REGULAR MEETING OF. THE CITY COUNCIL OF THE CITY OF

THE MINUTES of the meeting of June 17th, 1929 were read and approved,
THE FOLL6ZING BILLS against the City, bearing the proper vouchers and the approval of the Auditing
Committee were allowed and ordered paid and the Clerk was directed to issue warrants for the
same on motion by Alderman Harding,seconded by Alderman Fuller,passed by the unanimous vote)
of the Council and so declared.by the Ivla•ror; Goss -Rogers Electric Co., $3.25$ Greer Abstract

SHELLEY'S report for the week ending June 22 was presented and on motion ordered received and filed.
IBAERG: I A letter from Dr W.J. Baerg stating that he had left the matter of grading for his sidewalk
with Attorney Dwight Savage was read to the.Council,whereupon Alderman Pearson,seconded by

Alderman Drake moved that the Clerk be directed to notify Mr Savage of the requirements of
the Council in the matter. This motion.was duly passed.
SIDEWALK A petition praying that a sidewalk be.ordered.on Gregg Street from Ida to Dickson was
' PETITION;
,GREGG STR.: presented whereupon Aldergian Drake introduced a resolution ordering the construction of
the walk as desired,but on the West side of the Street,and moved its adoption, Alderman
Bynum seconded the motion which received the following vote ayes Aldermen Bynum, Drake, Ful
Harding, Pearson, Scott, Stanford,Stephens, nays none, and was declared passed by the Mayor

RESOLUTION.
WHEREAS:
In order to provide for the welfare,safety,comfort and convenience of the citizens of the C
of Fayetteville residing on North Gregg Street and in the vicinity thereof;it is necessary
that a sidewalk be constructed along the :7est.side of Gregg Street from the intersection
of Ida Avenue to Dickson Street,
THEREFORE,BE IT R ESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARY.ANSAS:
SECTION ONE:

That the City Clerk of said City of Fayetteville,Arkansas,be, and he is hereby directed
to notify the owners of Lots One (1).and Four (4),Block Four (4)0 Gregg's Addition to the
I City of Fayetteville,Arkansas,and of Lot Five (5), County Court Plat of Section Sixteen (16)
Township Sixteen (16) North, Range Thirty (30) best to construct a concrete sidewalk along
the East side of said Lotsaccordingto the plans and specifications of the ordinances
thereto pertaining,within 60 days from the date.of the service of said notice under the
penalties of the law and ordinances in such case provided.

SECTION TWO:
That this resolution be in force and effect from and after its aps sage and approval, and

all resolutions in conflict herewith be, and the same are hereby,repealed.

42 A petition purporting to contain the signatures of the owners of the majority in assessed
value of the real property within the limits of the territory therein set forth and described
and asking for the establishment of am Improvement District for the purpose of rolling,gradin
and paving a portion of South 4444 Avenue was presented,whereupon Alderman Harding moved th
' said petition be received,filed and placed of record. Alderman Scott Seco nded the motion whi
received the following vote; ayes Aldermen Bynum, Drake, Fuller, Harding, Pearson, Scott,
Stanford, Stephens; nays none; absent and not voting none, and was declared passed by the

Aldeflman Pearson introduced a resolution directing the Ci#y Clerk to publish the
statutory notice of the filing of the foregoing petition. Alderman.Harding seconded the
motion which received the following vote; ayes Aldermen Bynum, Drake, Fuller,\liarding,,
son, Scott, Stanford, Stephens;nays none; absent and not voting none. The Mayor declared
motion passed and the resolution adopted. A copy is as follows;

SECTION ONE:
' That a hearing of said petition to determine.whether those persons who have signed the
same constitute a majority,and what majority,.in assessed value of the said owners of real gre
property within the limits of the territory hereinbefore mentioned,and which is set forth and
'described in said petition,will be had at a meeting of said City Council 66 be held on the
15th day of July, 1929,beginning at 8;00 P.M. thereof.
SECTION T`IO:
That the City Clerk of the City of Fayetteville, Arkansas be, and he is hereby dirested
'to cause.to be published a notice,in accordance with the provisions of Section Two,Act No.�4�
(Acts of Arkansas,1929,advisinf all owners of real property within the limits of the territory
aforesaid,that said petition has been so filed, requesting that said District be so formed
and that the cost thereof be assessed and charged against the real property within said
'limits,and that on the 15th day Of July, 1929,at 8;00 P.M. thereof,the'said City Council will
determine whether the same is signed by the majority in.assessed value of such property pS
owners.

REALTOR The Ordinance providing for licensingli ealers in Real Estate was reported back by the
ORDINANCE:
I Ordinance Committee,without recommendation;whereupon,after some discussion, Alderman Pearson.
moved that the following words be stricken from Section Two;viz;-
"Provided,no real eatste
broker or rental agent,shall be permitted to_ solicit business.upon any street,alley,thorough-
fare,highway,sidewalk,or public business place within the corporate limits of the City of
Fayetteville, Arkansas,except in his own office."
Alderman Harding seconded the motion which
received the following vote; ayes Aldermen Bynum, Drake, Fuller, Harding, Pearson, Scott,
Stanford, Stephens; nays none, and was declared passed by the Mayor,who directed the Clerk to
strike out the words as specified,which was accordingly done.
Alderman Pearson then moved that the ordinance be placed on its third reading and final
passage,this motion was secohded by Alderman Scott, and received the following vote; ayes
Aldermen Bynum, Drake, Fuller, Iiarding, Pearson, Scott, Stanford, Stephens; nays none, and
was declared passed by the Mayor. The Ordinance was read the third time. The Mayor them
announced the question before the Council is shall the Ordinance pass, and called for the
vote on its passage which resulted as follows; ayes Aldermen Bynum, Drake, Fuller, Harding,
Pearson, Scott, Stanford, Stephens; nays none. The Mayor declared the Ordinance passed.

AN ORDINANCE TO BE ENTITLED"AN ORDINANCE PRESCRIBING A LICENSE FEE FOR REAL ESTATE BROKERS
REGULATING THE BUSINESS OF THE SAME AND FOR OTHER PURPOSES."
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAVETTEVILLE, ARKANSAS:
SECTION ONE: '
That hereafter it shall be unlawful for any person,forim partnership,co-partnership, assn-
ciation or corporation to engage in the business of real estate broker or rental agent, or
for any compensation or valuable consideration to sell, offer for sale,buy,or offer to buy,,
or to negotiate the purchase or sale,or exchange of real estate or personal propertyor to
lease or offer to lease,or remt or offer to rent any real estate within the corporate limits
of the City of Fayetteville, Arkansas, whether such property be located within or without the
said City limits of the said City of Fayetteville, Arkansas,without first having secured from
J the City Collector of the said City of Fayetteville, Arkansas,a license to so engage in said
N V business. Provided that no such license shall be issued in the name of any firm, partnership,
J co -partnership, association or corporation,but each individual person so engaging in such
business shall secure a personal license -to so do.
Provided further,that this ordinance shall
not apply to any person,firm, partnership,co-partnership, association or corporation selling
his or their individual property.

` F Each real estate broker or ren6al agent issued a license under the provisions of this
°1 %N ordinance,shall,within ten days from the date of such license,obtain and maintain a place of
J%o business within the corporate limits of said City of Fayetteville, Arkansas,and shall
display a sign designating to the public,such place of business.
ISECTION THREE:
Each applicant for license under the provisions of this ordinance shall be required to
1� pay to the City Collector of the City of Fayetteville, Arkansas,the sum of Twenty-five
($25.00) Dollars per annum,and said City Collector shall issue to such applicant a license
authorizing said applicant tomengage in the business.of real estate broker,or rental agent
for the period of one year from the date -of said license.
SECTION FOUR:
Anyfirm,person, firm, partnership,co-partnership, association or corporation• violating
any of the provisions of this ordinance,shall be deemed guilty of a misdemeanor,and upon a
conviction therefor,shall be fined in any sum not less than Fifty.($50.00) Dollars nor more
✓'� a than One Hundred ($100.00) Dollars for the.first offense,and not less then One Hundred
(/ ($100.00) Dollars,nor more than Two Hundred.Fifty ($250.00) Dollars for the second or,
succeeding offense,and each breach of this ordinance shall constitute a separate offense:
Provided further that.no person,.firm, partnershlp,co-partmership, association
or corporation,who has not procured a.li'cense as herein provided,shall be allowed to charge
o ' any compensation whatsoever as a real ***Gtr estate broker or renthl agent,and any contract
0 ,,rig for compensationby any such person,shall be deemed null and:void and of no probative and
(/ binding force and effect.
SECTION SIX:1
All ordinances and.parts of ordinances in conflict herewith be, and the same,are hereby, r
repealed,and this ordinance shall take effect and be in force from and.after its passage,
approval and publication.

RG JOHNSON Mr R.G: Johnson -was present and requested a hearing on his application for permission
STORAGE
TANKS: to locate Storage tanks ,whereupon AldermanPearson, moved that the.Clerk publish a notice
that such hearing will be had on the 1st day of July at the regular meeting of the City
Council. This motion was se onded by Alderman Harding and received the unanimous vote of the
Council.
FOURTH The matter of correcting the lines of Fourth Street coming up for discussion, Alderman
STREET.
Drake moved that the City Engineer be directed to investigate and'report as to the descrip-
tion of the property involved,the advisability of making the exchange of lands and the
probable expense which might be incurred by reason of the exchange..This motion was seconded
by Alderman Scott and received the unanimous vote of the Council.
On motion duly passed it was ordered that.beginning with the first meeting in July,1929
the City Council shall meet at the hour of 8;00 PM.
No further business appearing,adjourmment was had on motion duly passed.
