Cents 7�$R$ (501) for each pole so owned, leased or used by said person,
firm or corporation. where the same pole is used by -more than one person, firm or
corporation each person, firm or corporation owning, using or leasing, said pole shall
pay said license fee at the rate of Fifty Gent^ per pole, whether used ipAivi.dually,
Jointly, or severally.
Section Two: This Ordinance is intended, and construed. to he, cumulative, and
does not repeal any Ordinance now in force unless such Ordinance is in direct conflict
herewith,
•Section Three; This Ordinance shall take effect and be in force from and af-
ter its passage, approval and publication.

Allen Strain appeared before the Council. asking that some adjustment be made as to the
salaries of the day drivers and night drivers of the Fire Department. The matter was.
referred to the Fire Committee and the Fire Chief.
A motion to adjourn made by Alderman Sanders and secoriderd by Alderman wages was duly
Passed by the Council and the Mayor declared the Council adj ourned,
