'PURSUANT TO ADJOURNMTNT,the City Council of the City of Fayetteville, Arkansas met on the 28th day of March,1930,when there were present and presiding the Mayor, T.S.Tribble, and City Clerk J.C.Massie, Aldermen John Bynum, N.F.Drake, Don Fuller, C.T.Harding, Clem Pearson, Roy Scott, Dr. J.F. Stanford and S.S.Stephens. PURPOSE: The Mayor stated the pubpose of the Meeting to be the consideration of the proposition to submit to the electorate of the City the matter of voting a bond issue for the purpose of buying additional land for the Airport and equiping the same. COMMUNIAC- A communication from the President of the Chamber of Commerce of the City of Fayettevfi.11e TION FROMI CHAMBER OF was read,wherein it was set forth that the said Chamber of Commerce approved of the pro,jelct COMMERCE:' and requested the Council to take the necessary steps for the submission of the proposition to people Ithe pe6tte at a speci 1 election . After a thorough discusion of the pro,ject,and especially in view of the fact that the total levy for paying off the additional bond issue would not need increasing above the present 22 -mill levy for bonds, Alderman Pearson moved that the City Attorney be directed to prepare an ordinance providing for the submision to the people in the sum of $$20,000.00 the question of making a bond issue/for the purpose of purchasing additional land for the at an election to be held. May 6th, 1930. Airport and equiping the same/ Alderman Drake seconded the motion which received the following vote; ayes Aldermen Bynum, Drake, Fuller, Harding, Pearson, Scott, Stanford ;ani y�one, absent land not voting none. BIDS FOR Four bids for painting the names of streets on the curbs were presented,as follows;- STR7ET NAMES: Edmond vlages,30� per name, P.T. Gann 20� per name, Littrell Brothers $92;50 for 530 names, (being 171W per nam)and Bill T Brinson 12¢ per name.The City to furnish the paint in each bid ,Alderman Harding moved that the contract be awarded to Bill T Brinson at his bid of 12� per name. This motion was seconded by Alderman Stanford and received the unanimous vote f the Council and was declared passed by the Mayor. DISTR. 431 The Clerk reported that the`Assessment T+oll of Paving Improvement District Number 43 was ASSESS. ' lin his office o8 the 28th day of March, 1930,whereupon Ald erman Harding, introduced the following resolution and moved its adoption. This motion was seconded. by Alderman Scott and received the following vote; ayes Aldermen Bynum, Drake, Fuller, Harding, Pearson, Scott, Stanford, Stephens; nays none; absent and not voting none, and was declared passed by the Mayor, and the resolution adopted. SPECIAL Alderman Drake introduced an Ordinance providing for a special election for the pur- BOND LECTION:,pose of voting for or against a bond issue for the purpose of purchasing land and equiping an Airport thereon,which was read the first time. Alderman Harding moved thst the Rules be suspended and the ordinance placed on its second reading. Alderman Scott seconded the motion �j which received the folbowing vote; ayes Aldermen Bynum, Drake, Fuller, Harding, Pearson, Scott, Stanford, Etpphens; nays none, absent and not votnone, and was declared passed by the Mayor. The ordinance was read the second time.. After discussion,and the consideration of a suggested schedule of payments on the present outstanding bonds and the Aviation bonds, Ate' as presented by the C1erk,Alderman Harding moved that the Rules be further suspended and the y ordinance placed on its third reading and final passage, Alderman Bynum.seconded this motion but by request and with the consent of his second, Alderman Harding withdrew his motion, whereupon Aderman Pearson moved that the ordinance be placed back on its second reading for amendment. Alderman Drake seconded the motion which resulted in the following vote; ayes Aldermen Bynum, Drake, Fuller,Harding, Pearsom, Scott, Stanford, Stephens; nays none and was declared passed by the Mayor. Alderman Pearson then moved that Section Two be amended so as to providey that the bonds shall be issued on a basis of 6% interest,par value. Alderman Drake ' seconded the motion which received the unanimous votre of the Council. Alderman Harding then moved that the Rules be further suspended and the ordinance as amended be placed on its third reading and final passage. This motion was seconded by Alder- man Bynum and received the following vote;ayes Aldermen Bynum, Drake, Fuller, Harding, Pearson Scott, Stanford, Stephens;nays none; absent and not voting none, and was declared passed by 1� ao�4 *%J� j the Mayor. The ordinance was read the third time. The Mayor reserved the right of veto under the statute in such case provided. CITY AID Attorney Hurst, presented the matter of the paving of the intersections of streets and FOR; Paving J/Y^ a.rr,y»F DISTRICT qalleys in/District Number 43 ,and requested the Council to designate the amount they Pro - 43 L/ posed to appropriate to that purpose. After discusion, Aldirman Bynum moved that the Council, at the proper time and in the proper manner appropriate the sum of $1,350.00,payable in ten annual payments for the paving of the intersections in said Paving Improvement District Num- i Iber Forty-three. This motion was seconded by Alderman Stanford and received the following vote ,Ayse Aldermen Bynum, Drake, RU11OV, Harding, Pearson, Scott, Stanford, Stephens; nays Alder- Iman Fuller,and was declared passed by the Mayor. NATER BOND ORD Alderman Drake introduced an ordinance giving consent of the City of Fayetteville, Arhansas to the Board of Improvement of Water Improvement District Number One of said City to issue and sell bonds of said District in the sum of $54,000QOO,which was read the first time. Alderman Harding then moved that the Rules be suspended and the ordinance placed on its second reading. This motion was seconded by Alderman Pearson and received the following 490 r F, 7 F.REAS, WHEREAS, y11HEREAS, SECTION 1 ISECTION 2. vote; ayes Aldermen Bynum, Drake, Fuller, Harding, Pearson, Scott, Stanford, Stephens; nays none; absent and,not voting none, and was declared passed by the Mayor. The Ordinance was read the second time. Scott Alderman 19*0 then moved that the Rules be further suspended and the ordinance placed on its third reading and final passage. Alderman Harding seconded this.motic (which received the following vote; ayes Aldermen Bynum, Drake, Fuller, Harding, Pearson, Scott, Stanford, Stephens; nays none; absent and not voting none. The Mayor declared the motion passed. The Ordinance was read the third time. The Mayor then announced the question before the Council is shall the ordinance pass,and called for the vote on its passage,which resultei as follows, ayes Aldermen Bynum, Drake, Fuller, Harding, Pearson, Scott, $tanford, Stephens; nays mmne; absent and not voting none. The Mayor declared the ordinance passed. I r; r - the Board of Improvement of water improvement district number one has requested that the Bit Council of the City of Fayetteville,by a proper ordinance,give the consent of the City of Fayetteville,to the borrowing of the money hereinafter referred to,and to the mortgaging of the Water Works Plant,revenues and property of said Imprevement District to secure the pay- ment of the money borrowed,and under Ordinance number 642 of the City of Fayetteville,duly passed.and approved November 1,1926, said City gave its consent to the borrowing of money by the Board of Improvement as recited in that ordinance;and SAid City,by its ordinance number 687,duly passed and approved on the 11th day of June,1028( said City gave its further consent to the borrowing of an additional sum of money,as recited in that ordinance,and the City Council finds that it is necessary to secure and acquire additional water supply fo the use of said City and its inhabitants,and to construct a dam or dams for the impounding of said water for such use,and to make other and additional improvements necessary to the supplying of said water to said City and to its inhabitants;and-�'\ there is not Rufficient funds on hand belonging to the City of Fayetteville and to the Board of Improvement of said District to make said necessary improvement and to supply said addi- tional water;and it is necessary that additional water supply be provided as soon as possible,and that said Board of Improvement secure and provide the same without delay, NO!7,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF F.AYFTTFVILLF,ARKANSAS,AS FOLLOW^FS : The said City Council hereby confirms,ratifies and adopts the action of the Board of Imprc ment of hater Improvement District Number One looking to the making of said additional imp ment,and to the acquiring of said additional waber supply, and to constructing and install the necessary dam or dams,and equipment expedient for said purpose,in so far as said city council has the powep,to proceed with such improvement and to borrow the money necessary to such purposes. The said Board of Improvement of !'later Improvement District Number Ine,of the City of Fayetteville,Arkansasbe be, and it is hereby authorized, empowered and directed to issue it bonds aggregating,exclusive of interest the sum of Fifty-four Thousand ($54,000.00) Dollars, and the City of Fayetteville consents to the issuance of said bonds,which shall mature serially in the years 1931 to 1935,both inclusive, Said bonds to bear interest at five per cent (5%) per annum,and apyable semi-annually, re- 49� SECTION 3. SECTION4. The City of Fayetteville which has heretofore taken part in the operation of said Vlater Plant,by the appointment of a Board of Managers,hereby consents to the issuance of said i bonds,and in so far as said City has the power,gives,grants and authorizes said Board of Improvement of Water Improvement District Number One,to take all necessary steps for the purpose of issuing of said bonds,and of securing the payment of the same,by the execution and delivery of a valid mortgage upon the property oR said. Improvement District,subject to any prior oo*an? mortgages thereon,and by pledging the income and revenue thereof, subject to any prior pledges of tkte same,to the end that said bonds and the interest shall be promptly paid 1 at maturity thereof as above set out. SECTION 5. This consent does not obligate the city of Fayetteville to pay any of said bonds or interest thereon, SECTION 6.The City of Fayetteville hereby grants to the holders of said bonds the right and privilege to take over said plant and operate the same,in the event that such action becomes necessary for the protection of the holders of said bonds or the interest thereon,which right and pri- vilege shall continue so long as any default exists in the P*VffiM ttr payment of said bonds 'and interest. And they shall have the right and privilege to collect rentals from the oper- ation of said plant, and to pay the game on said bonds and interest,but shall make an account- ing to the Board of Improvement and to the City Council,at the end of their said operation of said plant. SECTION 7.
