MINUT S of the meeting of Danuary 5th, 1931 were read and approved. I RESOLUTION, Alderman Pearson introduced a resolution providing for the payment of certain due DISTR. 45; in School Avenue Improvement District Number One of the City of Fayetteville,and moved its i adoption. Alderman Fuller seconded the motion to adopt,which received the following vote; i I Aldermen Bynum, Fuller, Harding, Pearson, Scott, Stanford, Stephens, Wages, nays none. The Mayor declared the motion passed and the Resolution adopted. A copy is as follows;- ::;: R E S 0 L U T I 0 N WHEREAS: The real property hereinafter described is embraced in gatt*h Sc hool Avenue Improvement Dist Number One of the City of Fayetteville, Arkansas; and WHEREAS: Si id real property is also embraced in an Improvement District known as Paving Improvement District Number Forty-five (45);and WHEREAS: The City of Fayetteville,Arkansas,has by its City Council, agreed to assume the payment of th renefit dues assessed against said he einafter described real property in said before menti School Avenue Improvement District Number One of the City of Fayetteville,Arkansas,for the years 1930,1931,1932 and 1933 on condition that said Paving Improvement District Number Fort (five (45) he formed and carried out,(it being understood that one condition of said formetio of said District is that the Highway Department of the State of Arkansas shall assume one- half of the cost of the improvement to be made); Now,Therefore be it resolved by the city council of the city of Fayetteville, Arkansas; PECTION ONE: That the assessed benefits against the following real property as said benefits are shown in the assessment of benefits in the records of said School Avenue Improvement District Numb One of the City oP�Fayettieville,Arkansas,be,and the same are hereby assumed by the City of i ayetteville,Arkansas,and the Mayor and the City Clerk of said City be,and they are hereby authorized and directed to issue warrants for the payment of the same when and as they becom �lueand payable, and said warrants to be issued against the Street Fund of said City,and made payable to the Collector for said Improvement District. SECTION T O: That in case any of the owners of any of said real property shall have paid said assess- ments before this resolution becomes effective,then,and in that case the said Mayor and City Clerk shall issue such warrants in the sum or sums so paid,and apyable to the partiyf* or i parties who have so paid such assessments. t 553 SECTION THREE: - That this resolution shall become effective only on the following conditions,to-wit;- Said 1. 9tt*3& Paving Improvement District shall be formed and perfected; ' 2. The State Highway.Department shall assume in due legal form,the payment of one- half the cost of the proposed improvement as set forth in the petition for the I formation of said District 3. The District shall issue and sell its bonds,and enter into a contract for the construction of said improvement,said contract to be approved by the City Council of the said City of Fayetteville,Arkansas. In the matter of the removal of stumps from Shady Street,it was tacitly agreed t a proposal be made to the owners of adjacent property that the City will grade the treet if the said property owners will remove the stumps. The Finance Committee through Alderman Wages submitted a draft of a budget for year 1931,upon which action was deferred to the next meeting.
