BILLS: The following bills were presented after their aprroval of the Chairman of the*Auditing Committee Alderman Scott and upon a motion by Alderman Harding that the bills be allowed ' iand the City Clerk instructed to draw warrants upon their proper funds for their payment. I This motion was seconded by Alderman Sanders and upon the question being put before the I council,it received the unaminous votb of the Council and was so declared by the Mayor. A motion was made i by Alderman Harding, that these reports be accepted as read and that the report of the City Engineer be made a part of the records by spreading the same in our minutes and also that the City Clerk file these reports in their proper manner. This was seconded by Alderman I ,Stanford and upon the question being put before the council it carried unaminously. REPORT OF THE CITY ENG11,1=1 . AUGUST 4,1931. Mayor & City Council, City of Fayetteville,Arkansas. Gentlemen: j 'At a recent meeting a permit was issued to Henry "Talker for the installation of curb !gasoline pumps and for the construction of a driveway to his Union Bus Station property on jEast Mountain Street,the work to be done under the direction of the Engineer. In compliance with the above direction,I called at the site and talked the matter over ,with the man in charge and stated to him that there are only two regulations udder which he could construct this driveway one for a private driveway and the other for a public driveway, I which requirements are set out in Ordinance No.192.I also stated to him that in my opinion since the Bus Station was a private institution,the driveway could not fall under the class 'of public driveway,and suggested that the matter he presented to the Councilto be passed upon before the work was done.A few days later it was called to my attention that the work had been done and it is not in complience with either requirement and I hereby submit the matter to ,you for your consideration. The commissioners of Tillow avenue presented a report on the district and asked they they be discharged. They were informed that the District owed a note.for $6500.00 and inter to the Cityand that this should be disposed of in some manner agreeable to the City and the Commissioners.The Mayor then asked the Finiance Committee and the Commissioner of Willow Avenue Improvement District No.l together with the City Attorney and City Clerk to meet on Tuesday August 11,1931 at 5.p.m. for the purpose of making some definate disposal of this note and interest and to report their findings back for the consideration of the Council on Monday August 17th,1931. 598 ORD IN.AI : Alderman Harding made a motion that the the Ordinance to "Prohibit the operation of a motor vehicle for a period of one year after being convicted of driving an automobile while intoxicated condition and to provide the penalty therefore and for other purposes" be place third upon its eeeea3 reading. This motion was seconded by.Alderman Wages.Upon the motion being )ut before the Council it received the following vote.Ayes:Barr,B;/num,.Harding.Pearson,Sanders Scott,Stanford,"Iages.ilays:None.Absent and not voting None. The Ordinance was then read the i :ime. The Mayor then asked shhal the Ordinance pass.Upon the Vote it Vias as follows Ayes: 3arr,Bynum,Harding,Pearson, Sanders, Scott, Stanford,Vlages.Nays:None.Absent and not voting None, The Mayor then declared the Ordinance passed and to be in effect afbbr it approval and publication. ORDINANCE NO.739. AN ORDINANCE TO BE ENTITLE"AN ORDINANCE TO PROHIBIT THE OPERATIOIi OF A MOTOR VEHICLE FOR A PERIOD OF ONE YEAR AFTER BEING CONVICTED OF DRIVING AN AUTOMOBILE !'IiILE IN AN INTOXICATED CONDITION AND TO PROVIDE THE PENALTY THEREFORE AILD FOR OTHER PURPOSES'. BE IT ORDAINED BT THE CITY COLi<CIL OF THE CITY OF FAYETTEVILLE,ARKANSAS: SECTION ONE:That it shall be unlawful for any person V-Jiho has been convicted under the ordins of .the City of Fayetteville,Arkansas,for the offense of driving a motor vehicle while in an intoxicated condition,to drive any motop vehicle upon any of the streets of the city og Fayetteville,Arkansas,for a period of one year dating from the clay of his conviction. SECTION TVIO:Any person who has been convicted of driving a motor .vehicle while in an intoxj condition and who shall at anytime within one year from the date of his conviction drive any motor velilcile upon any of the streets of the City of Fayetteville,Arkansas,sl7all be fined j sum not less then twenty-five(p25.00) dollars,nor not more than One Hundred($100.00)dollar.s, he eP-she and each day'shall drive a motor vehicle shall constitute a seperate offense. SECTION THREE:This Ordinance is not intended to repeal any Ordinances or parts thereof,exce where they conflict herewith but shall be deemed as cumulative to all such Ordinances of th nature now in force and effect.This Ordinance shall take ef"ect and be in force from and of its passage and publication.
