Massie, Attorney Don Trumbo, Engineer E.M. Ratliff; Aldermen Bynum, Drake, Fuller, Harding, Pearson, Scott, Stanford, Stephens. SHELLEY'S I JS&JR BAT of the Meeting of July 15th, 1929 were read and approved. NG BILLS against the City, bearing the proper vouchers, and the approval of the Auditing ttee were allowed and ordered paid and the Clerk was directed to issue warrants for the 'same on motion by Alderman Fuller,seconded by Alderman Drake, passed by the unanimous vote of, the Council and so declared by the Mayor; Ben Porter `18.75; Elmer i'lier �$17.50;J.W. Shelley Ik42.50;Southwestern Bell Tel. Co., $23.90;Bob Hannah 19.00;Dave Lewis $8,25, 'report showing 158 blocks cleaned during the week was presented and on motion,ordered filed. GRADE FOR SEWER IN Ai LLEY BLK.I5; r� were present,and in reference to the alley in Block 5,denied responsibility.There being evidence produced per contra, the matter was dropped without action. I Alderman Drake moved that the City Engineer establish the grade for sewer line in the North -south alley in Block 5,and that the City Clerk notify the owners of the ivate sewer line in said alley to re -locate said line in accordance with the established grade. Alderman Stanford seconded the motion which received the following vote; ayes Alder- men Bynum, Drake, Fuller, Harding, Scott, Stanford; nays Ald ermen Pearson,and Stephens. The Magor declared the motion passed. 40 The Appeal of the A.C. Hamilton Estate,by W.J. Hamilton,requesting cancellation of the ALS. the LTON: assessment against "1W property of said Estate,in case the alleys adjacent to said property were not to be paved.was withdrawn by W.J. Hamilton,upon being assured by the City Engineer' that said alleys will be paved 174 Elizabeth The Appeal of Mrs lizabeth Wade asking a reduction of the assessment of $233.00 Prom said amount to the sum of .$216.00,was presented. After investigation of the matter by it I Sidewalk; Shady & Ila; Council,Alderman Drake moved that said appeal be denied. Alderman Stanford seconded the which received the following vote; ayes Aldermen Bynum, Dbake, Fuller, Harding,Pearson, Stanford, Stephens; nays none; absent and not voting none. The Mayor declared the passed and the appeal denied. A request for the establishment of sidewalk grade along the property of the Delta. Association was presented by Mr.P.A. McAnally,wherethpon Alderman Harding moved that the quest be granted and that the City Clerk cause to be served a legal notice ordering the construction of sidewalk along Ila Avenue and Shady Street adjacent to lots 1 and 2 in Block 4,Englewood Addition to the City of Fayetteville, >rkansas. Alderman Scott seconded the motion which received the unanimous vote of the Council and was declared passed by the Mayor, #40 Alderman Drake introduced an ordinance levying the assessment in Alley tg District Levy; i Number 40 which was read the first time. Alderman Harding moved that the Rules be suspended 1 I nd the ordinance be palced on its second reading. This motion was seconded by Alderman Scottl and received the following vote;ayes Aldermen Bynum, Draek, Futller, Harding, Pearson, Scott.. tanford, Stephens; nays none; absent and not voting none. The Mayor declared the motion passed. The Ordinance was read the second time. Alderman Drake then mooed that the Ryles be further suspended and the ordinance placed on its third reading and final passage. Alderman o Bynum seconded this motion which received the following vote; ayes Aldermen Bynum, Drake, Fuller, Harding, Pearson, Scott, Stanford, Stephens; sharp nays none; absent and not voting - I none. The Mayor declared the motion passed. The Ordinance was read the third time. The Mayor then announced the question before the Council is shall the ordinance pass, and called for the vote on its passage which resulted as follows; ayes Aldermen Bynum, Drake, Fuller, Hadding, Pearson, Scott, Stanford, Stephens; nays none; absent and not voting none. The Mayor declared the ordinance passed. A copy is as followse- I 0I 426 WHEREAS: WHEREAS: ORDINANCE NUMER 710. AN ORDINANCE TO BE ENTITLED " AN ORDINANCE TO LEVY THE ASSESSMENT UPON THE REAL PROPERTY WITHIN ALLEY IIuIPROVEMENT DISTRICT NUMBER FORTY(40) OF THE CITY OF FAYETTEVILLE ARKANSAS." The majority in value of the property holders owning property adjoining the locality to be affected and situated in Alley Improvement District Number Forty (40) of the City of Fay- etteville, Arkansas,organized for the purpose.of grading,rolling and paving with concrete pavement the alleys and parts of alleys within said Alley.Improvement District Number Forty (t0)of the City of Fayetteville,. Arkansas,have petitioned the City Council of "0 said City of Fayetteville, Arkansas,for the construction of said improvement,and that the cost thereo shall be charged and assessed against the real property within said District according to t benefits to be received, said benefit received by each lot or block or parcel of real property within said District equals or exceeds the local assessment;and tore estimated cost of said improvement is twenty-thousand($20,000.00) Dollars; NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYFTTEVILLE,ATKANSAS: SECTION ONE: That all ordinances and parts of ordinances in conflict herewith be,and the same are,hereky repeal ed,and this Ovdinance shall take effect and be in force from and after its passage, That said several lots, blocks,and parcels of real proPerty within said district be assess according to the assessment list for said Improvement District as the same now remains in office of the City Clerk of the City of Fayetteville.. Arkansas,and that Twenty-five (25%) per centum on said Lots,.Blocks and parcels of real property within said District shall be paid annually on or before the first Monday of November until the whole of said local assessment shall be paid. SECTION TWO: That all ordinances and parts of ordinances in conflict herewith be,and the same are,hereky repeal ed,and this Ovdinance shall take effect and be in force from and after its passage, approval and publication. Massie, Clerk Extension A communication from the Jerpe Dairy Products Corp. with reference to the condition of West Spring Str.; of West Spring Street adjacent to their plant was presented to the Council;and after some discussion of the matter by members of the Council ,Mr Campbell and Mr Price an behalf of the Company, Alderman Harding moved that the matter be referred to the Street Committee and the City Engineer for investigation and report.This motion was duly seconded and passed TAGS:* Thw purchase of auto and other tags for the year 1930 was referred to the Mayor and the Cit collector with power to act.on motion by Alderman Pearson,duly seconded and passed. Drainage The drainage trouble at Ladd's on Fletcher Avenue was referred to the City Engineer at Ladd's; with power to actrsmb-foot boix in the matter of contracting with.Lehman for a concrete Culve subject to a cost limitation of $150.00..This action was had on motion by alderman Drake, s conded by Alderman Harding,passed by the unanimous vote of the Council and so declared by t: Mayor. BYRNES & The proposition of Albert Byrnes to deed to the City twelve feet of land from Heer- EAST MEADOW STR.: wagen's eastward to Willow Avenue was referred to the Street Committee and the City Engineer for investigation and report.
