BILLS against the City,bearing the proper vouchers and the approval of the Auditing Committee were allowed and ordered paid and the Clerk was directed to issue warrants for the same on motion by Alderman Drake, seconded by Alderman Pearson, passed by the unanimous vote of the members present and so declared by the Mayor; Bert Watson $143,25;Southwestern Gas & Electric Company "511.10;Fayetteville, Printing Company $12.45;Texas Service Station 21.62; Allan M. This mobion was seconded by Alderman Stanford and received the following vote; ayes Aldermen Bynum,Drake, I )Jones, Pearson, Scott, Stanford; nays none; absent and not voting Aldermen Harding and Fuller. !The Mayor declared the motion passed. By Bert Watson, Secy. i ORD. 699 TO REPEAL Alderman Jones introduced an ordinance to repeal Ordinance Number 692,which was read t ORD 692: the first time. Alderman Drake moved that the Rules be suspended and the ordinance placed on its second reading. This motion was seconded by Alderman Scott, and received the follow- ' ing•vote; ayes Aldermen Bynum, Drake, Jones, Pearson, Scott, Stanford; nays none; absent and. not voting Aldermen Fuller and Harding. The Mayor declared the motion passed. The ordinance) was read the second time. Alderman Pearson them moved that the Rules be further suspended and', the ordinance placed on its third reading and final passage. This motion was seconded by Alderman Jones and received the following vote; ayes Aldermen Bynum, Drake, Jones, Scott, Stanford; nays none; absent and not voting Aldermen Fuller, and Harding. The Mayor declared the motion passed. The ordinance was read the third time. The Mayor then announced the questin before the Council is shall the ordinance pass, and called for the vote on its passage, which i resulted as follows; ayes Aldermen Bynum, Drake, Jones, Scott, Stanford; nays none; absent and not voting Aldermen Fuller and Harding. The City Council of the City of Fayetteville, Arkansas granted unto John McCullough August 27th, 1928 a fifty year gas franchise;and WHEREAS, More than 15% of the qualified electors of the City of Fayetteville, Arkansas petitioned that said franchise be put to a vote of the people as provided by Amendment No. 13of the consti- tution of Arkansas;and WHEREAS, The Mayor of Fayetteville, Arkansas then issued a proclamation directing that said special election be held January 21st, 1999 as provided by law, and WHEREAS, said election was held according to law on the date set; and WHEREAS, The County Election Board has certified unto the City Council by the vote of the people, that said franchise was defeated) -380 1NOW IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS: ION 1. That all rights granted to John McCullough under ordinance number 692 are hereby declared ito be null and void and that ordinance•number.692 granting a gas franchise for a term of fifty years to John McCullough is hereby declared to be repealed and held for naught. ION 2'. (That this ordinance shall be in force and effect from and after its passage,approval and publication,and all ordinances or parts of ordinances in conflict herewith,be,and the same are hereby repealed. Mayor, APPEALS, IN The Clerk reported several appeals filed against the action of.the Board of Assessment for DOUGLAS I.D.: Douglas Street Improvement District Number One of the City of Fayetteville,whereupon Alder Scott moved that the hearing of said appeals and any others which may be.filed within the allowed by law be set for the next regular meeting of the Council. Alderman Stanford secohded the motion which received the unanimous vote of the members present. SSESSORS Alderman Stanford presented a resolution anpoimting a Board of Assessment for Alley Im- LLEY AVING provement District Number 40 of the City of Fayetteville, And moved its adoption, Alderman ISTR. 7140; cott seconded the motion to adopt which received the following vote; ayes Aldermen Bynum, Drake, Jones, Pearson, Scott, Stanford; nays none; absent and not voting Aldermen Fuller and , (Harding. The Mayor declared the motion passed and the resolution adopted. A copy is as follow3 RESOLUTION. BE IT RESOLVED BY THE CITY COUNCIL OF THE. -CITY OF FAYETTEVILLE,ARKANSAS: That C.F. Armistead, U.L. Smelser and W.L. Crouch,three qualified electees of the City of Fayetteville, Arkansas are hereby appointed to constitute a Board of Assessment of the benefits to be received by each lot or block or other subdivision of real property within Alley Improvement District Number 40 of the City of Fayetteville,Arkansas,by reason of the proposed improvement I J.F. Appleby to be a member of the ;OM'R LLLEY I.D. Board of Improvement of Alley Improvement District Number 40, and moved its adoption. #40; Alderman Scott seconded the motion to adopt which received the following vote; ayes Aldermen Bynum, Draek, Jones, Pearson, Scott, Stanford; nays none; absent and not voting Aldermen ' Fuller and Harding. The Mayor declared the motion passed and the resolution adopted. A copy is as follows;- W1VW` r)9\ RESOLUTION. WHEREAS, On the 21st day of January,1929,the City Council of the City of Fayetteville,Arkansas,did appoint N.F. Drake, J.F.. Stanford and Ralph Lewis as the Board of Improvement of Alley Im- provement District Number Forty (40) of Cato said City;and WHEREAS, said appointees met and organized as such Board according to law,prepared their report and the plans of the work to be done in the construction of the contemplated improvement;and WHEREAS, Ralph Lewis,because of the pressure of private business,desired to be relieved of further duties as member of said Board of Improvement;and WHEREAS, the said Ralph Lewis did,on the 28th day of January,1929 present to the City Council his re- signation from said Board of Improvement;and WHEREAS, said City Council,by motion duly passed,accepted said resignation;and WHEREAS, the remaining members of said Board requested the appointment of Geo. Appleby to be a member of said Board in place of Ralph Lewis,resigned; THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS: That Geo. Appleby,an owner of,real propebV within the limits of Alley Improvement District Number Forty (40) of the City of Fayetteville, Arkansas,be,and he is hereby,appointed to be a member of the Board of Improvement of said District. ,.
