Alderman Sanders then made a motion, which was se.cor;ded by Alderman Carter, that the ordinance he left on its second reading. The Mayor declared the motion carried as there were 5 ayes and 1 nay, and the m di- nance was left on its second reading. Fire Arequest that Block 32 in the Original Town of Fayetteville be taken into the Fire Zone: Zone was Presented. After discussion, Alderman Hardine made a motion that the Ordi- nance Committee take the matter un and decide what properties in the City of Fa,yette- ville be taken into the Fire Zone. The motion was lost for want of a second. I Asphalt Mr. Frlenc}h of the Moreno-Bi:rkham Construction Co. appeared before the Council and Plant: made a proposition relative to the disposition of the asphalt plant owned by them and remaining in the City. Alderman Gregory made a motion, which was seconded by Aldermari Wages, that the street committee and the City Engineer investigate the matter. This motion received the unanimous vote of the Council and the Mayor so declared. The budget .for the .year 1933 was peesented by the Finance Committee. No action was taken. Bills: The following hills were presented after their approval by Alderman Barr, Chairman of the Auditing Committee, whereupon Alderman Bynum made a motion seconded by Alder- man Harding that the hills be allowed as approved and the Clerk be instructed to draw warrants for same upon the proper funds. This motion received the unanimous vote of the Council and the Mayor so declared and'instructed the Clerk; South Vest - ern Gas & Electric Co. $530.90 T. P: Gann 110.00, Ben Porter $6.0n, Harry Hamilton 69.00, Magnolia Petroleum Co. 652.11, Henry Barton $9.(10, A. P. Pyeatt $3020, A. F. Shumate $30.00. Asphalt A report of the Street Committee and the City Engineer relative to the,proposition Plant: to purchase the'asphalt pinnt owned by the C. A. Moreno Co. and stored in the; City of Fayetteville, together With anew proposition from the'C. A.'Moreno Co. was pre- sented; the new prorosition as follows: that the City of Fayetteville, Arkansas, pay to the Co A. Moreno Co. the sum of $1.00 per year for a period of three years, there by acquiring clear title to said asphalt plant, providing„ however, that said plant is not used by the City of Fayetteville, Arkansas, prior to March 1st, 1936. In the event that the City of Fayetteville, -Arkansas, shall use or allow XXXXKXXKXXi4Hiid this asphalt plant to be used for the Purpose of making asphalt mixtures prior to March 1st, 1936, the City of Fayetteville, Arkansas, shall pay to the C. A. Moreno Co. an additional sum of d`1.00 per ton for all material so mixed, provided that the expenses of labor and equipment necessary to place the plant in or_erating condition be deducted from above sum. After $1,000.00 has been paid the C. A. Moreno Co. on acco•mt of charge per ton for materials mixed as above provided for, the plant shall become the property of the City (Of Fayetteville, Arkansas. Alderman Wages made a mo- tion seconded by Alderman Sanders that the Street Committee and the, City Engineer negotiate with the property owners as to rentals for storage on the asphalt'plant. This motion received the entire vote of the Council and the Mayor so declared. Alderman Harding moved that this report and Proposition be .received and filed. Alderman Barr seconded the motion which was duly passed by the Council. Ordi.nanc'.; Alderman J', K. Gregory introduced an ordinance entitled "An Ordinance to amend Sections 1, 2, and 3 of Ordinance No. 611..1} This ordinance was read the first tire in its entirety. Alderman -Wages then made a motion that was seconded by Alder- man Carter that the rules he suspended and the ordinance he Placed on its second reading. Upon the question being put before the Council it received their unanimous l vote. The Ordinance was left on its second reading. 1 Section one: The Officers of the City of Fayetteville, Arkansas, shall be paid and receive the following salarieseand in no event additional compensation in the way of fees, fines, or perquisites, but.all such fees, fines or perquisites shall be paid into the City Treasury. A, The Mayor shall be paid and receive the sum of Twelve Hundred (d$1200.00) Dollars per annum, payable monthly. B: The City Treasurer shall he paid and receive the sum of Ninety (90.00) Dollars Der annum, payable monthly. C: The Police Judge shall be paid and receive the sum of Six Hundred (600.00) Dollars per annum, payable monthly. , D: The City Clerk shall he paid and receive the sum of Seven Hundred Twenty (720.00) Dollars per annum, pavablP, monthly. - T: The City Attorney shall'be paid and receive the sum of Four Hun- dred Fighty (480.00) Dollars per annum, payable monthly. F; The Aldermen shall be paid and receive the sum of Two and One-half (442.50) Dollars for each meeting at which they may be in attendance. Section two: All Ordinances or parts of Ordinances in conflict with this Ordinance Ordinance: The amended Ordinance entitled "An Ordinance to fix the salaries and duties of cer- tain City Officials, and to repeal Ordinances No. 553 and 606" was brought up for consideration. This Ordinance was left on its second reading February 6th, 1933. Alderman Wages made a motion, which was seconded by Alderman Barr, that the Ordi- nance be placed on its third and final reading. This motion received the entire vote of the Council and the Mayor declared the motion as carried and instructed the Ordinance Clerk to read the Ordinance the third and final time. which was done. Upon the question being put before the Council it received their entire vote and the Mayor so declared "and instructed the Clerk to read the Ordinance the second time, which was done, Alderman Gregory moved that the Ordinance be' amended as follows; that the City Treasurers salary he reduced from 0)120.00 per year to 490.00 Per year. Alderman Barr seconded the motion, which received the unanimous vote of the Council. Alderman Sanders then made a motion that was seconded by Alder man Bynum that the rules he further suspended and the Ordinance be.placed on its third and final reading. Upon the question being put before the Council the follow- ing, vote resulted: Ayes, Barr, Bynum, Carter, Gregory, Harding, Sanders. Stanford, and Wages. Nays, none. The Mavor declared the motion carried and instructed the Clerk to read the Ordinance the third and final time. Ordinance No. 749, An Ordinance to be entitled "An Ordinance descrihing additional duties for the City Clerk, and providing compensation for the same."; He it ordained by the City Coun- cil of the City of Fayetteville, Arkansas: Section one; From and after the first'Tuesday in April, 1935, the City Clerk of the P4KXKEt# City of Fayetteville , Arkansas shall have t:he following additional duties, Wiland shall receive x$100.00 per month as compensation therefor, beginnign on the a- � foresaid date. Section two; It shall be, the duty of the City Clerk to keen an accurate account of iPaP� all moneys .received by him, in a book provided .for that purpose, showing the names of the person or persons from whom the same is collected, the date of the payment, and the purpose or cause for which the same is Paid: and for each separate sum so collected, he shall issue duplicate receipts, consecutively numbered. 62 il Section three; It shall also be the duty of the City Clerk to collect all license and privilege feesof whatsoever nature and kind: and upon payment of the amount re- q>>ired therefor, to deliver tq--the person entitled thereto, the proper printed li- cense, and also to deliver to the person paying for• and receiving such license, a duplicate receipt +,,owi.ng the date of the payment, the name of the person making the payment, and the kind of license or privilege for which the payment is made. Section four; It shall also be the duty of the City Clerk to make and prepare a list of the names of all persons in the City who are engaged In any profession, business, trade, or vocation for which a license or privilege permit is required, and said list shall show the kind of profession, business, trade, or vocation in which each person so listed is engaged. Upon the completion of said list, It shall he the duty of the City Clerk to'proceed to the collection of such licenses or privilege taxes, on such dates as are, or may hereafter -be ordained by the City Council.xIn case of the failure or .refusal of any such person liable therefor , to Pay such license or privilege tax,'it shall be the duty of the City Clerk to report such persmn to the Police Judge or to the Chief of Police for Violating of the City Ordinance, and thereupon the City Attorney shall be required to file an affidavit against such ner- son and cause him to be proceeded against in the Police Courts of the City. Section five: It shall also be the duty of the City Clerk to collect all rents and forfeitures that may he due, the City: to collect all judgements obtained by the City to collect all -other debts that may be due or may become due to the City. Section six; It shall also be the duty of the City Clerk to collect all assessments due or to become due on various street, sewer, or other kinds or classes of Improve- ment Districts that are now formed or may be formed in the City of Fayetteville, Arkansas, and after such funds have been so collected by the Clerk, he shall deposit the funds of each separate Improvement District in such Bank or Banks as he may be directed by the several Commissioners of the respective Improvement Districts.. For - the collection of the aforesaid assessments due said Improvement Districts, a fee of One per centum of such collections shall be paid to the City Clerk, and the money de rived from this source shall be paid to the City Treasurer by the City Clerk and by the City Treasurer placed in a separate fund for the payment or the nartial payment of the salary of the City Clerk. Section seven: It shall also be the duty of the City Clerk to turn over to the City Treasurer, at least once each month, all the moneys in his hands, taking, the Treas- urers receipt in duplicate for the same, which receipt shall. show the fund to which same belongs, one of which receipts shall be filed with the Citv Records and'the other the City Clerk shall retain for his own files, and the said City Clerk, at the first regular meeting, of the City Council, each month, shall make a full report of all his official transactions since his last report. Section eight: The said City Clerk shall be required to furnish a good and suffi- cient bond to the City of Fayetteville, Arkansas, for the faithful performance of all his duties and in such amount or amounts as may be from time to time fixed by the City Council of the City of Fayetteville, Arkansas. Section nine; Pending the taking over of the duties herein before mentioned by the Mop Cite Clerk, the City Council of the City of Fayetteville, Arkansas, shall employ some Person who shall Perform the aforesaid duties and shall receive as comnensa- tion therefor, the sum of 60.00 per month. Provided, however, all of the terms and conditions herein before mentioned have been complied with. It is further provided that the Council may at their option employ the Present City Clerk, or any other City Clerk, or any other person to perform the aforesaid services Pending the taking over of the additional duties by the City Clerk on the first Monday in April, 1935. Section ten; This Ordinance is intended to and does hereby abolish and discounten- ance the office of City Collector for the City of Fayetteville, Arkansas, effective April 2nd, 1933. Section eleven; All -ordinances or parts of ordinances in conflict herewith are here- by repealed and this ordinance shall take effect and he in force from and after its Passage,, approval, and publication. Alderman Sanders made a motion that was seconded by Alderman Bvnum that the rules he suspended and the Ordinance he placed on its second'reaaing. Upon the question being put before the Council it received their unanimous vote. Alderman Sanders then made a motion amending the original Ordinance to-read`as follows; that all auto license fees be due and payable on or before March lst,-1933, and thereafter annually on or before the 1st day of February. This motion - was seoon- ded by Alderman Barr and received the entire vote of the Council. Aldermar-Senders mad a motion that was seconded by Alderman Bynum that the rules be further suspended and the Ordinance be 'placed on its third and final reading. G3 Lo�Ordinance No. 750, An Ordinance to }tee entitled "An Ordinance to prescribe the reduction of license fees or privilege taxes on all motor propelled vehicles, or motorcycles, owned or operated within the City limits of the City of Fayetteville, Arkansas. and for other purposes: Be it ordained by the City Council of the City of Fayetteville, Arkansas; Section One; That the license fees or privilege taxes on all motor propelled ve- hicles, or motorcycles, owned or operated upon the public streets, alleys, or. public highways of said City, be and the same are hereby reduced .forty percent (40%), and that, said license fees or privilege taxes shall be due and payable on or before the lst day of March, of�the'ealender year of 1933, and thereafter annually on or before the 1st day of February. The failure to pay'same when due as provided herein shall automatically cause a penalty of sixty-six and two-thirds percent to attach to such license fees or privilege tax. Section Two: Any motor propelled vehicle or motorcycle belonging to anti person who is a non-resident of the State of Arkansas or the City of Fayetteville, Arkansas, and Who has complied with all the laws relative to the operation of such motor vehielf or motorcycle in any State or any City of the State of Arkansas, and, the. owner or operator of same is a visitor or tourist of the City of Fayetteville, may operate the same in this City for ninety days without the payment of a license fe.e•or privi_l=ge tax, providing he registers same with,the City Clerk of Fayetteville, Arkansas, after such owner or operator has been in the City for thirty days; and providing further that this section shall not exempt any motor propelled vehicle operated in said City for hire. Section Three: That it shall be the duty of the City Clerk of said City of Fayette• ville, to keno 'a record or register and issue a certificate of registration to all such non-residents in the form of a card which may be. carried in the pocket of such owner or operator =tnd which card shall contain a registration number assigned to such registrant showing tee expiration date of said ninety day period and it shall further he the duty of said City Clerk to furnish the Police Department of said City with such expiration dates together with the names and addresses of such registiantsi Section Four: All license fees or privilege taxes collected prior to the effective date of this Ordinance shall be refunded by the City Collector to the extent of the 40% reduction provided for by this Ordinance. Section Five: The City Council of the City of Fayetteville, Arkansas, shall have the right and authority to order the Police Department of said City to collect all, sltch delinquent license fees or privilege taxes. %.ectlon Six: For the violation of any of the provisions of this Ordinance, the rer• son convicted thereof, shall be fired in any sum not less than Ten ($10.00) Dollars nor more than Twenty-five (4$25.00) Dollars. Section Seven; That this -Ordinance shall he deemed cumulative and repeal only such Ordinances or parts of same, as are in direct conflict herewith, and this Ordinance 'ring necessary for the immediate peace, health, safety, and welfare of the City of Fa•yettewile, Arkansas, is toptake effect and be in full force from and after the date of its passage, approval, and publication. Refund; Alderman Gregory made a motion that a warrant for 4$242.00 he drawn on the street fund and turned over to the City Collector for the purvose of refunding, the 40% auto license fees paid to the City Collector prior to the passing of Ordinance No. 75( this being the amount due lccordi.nF to list furnished by the City Collector. This motion was seconded by Alderman Carter and received the entire vote of the Council and the Mayor so declared and instructed the Clerk. Rudget The .report of the Finance Committeeon the budget for 1933 was further discussed. for On motion of Alderman Carter, seconded by Alderman Sanders, and passed by the entire 1933: vote of the Council, the Street appropriation was reduced from 4$3,660.00 per ,year to ^3,000.00 per year. Alderman Carter then made a motion, which was seconded by Alder- man Harding, that the appropriation for the Police Department he raised from 4$3,240.0n nor year to 43,600.00 Der year. This motion received the unanimous vote of the Council and the Mayor so declared. Alderman Stanford then moved that the Rudrret be adopted. Alderman Carter seconded the motion. Upon the question being put before the Council it received their unanimous vote and the Mayor declared the Budget adopted. F. Shumate $30,00. The City Engineer and the Chairman of the Street Committee reported that the rental on the Asphalt Plant where it Is now stored would he $15.00 per month. After dis- cussion it was agreed that the Plant be moved to the South end of Gregg Street. Alderman Sanders then moved that the proposition of the C. A. Moreno Co. as pre- sented'February Leith he accepted. Alderman Hardinc^ seconded the motion which was duly passed by the Council and the Mayor so declared. The Ordinance amending Ordinance No. 611 was brought before the Council. By motion of Alderman Harding, seconded by Alderman Sanders, and duly passed by the Council, it was again left on its second reading. Alderman J. F. Stanford introduced an Ordinance entitled "An ordinance to amend sec- tion one of Ordinance No. 618." This ordinance was read the first time in its entire- ty. Alderman Sanders then made a motion which was seconded by Alderman Bynum that the rules be, suspended and the ordinance be placed on its second reading. The motion re- ceived the entire vote of the Council and the Clerk read the ordinance the second time. It was left on its second reading. The South-17estern Bell.Telephone Co, asked permission of the Council to cut the pave- ment in two places on Center. Street, one being ,just East of the School Street inter- section and the other being at the Hill Street' intersection. By motion of Alderman Wales, seconded by Alderman Harding, and dull passed by the Council, the permit was granted, same to be under supervision of the City Engineer. Mrs. Peck appeared before the Council stating that her residence is outside of the Corporate limits of the City of Fayetteville, and that her Water Improvement assess- ment had been raised from x$,8.33 to 1$25.00 per yee.r, and asking relief from same. Alderman Wages moved that the Mayor be instructed to appoint V. Comriittee to investi- gate the matter. The motion was seconded by Alderman Grep;ory and received the unani= mous vote of the Council. The Mayor named the Committee as follows; Aldermen Wages, Barr, and Carter. The Board of Governors of the Chamber of Commerce extended an invitation to the City Council to be guests of the Chamber of Commerce �Lt luncheon at the Canteen on the U. S. Hospital Reservation at Noon February 21st. The invitation was accepted.
