PRESENT: Mayor,T.S.Tribble,City Clerk V1m.F.Dunn,Attorney V.James Ptak,Chief of Police Neal Cruse, and Alderman Barr,Harding,Pearson,Scott,Stanford,& Vlages. Minutes of regular meeting of Council held on May 18th,1931 were read and approved. (BILLS: I I The following bills were read and allowed after properendorsement by finiance committee warrants were ordered drawn by City Clerk upon proper funds.Bills as follows: Sam Stephens $'20.00,Sidney Graham $8.00,Lem Guinn $8.00,Ben Porter $18.75,J.Vi.Shelley $42.50. Report of J.VI.Shelley as street cleaner reported 190 blocks of streets cleaned. and upon motion by Alderman Harding seconded by Alderman Pearson that report be accepted and orered filed. The Mayor asked City Clerk to notify the treasurer Roy Nix of the transfer of accounts from the WIcIlroy Banking & Trust Co to the First National Bank on June 1st as per bid. Alderman Wages reported for the street committee on the condition as found in front of the property in front of T.A.Matthews property on Garland Avenue that it was not the fault of the City of Fayetteville for the condition as it existed and therefore we were not responsible and should not be out any expense whatsoever in repair of the same. Ivayor wages moved that bis report be accepted.this was seconded by Alderman Pearson.Upon motion being put it carried unaminously. Contract of City Engineer for Next two years is a record of this meeting. 1 CONTRACT KN0111 ALL MEN BY THESE PRESENTS: CITY (ENGINEER E That this contract and agreement made and entered into on this 27th day of May,A.D.1931, at Fayetteville,Arkansas,by and between the Mayor and the City Council representing the City of Fayetteville,Arkansas,herein known as party of the first part,and E,M.Ratliff, Civil Engineer,hereinafter known as party of the second part,Vlitnesseth: Whereas,The party of the first part have retained and employed the party of the second. part as City Engineer of the City of Fayettevil].e,Arkansas,arid the party of the second part has accepted said employment; Therefore,in consideration of the coppensation hereinafter mamed,the party of the second part agrees to perform the services hereinafter named and set out,and the party of the €irb first part,with and by authority invested in them by law and acting for the City of Fayetteville,Arkansas,agrees to pay the party of the second part for his services as Engineer the compensation hereinafter set out.The services to be performed by the party of the second par8 are as follows: 1. To keep the records and information relating to engineering work,which shall be properk ly indexed and filed,and such records when sA filed shall become the property of the City of Fayetteville,Arkansas,even though such records sahll be in the office of the Engineer. 2. To establish all street,water & sewar grades. 3. To make estimates of cost and preliminary surveys and reports for proposed work within the City of Fayetteville,Arkansas. 4. To make all necessary estimates,drawings,plans,and inspection of the work during construction of all bridges, culverts and any other improvements 1.1vork which is clone by, or under the control of the Mayor and City Council of Fayetteville,Arkansas. 5. To locate and establish the location of telephone,telegraph,or electric light poles and report the same to the City Council.This paragraph shall be construed to mean only such poles as are ordered to be moved by the City Council. 6.To inspect and report on water & sewiar connections,which are made within the streets of 1 the City of Fayetteville,Arkansas. The party of the First part,for and in consideration of the true and faithful performance of the covenants and agreements made by the party of the second part,agrees to pay the part of the second part the rates and prices for services rendered as are set out by the schedule fees,which are attached hereto;it being understood and agreed by the parties hereto that the said schedule of fees is an essential part of this contract. SCHEDULE OF FEES. (a) A fee of $25.00 per month shall be paid for general serviues,such as committee work, supplymng general information,specifications and office work. (b) For establishing grades adjacent property of persons making improvements.$1.00 each fifty feet. (c) For making all estimates,drawings,pla.ns and inspecting the work during construction of all bridges,culverts,or any other improvement work which is done by or under the direct control of the Mayor or City Council,the compensation shall be 5% of the gross total cost of the improvement. i (d) For inspecting sidewalks during construction.$% of the total cost of construction, said 5% to be paid by the contractor or by the owner of the property. (e) For locating and establishing a point for each telephone,telegraph,or electric light pole.25 cents per pole. (f) For inspecting and reporting on water and sewer connections,$1.00 for each connection, (g) For locating water and sewer lines,setting stakes and elevations for same.50 cents per hundred feet. i 5�2 It is further agreed and understood that the party of the first part shall allow all cla for compensation in payment for services renered to the party of the second part,under this contract,at the first regular meeting of the City Council after the report has been made byl , the party of the second part. It is further agreed and understood by the parties hereto that all plans,estimates, ications•and reports shall be inspected by the Mayor and City Council and,if there are any changes to be made the same shall be made by the party of the second part,but in no case shall either party hereto delay the acceptance for more than two regular meetings of Council. The party of the second part agrees to maintain an office In the City of Fayetteville,Arkal- sas,and to meet with the City Council as many times as may be consistant with his business relations. It is further understood and agreed by the partieshereto that the party of the first shall have the privilige of appointing one assistant,who shall have authority to act for h during his abscense,and such other assistants as may be approved by the Mayor and City Council. It is distinctly understood and agreed by the parties hereto that this contract is int to cover and does cover all the work of an engineering nature which is intended to be done it caused to be done by or for The City of Fayetteville,Arkansas;if the work is of the nature it , kind which is not particularly mentioned herein,the compensation for such work shall be agrpdd upon by the parties hereto,and payment made accordingly. This contract shall be in force and effect from and after the date and day of the eigkx�ag signing of the same and shall terminate at the end of two years,or at such time thereafterlas party of second part has been paid in full. IN WITNESS WHEREOF,said party of the first part has caused this instument to be signed b the Mayor and attested by the City Clerk of the City of Fayetteville,Arkansas,in accordant with the resolution passed by the City Council of the City of Fayetteville,Arkansas, authorizing such signatiuee.
