Fayetteville City Council met in regular session Monday January30, 1933.
Present: Mayor T. S. T'Nibhle,'City Clerk Otoe Phillips, City Attorney V. James Ptak, City En-
gin6ar E. ti. Ratliff, Chief of Police Neal Cruse, Aldermen Barr, Bynum, Carter,
Gregory, Harding, Sanders, Stanford, and Wages.
Minutes of the regular meeting held January 23rd, 1933, were read and approved.
Rills: The following hills were presented after their approval by Alderman Barr, Chairman
of the Auditing Committee, whereupon Alderman Harding made a motion seconded by
Alderman Bynum that the bills be allowed as approved and the Clerk be instructed
to draw warrants for same upon the proper funds. This motion received the entire
vote of the Council and the Mayor so declared and instructed the Clerk: Joe Dear-
ing $7.00, Ben Porter $12.00, A. F. Shumate $30.00. Total $49.00 Street fund.
Auto Alderman Barr made a motion, seconded by Alderman Bynum, that the Ordinance Committee
License; be instructed to draw an Ordinance to reduce Cite auto license fees'. Alderman Stan-
ford, seconded -by Alderman Carter, offered an amendment to the -motion as follows:
that the matter be referred to the Finance Committee for investigation. The amend-
ment was voted on first with the following vote resulting; Ayes, Bynum, Carter,` Greg-
ory, Sanders, Stanford, Wages. Nays, Barr,'Harding. Absent and not voti.nh:, none. The
Mayor declared the amendment carried as there were 6 Ayes and 2 Nays. The original
motion was then put before the Council and received their unanimous vote.
Peddlers Mr. Lamar of the Dawson Produce Co. and Lir. McWhorter of the Oxark Gro. Co. appeared
License: before the Council stating that out of State produce X is being, trucked into the
City and peddled without paying necessary license, "and thzt the local retail and
wholesale dealers deserve some relief from this condition. After discussion Alderman
Harding moved that'the City Attorney he instructed to draw an amendment to Ordinance
No. 611 as follows; that the license fees for peddling produce from other States he
raised to $25.00 per day and the fine for violation of this amendment be not to ex-
ceed $50.00. This motion was seconded by Alderman Carter and received the unanimous
vote of the Council.
Tractor The necessity of purchasing a new track .for the Street tractor being brought before
Truck: the Council, Alderman Harding, seconded by'Al.derman Carter, made a motion that the
Mayor and the Street Committee he authorized to purchase same. This motion received
the entire vote of the Council and the d:'ayor so declared.
A motion to adjourn made by Alderman Sanders and seconded by Alderman Bynum was duly
Passed by the Council and the Mayor declared the Council adjonrned.

man Wages that the bills be allowed as approved and the Clerk be instructed to draw

Reports) The following reports for the month of January, 1933, were read in their entirety by
Cf City the Clerk; T. S. Tribble as Purchasing Agent, Otoe Phillips as City Clerk, M..Cunninr-
Officlals:ham as City Collector, F. P. Nifong as Police Judge, and Neal Cruse as Chief of Po-
lice. After the reading of the reports Alderman Harding made a motion that, the reports
be accepted as read and the Clerk be instructed to file same. This motion was seconded
by Alderman Bynum and received the entire vote of the Council.
The report of the Committee on Light and Telephone rates and Peddlers license amend-
ment'to Ordinance No. 611 were carried over till next regular meeting night, February
13th, 1933.
Auto Alderman Sanders moved that: the Ordinance Committee be. instructed to draw upan Ordi-
License nance reducing the license fee on all motor driver vehicles 40% and that all auto -
Fees: mobile owners becoming residents of the City of Fayetteville be required to purchase
auto license after a residence of 90 days in the City. This motion was seconded by
Alderman. Bynum. Upon the question being put before the Council. -the following vote re-
sulted; Ayes; Bynum, Sanders, and Wages. Nays; Carter, Gregory, and Harding. Absent
and not voting: Barr and Stanford. There being'3 ayes and 3 nays the Mayor voted Aye
and declared the motion carried as there were 4 ayes and 3 na:rs.

The Mayor declared the motion carried as there were 5 ayes and 1 nay, and the cr di-

Fire Arequest that Block 32 in the Orig;ir_al Town of Fayetteville be taken into the Fire
Zone: Zone was Presented. After discussion, Alderman Hardine made a motion that the Ordi-
nance Committee take the matter un and decide what properties in the City of Fayette•
ville be taken into the Fire Zone. The motion was lost for want of a second.
Asphalt Mr. French of the Moreno-Burkham Construction Co. appeared before the Council and
Plant: made a proposition relative to the disposition of the asphalt plant owned by them
and remaining in the City. Alderman Gregory made a motion, which was seconded by
Aldermari Wages, that the street committee and the City Engineer investigate the
matter. This motion received the unanimous vote of the Council and the Mayor so
declared.
The budget for the year 1933 was presented by the Finance Committee. No action wxs
taken.
Resiana- Alde^mar_ Sanders made a motion that the resignation of City Attorney V. James Ptak
tion of to take effect April 1st, 1933, be reconsidered. This motion was seconded by Alder -
City man Harding;, and received the entire vote of the Council. Alderman Sanders then
Attorney: moved that'the resignation of V. James Ptak as City Attorney he accepted as effecti
April 10th, 1933. This motion was seconded by Alderman Harding and received the,
unanimous vote of the Council and.the Mavor so declared.
A motion to adiourn made by Alderman Carter and'seconded by Alderman Sanders was
duly Passe,,d blr-the Council and the Mayor declared the Coucil adjourned.

Bills: The following bills were presented after their approval by Alderman Barr, Chairman
of the Auditing Committee, whereupon Alderman Bynum made'a motion seconded by Alder-
man Harding that the bills be allowed as approved and the Clerk he instructed to

Asphalt A report of the Street Committee and the City Engineer relative to the,proposition
Plant: to purchase the'asphalt plant owned by the C. A. Moreno Co. and stored in thq City
of Fayetteville, together with anew proposition from the C. A.'Moreno Co. was Dre-
sented; the new proposition as follows:'that the City of Fayetteville, Arkansas, ray
to the Co A: Moreno Co. the sum of ?1.00 per year for a period of three years, there
by acquiring clear title to said asphalt plant, providing, however, that said plant
is not used by the City of Fayetteville, Arkansas, prior to March 1st, 1936. In the
event that the City of Fayetteville, Arkansas, shall use or allow XXXXXXMXXi4Xhd
this asphalt plant to be used for the purpose of making, asphalt mixtures prior to
March 1st, 1936, the City of Fayetteville, Arkansas, shall pay to the Co A. Moreno
Co. an additional sum of $1.00 per ton for all material so mixed, provided that the
expenses of labor aril equipment necessary to place the plant in operating condition
he deducted from above sum. After $1,000.00 has been paid the Co AL Moreno Co. on
acco,int of charge per ton for materials mixed as shove provided for, the plant shall
become the property of the City df Fayetteville, Arkansas. Alderman gages made, a mo-
tion seconded.by Alderman Sanders that the Street Committee and the City Engineer
negotiate with the property owners as to rentals for storage on the asphalt plant.
This motion received the entire vote of the Council. and the Mayor so declared.
Alderman Harding moved that this report and proposition be .received and filed.
Alderman Barr seconded the motion which was duly passed by the Council.
Ordinanc: Alderman J'. K. Gregory introduced an ordinance entitled "An Ordinance to amend
Sections 1, 2, and 3 of Ordinance No, 611.." This ordinance was read the first
time in its entirety. Alderman -Wages then made, a motion that was seconded. by Alder-
man Carter that the rules be suspended and the ordinance he placed on Ito second
reading. Upon the question being put before the Council it received their unanimous
vote. The Ordinance was left on its second reading.
