Tribble, City Clerk Otoe Phillips, City Attorney Virgil Ramsey, Chief of Police Neal Cruse, Aldermen Bynum, Harding, Peal, Stanford, -and Wages. Absent; Aldernen Carter, Gregory, and Sanders. Minutes of the regular meeting held May let, 1933, were read and approved. Rills: The following bills were presented after their approval"by A1de.rman,Peal, Chairman of the Auditi.np, Comiittep: Otoe Phillips x'3.00, Salsbury General Shop $0.50, Fay- etteville Printing Co: 124.18, Rock Street Gro, $4.00, A. P. Shumate 118.00, Suttle Service Station ?4.25, American -La France Co. 1;152.35, Alderman Harding made a mo- tion that was seconded by Alderman Bynum that the, bills he allowed as approved and the Clerk be. instructed to draw warrants for same upon the proper funds. This mo- tion received the entire vote of the Council present a.id the Mayor so declered. Reports: The following reports for the month of April; 1933, were read in their entirety by of Citv the'Clerk: T. S. Tribble as Purchasing Agent; Otoe Phillips as Citv Clerk and as Official City Collector, Clem Pearson as Police Judge, Neal Cruse as Chief of Police, and Clyde Iflalters as Fire Chief. After the reading of the reports Alderman Bynum made a motion that the reports be accepted e's read and the Clerk he instructed to file same. This motion was seconded by Alderman 6'lages and was duly passed by the Council. Dairy: A paper recommending changes in the existing Dairy Ordinance was read by the Clerk. By motion of Alderman Harding, seconded by Alderman Bynum, and duly passed by the Council, the matter was referred to the Ordinance Committee and City Attorney. A motion to adjourn was made by Alderman Harding and seconded by Alderman Peal. The motion recei-7ed the entire vote of the Council and the Itiayor declared the Coun- cil adjourned. Tribble, City Clerk Otoe Phillips, City Attorney Virgil Ramsey, City En p,ineer E. M. Ratliff, Chief of Polise Neal Cruse, Aldermen Bynum, Carter,- Gregory, Peal, Stanford, and Tapes. Absent: Aldermen Harding and Sanders. Minutes of the regular meeting held May 8th, 1933, were recd and approved. v Bills: The following bills were presented after their approval by Alderman Peal, Chairman of the Auditing Committee; S. V1, Gas & Electric Co. $530.90, A. F. Shumate $5:50, We M. Fishhack 111.60, Fayetteville -Printing Co. $26.90, A. F. Shumate $18.00, Mag- nolia Pet. Co. $39.46. Alderman Bynum made a motion that was seconded by -Alderman Carter that the bills be allowed as approved and the Clerk he instructed to draw warrants for same upon the proper funds. This motion received the entire vote or the Council present and the Mayor so declared. Dairy rdinance. An ordinance was introduced by Alderman Grepery entitled "An Ordinance to amend Ordi- n;ince 'do. 313 as amended by Ordinance No.,442 of the City of Fayetteville, Arkansas, KM and to provide more sanitary dairy conditions". The ordinance was read in its entirety by the Clerk. Alderman Bynum made a motion seconded by Alderman Stanford that the rules be suspended and the ordinance be placed*on its second reading. This motion received the unanimous vote of the Council and the Clerk .recd the ordinance the second ling. After discussion the ordinance was left on its second reading. C. M. Davis .requested the Council XM to take some action in regard to the Telephone Co.'s moving a telephone pole from in front of his store or driveway on North College Avenue, Action was deferred till the.matter could he taken up with the Telerhone Co. Request o widen 17, S, Dugga^s asked permission to widen concrete driveway on property at the corner riveway: of Johnson and WR lnut Streets.'By motion of Alderman i7ages seconded by Alderman Carte and duly passed by the Council, the permit was granted, same to be under supervision of the City Engineer. alicious !ischief An ordinance was introduced by Aldarman Gregory entitled "An Ordinance to prohibit rdi.nanceC, the injury to electrical apparatus, and for other purposes". The ordinance was read in its entirety by the Clerk. Alderman Wages made a motion seconded by Alderman Bvnum that the rules be suspended and the ordinance be placed on its second reading. This motion received the unanimous vote of the Council and the Clerk read the ordinance the second time. After discussion, the ordinance was left on its second reading. Skating ink and Alderman J, K. Gregory introduce) an ordinance entitled "An Ordinance to amend Ordi-. owling nance No. 393 of the, City of Fayetteville, Arkansas, and for other purposes". Alderman Carter mv e a motion that rdinance: was seconded by Alderman Stanford that the rules be suspended and the ordinance be placed on its second r•eadinp. This motion was duly passed by the Council and the Clerk read the ordinance the second time. Alderman Carter then made a motion that was seconded by Alderman Stanford that the rules be further suspended and the ordi- nance be placed on its third and final reading. This motion received the entire vote of the Council present and the Clerk read the ordinance the third and final time. The Mayor then put the question "Shall the Ordinance pass". On the'Clerk's calling the roll the .following vote resulted: Ayes, Bynum, Carter, Gregory, Peal, Stanford, and Wages. Nave, none. Absent and not voting, Harding and Sanders. The Mayor declared the Ordinance Passed. 73 Ordinance No. 755. An Ordinance'to be entitled "An Ordinance to amend Ordinance No. 393 of the City of Fayetteville, Arkansas, and for other purposes". Be it Ordained by the City Council of the City of Fayetteville, Arkansas: Section One: Amend Ordinance No. 393, passed and approved June 2nth, 1919, and recorded in the Ordinance Record Book of 1909 at page 535, to read as follows: "That the license or permit for each skating rink and bowling alley operated within the corporate limits of the City of Fayetteville, Arkansas, shall be Fifty Dollars per year, or a part of a year, to be paid in advance, and that no license or permit shall he issued by the month". Section Two: All Ordinances and parts of Ordinances in conflict herewith are hereby repealed, and that this Ordinance shall take effect and he in force from and after its passage, approval, and publication. Whoever shall unlawfial.ly, ma- liciously and intentionally iniure or destroy or -permit to he iniured or destroyed any meter,'pipe,'conduit, wire, line, pole, lamp, or other apparatus belonging to any person, firm, or corporation engaged in the manufacture or sale of electricity for light, heat, power, or any'other purpose, within the corporate limits of the City of Fayetteville, Arkansas, shall he deemed Fr uiltir of misdemeanor and upon con- viction before the Police Judge shall he fined in any sum not exceeding $100.00 or Imprisoned not exceeding one year or by both such fine and imprisonment. Hurst appeared before the Council relative to the request of Homer Cri.stiar that the City refund $35.00 of the `50.00 skating Rink license puchased by him for pne,year. After discussion, Alderman Gregory moved that the Mayor and City Attorney be authorized to handle this matter, and he riven Dower to act. This motion was seconi ded by Aldernar.r. Carter and received the unanimous vote of the Council. Permit; Jack Roberts came before the Council asking oeitwission to break the co:ncrpte at Abshi�r- to Bryan Motor Co. for the purpose of re airin broken bre al; purpose P g pipes. 3y motion of k.lderman Wage�a concrete seconded by Alderman Carter and duly passed by the Council, this permission was grsnt- ed, same to be under supervision of the City i7trineer. Alderman Wages made a motion seconded by Alderman Carter, that the Ordinance be placed on its third and final reading. This motion was duly passed by the Council and the Clerk read the Or- dinance the third and final time. The Mayor then put the question "Shall the Ordi.nanc Dass". On the Clerk's calling the roll the following vote resulted: Ayes, Bynum, Car- ter, Gregory, Harding, Peal, Stanford, and Wages. Nays, none. Absent and not voting: Sanders.
