Massie, Attorney Don Trumbo; ?Aldermen Bynum, Fuller, Harding, Pearson„ Scott, Stanford,Stephens; absent'Engineer, Ratliff and Alderman Drake. THE MINUTES of the meeting of July 29th, 1929 were read and approved, THE FOLLOWING BILLS AGAINST the City,bearing the proper vouchers and the approval of the Auditing Committee,were allowed and ordered paid, and the Clerk was directed to issue warrants for ;the same on motion by Alderman Harding,seoonded by Alderman Fuller,passed by the unanimous vote of the mdmbers present and so declared by the Mayor; -Choctaw Culvert & Machinery Co ., ,8.60; Democrat Publishing Co., 1}7.74;Fayetteville;umber & Cement Co., 1'016.47; John 'Zillah l60.00;Sandford & Son $1.25kHight Roofing Co., $15.00;Anderson Stone Co., $2.00; Lewis Bros.Co., $1.95; '9.L.Crouch •49.50;Magnolia Petroleum -Co... $41.281 Ben Porter $18.75; Salsbury and Sanford $5.99; J.W. REPORTS: The monthly reports of the City Collector, City Clerk, Purchasing Agent, Police Judge, Fire i Chief and Street Cle aner were presented and on motion,ordered received and filed. ;MUFFLER Alderman Scott introduced an ordinance to amend Ordinance Number 361,which was read the fir ORD.: 1 time. Alderman Harding moved that the Rules be suspended and the ordinance placed on its second rending. This motion was seconded by Alderman Fuller and received the following vote; ayes Aldermen Bynum, Fuller,.Harding, Pearson, Scott, Stanford, Stephens; nays None; absent land not voting Alderman Drake. The Mayor declared the motion passed. The Ordinance was read ;the second time. Alderman Pearson then moved that the Rules be further suspended and the ,ordinance placed on its third reading and final passage. Alderman Bynum seconded this motion' which received the following vote;.ayes Aldermen Bynum, Puller, Harding, Pearson, Scott, i Stanford, Stephens; naps none; absent and not voting Alderman Drake. The Mayor declared the motion passed., The Mayor then announced the question before the Council is shall the Ordinarne I pass, and called for the vote on its passage which resulted as follows; -ayes Aldermen (Bynum, Fuller, Harding, Pearson, Scott, Stanford, Step1}ens; nays none; absent and not voting, ;Alderman Drake. The Mayor declared the Ordinance passed. A copy is as follows; - ORDINANCE NUMBER 711. AN ORDINANCE AMENDING ORDINANCE NUMBER 361 WHICH PROHIBITS THE USE OF CUTOUTS ON AUTOMOBILES AND OTHER VEHICLES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS: j SEC1. That hereafter it shall be unlawful to operate upon the streets of Fayetteville,Arkansas any attomobile,truck,motorcycle,or other gasoline propelled vehicle without a completely i� muffled engine exhaust. ISECTION 2. That hereafter the use of so-called "72" mufflers on automoblies,trucks motorcycles or other gasoline propelled vehicles shall be unlawful within the City of Fayetteville, 11�Arkansas, when the driver of said vehicle permits -the engine exhaust to pass thru said "72" muffler unmuffled in an attempt to circumvent the application of other sections of this y ordinance pertaining to the•use of cutouts on gasoline propelled vehicles. (SECTIO\\N 3I That hereafter it shall be unlawful to use an extended exhaust pipe or pipes from the cc�,py,imotor og a gasoline propelled vehicle unless said exhaust pipe passes thru and is connected � with a proper funtioning muffler to be in as mechanically perfect condition as possible. SECTIq V4. That any person, firm, partnership or corporation violating any of the provisions of this � ViN ,amendment to Ordinance number 361 shall be fined as provided in ordinance no. 361. SECTION 5I. That this amendment to ordinance No. 361 shall take effect from and after its passage, approval and publication. Passed and approved this 5th day of August, 1929, Approved; T.S. Cope, and moved its adoption. This motion :ias seconded by alderman Scott and received the following vote; ayes Aldermen Bynum, Fuller, Harding, Pearson, Scott, Stanford, Stephens; nays none; absent and voting Alderman Drake. The Mayor declared.the motion passed and the•resolution 1. adopted. A is as follows; R E S O L U T I O N. WHEREAS: There is a vacancy in the membership of the Board of Improvement of Water Improvement District Number Two of the City of.Fayetteville,Arkansas,by reason of the death of H.N Cope;and .WHEREAS: Isaac Napier, an owner of real prbperty within the limits of said Water Improvement District Number Two has signified his willingness to serve as a member of said Board, OEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS:- SECTION 1. ' That Isaac Napier,a qualified elector,and an owner of real property within I the limits of Water Improvement District Number Two of�-the City of Fayetteville, Arkansas, be, and he is hereby appointed to be a member of the Board f Improvement of Water Improvement dDistrict Number Two r the City of Fayetteville, ;1rk4nsas. SECTION 2. -That this resolution shall take effect and be in force from,and after its passage and approval;and all resolu- tions in conflict herewith be, and the same are, hereby, repealed. C.T. The Mayor reported that Mr. Savage,who had been requested to appear before the Council in the matter of Dr. Baerg's Sidewalk, had aggreed that the work of grading should be done,and that he would contract.with John "Zillah for the same. The Fire Chief appeared before the Council with the request that provision be made for equipping the Fire Trucks with Foamite containers,to enable the Firemen to combat ga'solfne fires. After some discussion, Alderman Acott moved that the Purchasing Agent be authorized to purchase trio 22 gallon Foamite containers. This motion was duly seconded by Ald rman Harding and received the following vote; ayes Aldermen Bynum, Fuller, Harding, Pearson, Scott, Stanford, Stephens,Nays none; absent and not voting Alderman Drake. The Mayor declared the motion passed. On motion by Alderman Scott,duly seconded and passed the Council adjourned. Approved; Attest; Mayor* Clerk.
