T.S.Tribble, Clerk J.C.Massie, Attorney V.James Pbak, Fngineer E.M.Ratliff; it Aldermen John Bynum, Don Fuller, C.T.Harding, Clem Pearson, Roy Scott, J.F.Stanford,S.S.Steph ' R.F.Wages0 ITHE MIIUTES of the meeting of April 21st,1930 were read and approved. I THE FOLLOWING BILLS against the City,properly approved, were allowed and ordered paid and the Clerk was dorected to issue warrants for the same on motion by Alderman Fuller, seconded by Alder ,man Bynum, passed by the unanimous vote of the Council and so declared by the Mayor;0"# Dave Lewis $2.25; J.11'.Shelly $42.50;Ben Porter $18.75. SHELLY'S report,showing 178 blocks cleaned during the week was presented,and on motion,ordered filed.) CUT CURB: The petition.of the Daily Leader for permision to cut the curb at Lot 108, Oak Park Place for the purpose of constructing a driveway,was granted,on motion,d.uly passed,the work to be done under the supervision of the City Engineer. LEVY Alderman Harding introduced an ordinance providing for the levying of the Assessment, Distr.. 43; of benefits in Paving Improvement District Number Forty-three (43) of the City of Fayettevill, i Arkansas,which was read the First time. Alderman Pearson moved that the Rules be suspended an, I the ordinance placed on its second reading. This motion was seconded by Alderman Pelages and re received the following vote;ayes Aldermen Bynum, Fuller,Harding, Pearson, Scott, Stanford, Stephens, Wages; nays none; absent and not voting none, and was declared passed by the Mayor The Ordinance was read the second time. Alderman Harding then moved that the Rules be further suspended and the oddinance placed on its third .reading and final passage. Th&s motion was seconded by Alderman Scott and received Pearson, ' the following vote; ayes Aldermen Bynum, Fuller, Harding, Scot Stanford, Stepkjens, Wages; n Inays none;absent and not voting none,and was declared passed by the Mayor. I The Mayor then announced the question before the Council is shall the ordinance pass,and called .for the vote on its passage which resulted as follows; ayes Alder ,men Bynum, Fuller, Harding, Pearson, Scott, Stanford, Stephens, Wages,# naps none, absent and not voting none. The Mayor declared the ordinance passed. A copy is as follows; - ORDINANCE NUMBER 724, AN ORDINANCE TO BE ENTITLED "AN ORDINANCE TO LEVY THE ASSESSMENT UPON THE REAL PROPFRTY LOCATED WITHIN PAVING IMPROVEMENT DISTRICT NUMBER FORTY-THREE (43) OF THE CITY OF FP.YETTEVI ARKANSAS." WHEREAS, The majority in value of property holders owning property adjoining the locality to! i be fiffected and situated in Paving Improvement District Number Forty-three (43) of the City of Fayetteville,Arkansas,organized for the purpose of grsding,rolling and paving the streets' and parts of streets within said Paving Improvement District Number Forty-three (43) of the ' City of Fayetteville,Arkansas have petitioned the City Council of the City of Fayetteville, Arkansas for the construction of said improvement,and that the cost thereof shall be assessed upon the real property of said District,according to the benefits to be received;and 111HEREAS, said benefit received by each block,lot and parcel of real property situated in said', District equals or exceeds the local assessment;and IVHFRFAS, the estimated cost of said improvement is $11,900.00; NON,TH?REFORF,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLF,ARKANSAS: SECTION ONE: That said several blocks,lots and parcels of real property in said District,be assessed according to the Assessment List for said Improvement District,as the same now re- mains in the office of the Recorder or City Clerk,and that 7 per centum on said.blocks,lots Viand parcels shall be paid annually on or before the first Monday of November,until the whole of said local assessment shall be paid. 498 S 4247 Approved Petitio to withd condemna tion sui E DEL Y ON NDAY: 'AUL GUI ;OM'R I SECTION TI -70: That all ordinances and parts of ordinances in conflict herewith be,and the sar.eI are hereby repealed, and this ordinance shall take effect and be in force from and after its passage,approval and publication. A copy of Senate Bill #4247,introduced into the Senate of the U.S. by Senator Caraway, )roviding for an appropriation of $3,200.00 for the construction of a hard surfaced road to `.die Confederate Cemetery from the end of the pavement on Rock Street was presented to the ,ouncil with the request that they consent to such construction,whereupon Alderman Harding that the Council does hereby approve and consent to said construction. Alderman Hiller econded the motion which received the unanimous vote of the Council. A petition signed by a majority of the signers of a previous petition which asked 20 -foot strip along the south side of Lot S, Ambrose Addition be condemned for a street,was resented, praying that said condemnation proceedings by cancelled and withdrawn. Alderman arding moved that said petition be granted and the City Attorney directed to withdraw said uit. Alderman Pearson seconded the motion which receiiYed the unanimous vote of the Council. ,A questionaire which had been circulated by the Fayetteville Ice Company,asking th&&r atrons to vote for or against Sunday Delivery of Ice in the Residence Districts of the City, nd which showed 431 against and 7 for such delivery,was presented to the Council with the erbal request that some action be taken in the.matter. Discussion of the matter disclosing he fact that such delivery is already under ban by State law and City ordinance,it was ecided informally that the Council had nothing further to do in the matter. Alderman Pearson introduced a resolution appointing Paul Guisinger to be a member of R the Board of Improvement of willow Street Improvement District Number One of the City of Fayetteville,Arkansas and moved its adoption, This motion was seconded by Alderman cott, and received the following vote; Ayes Aldermen Bynum, Fuller, Harding, Pearson, Scott, *too tanford, Stephens, Wages,* nays none; absent and not voting none. The Mayor declared the otion passed and the resolution adopted. A copy is as follows;,, RESOLUTIONS WHEREAS: There is a vacancy in the membership of the Board of Improve- ment of !'Iillow Avenue Improvement District Number One of the City of Fayetteville,Arkansas,by reason of the removal from the Sete of Marcus Hulse, and WHEREAS: Paul Guisinger has signified his willingness to serve as a member of said Board of Improvement, THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTE- VILLE,A.RKANSAS: SECTION ONE: That Paul Guisinger,a qualified elector of the City of Fayetteville,Arkgnsas,and an owner of real property within the limits of said Improvement Distriet,be,and he is hereby, appointed to be a member of the Board of Improvement of Willow 4"S4d^'1NA4%, Improvement District Number One of the City of Fayetteville, Arkansas,in place of Marcus Hulse, removed from the State. SECTION TWO: That this resolution shall teke effect from and after its passage and approval,and all resolutions in conflict herewith be, and the same are hereby repealed. I COLLECTOR The Bond of the City Collector M. Cunningham was g presented and on motion by Alderman BOND: Harding,seconded by Alderman Bynum was approved and filed. The Clerk reported that he had I i administeded the oath of office to M. Cunningham as City Collector on the 1st day of May,1930. A request from F.M. Tolleson,D.D. For permission to alter the curb at his property on East Maple Street so as to provide access to his driveway,was granted subject to super- vision by the City Engineer. Pearson G.A.HURST; Aldermau./moved "That the City Clerk be and he is hereby directed to notify G.A.Huast to appear before the Council at its meeting on May 12th,1930,and present the work done by j him on the digesting of the City Ordinances,explaining the same in detail." Alderman Wages seconded the motion which received the unanimous vote of the members present.
