THE MINUTES of the meeting of January 14th, 1929 were read and approved. THE )WING BILLS against the City,bearing the proper vouchers and the approval of the Auditing Committee,were allowed and ordered paid and the Clerk was directed to issue warrants for the' same on motion by Alderman Scott, seconded by Alderman Jones, passed by the unanimous vote of the members present and so dedlared by the Mayor; American LaFrance & Foamite Co. $60.30; 5 Southwesyern Bell T1. Co. $24.84, Mary -Lu Shop $5.00;Carl K. Bell $21.00; John Zillah $15.00 i and $15.00; Dave Condra $36.00; Ed Malone $5.00; Chase National Bank $1,679.19. HEARING At this time the hearing of the second.petition for the formation of Alley Paving District ALEY PAV- ING250'40;iNumber 40 of the City of Fayetteville, Arkansas was resumed, and after careful consideration jand investigation,the following resolution was introduced by Alderman Pearson who moved its adoption. This motion was seconded by Ald-rman Stanford and received the following vote; ayes Aldermen Bynum, Drake, Harding, Jones, Pearson, Scott, Stanford; nays none; absent and' i not voting Alderman Fuller, The Mayor declared the motion passed and the resolution adopted.1 • I iA copy is as follows; RESOLUTION. WHEREAS, on the 3rd day of September, 1928,a petition signed by more than ten owners of real property, was presented to the City Council of the City of Fayetteville, Arkansas, requesting that steps be taken to form an Improvement District to embrace the property therein described and Iset forth;and WHEREAS, on the 10th day of September, 1928,an ordinance number 694,was passed and approved forming the District as set forth in the above named petition;and ;WHEREAS, on the 11th day of September, 1928,a petition was presented to the said City Council of the Isaid City of Fayetteville, Arkansas, signed by persons claiming to constitute a majority in assessed valuation of all real property located wihhin the District,as.set forth in the (petition and ordinance aforesaid; and WHEREAS, the said City Council of the said City of Fayetteville, Arkansas,by a resolution duly passed and approved on the 11th day of December, 1928,ordered and diredted the City Clerk of the City of Fayetteville, Arkansas,to publish a notice ,once a week for two weeks,advising all owners of real property within Alley Improvement District Number Forty (40) of the City of Fayetteville, Arkansas,that on the 7th day of January, 1929,the said City Council would take ,the last named petition under consideration,and would,at that time determine whether or not the same was signed by the majority in assessed valuation of all real property within said District;and WHEREAS, said notice was so published,in accordance with the law in such cases made and provided;and I WHFREAS, the time has now arrived for said hearing; NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: That after careful consideration,the Council finds that there is a total assedded valuation. of $353,555.00 of real property within said District,according to the last assessment on file in the office of the County Clerk of Washington County, Arkansas; and that persons signing said petition own real property within said District of an assessed.valuation of $181,560.00, according to said assessment. It is therefore the finding of said City Council that the majority in assessed valuation of owners of real property within Alley Improvement District Nuhber Firty (40) of the City of Fayetteville, Arkansas,have signed said petition and the said Distrdct is hereby duly formed by the City Council of the City of Fayetteville, Arkansas. In the consideration of said petition, the Council has been guided by the certificate of the! Circuit Clerk of Washington County,Arkansas, as to the ownership of said real property, and by the certificate of the County Clerk of said County and State,as to the assessed valuation of said real property. Be it further resolved that this resolution be in force and effect from and after its passage and approval, and that all resolutions and parts of resolutions in conflict herewith be, and the same are hereby repealed. DISTR:: Alderman Pearson then introduced a resolution appointing N.F. Drake, J.F. Stanford and Ralph Lewis commissioners of Alley Improvement District and moved its adoption. Alderman J seconded the motion which received the following vote; ayes Aldermen.Bynum, Drake, Harding, Jones, Pearson, Scott, Stanford; nays none; ab sent and not voting Ald rman Fuller. The Mayor declared the motion passed and the resolution adopted. A copy is?as follows; RESOLUTION. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS, SECTION ONE: That N.F. Drake, J.F. Stanford and Ralph Lewis,three owners of real property within the limits of Alley Improvement -District Number Forty (40) of the City of Fayetteville, Arkansas be, and they are hereby appointed as the Board of Improvement for said District. Cade to be a member of the Board I.Ar, of Assessment for University in place of N.F. Drake,resigned, and moved its adoption. Alderman Harding seconded the motion which received the following vote; ayes Aldermen Byn Drake, Harding, Jones, Pearson, Scout, Stanford; nays none; absent and- not.voting Alderman Fuller. The Mayor declared the motion passed and the resolution adopted. N. a@g*e Cade, a qualified elector of the City of Fayetteville,be and he is hereb3 appointed to be a member of the Board of Assessment of University Improvement District Num- ber One of the City of Fayetteville, Arkansas in place of N.F. Drake, resigned; that this resolution be in full force and effect from and after its passage and approval;and that all resolutions or parts thereof in conflict herewith be, and the same are hereby,repealed. Drake, Chairman of the Finance Committee presented his annual report,show- ing the disbursements on account of the various Departments,together with a comparative statement of the incomes and expenses of the ,years 1925,1926 and 1927. Filed with the report was the proposed Budget for the year 1929,which Alderman Drake mov be adopted. Alderman Stanford seconded the motion which received the following vote, ayes Aldermen Bynum, Drake, Harding, Jones, Pearson, Scott, Stanford; nays none; absent and not voting, Alderman Fuller. The Report was orddred received and filed. On motion By Alderman Harding,duly passed,the reading of the minutes of the meeting of January 21st,1929 was deferred to the next regular meeting. CUTAthe request of E.V. Bird,permission was granted to cut the curb on the South side of CURB ON IMttNord Street at the property of Paul Rhoades for the purpose of constructing a driveway, MT.NORD: subject to the supervision of the City Engineer. HIGHT'S i The bills of the Hight Roofing Company for repairs made on North College Avenue and on BILLS: (School Street were referred to the City Engineer with instructions to have'the bill for work on North College presented to the commissioners of Impbovement District Number 31, and to make deduction for faulty work on School Street. MAYOR TO On motion by Alderman Harding,seconded by A1defman Pearson and passed by the unanimous votie L.R.: of the members present,the Mayor was authorized to attend a meeting of a committee from the! Municipal League with a Committee of the General Assembly to discus legislative matters of interest to the Cities of Arkansas. BEN COOK The Clerk was directed to place the name of Ben Cook on the pay -roll as a member of the ON PAY- Police force, with salary at the rate of $125.00 per month, dating from the 15th day of ROLL, jJanuary, 1929, and to issue warrants to him accordingly. Jan. 15, 1929;- The Board of Improvement for Alley Improvement District Number Forty (40) of the City of Fayetteville, Arkansas presented their First Report, whereupon Alderman Pearson moved that said report be received and filed, and spread of record. Alderman Scott seconded the motion, (which received the following vote; ayes Aldermen Bynum,Drake,Harding,Jones,Scott,Pearson, Stanford; nays none; absent and not voting Alderman Fuller. ALLEY I.D.#40; Gentlemen; Fayetteville, Arkansas, January 28,1929. Your Board of Commissioners for Alley Improvement District Number Forty have employed E.M. Ratliff to prepare plans and make estimates of cost of grading,rolling and constructing' I pavement upon all of the alleys situated in Alley Improvement District Number Forty of the City of Fayetteville, Ark nsas. We submit herewith a plat with the alleys shown in color which are to be paved. After careful consideration of the report of our Engineer, ,your Board has decided to construct reinforced concrete pavement which shall he six inches in thickness and to be re - a inforced by usinE/marginal reinforcing bar in the border of each section of pavement. The pavement to be ten feet in width throughout the entire District. Provision will be made however so that private extensions may be made to the navement where the abutting property owners desire to make a wider pavement to connect with improvements not I I !on the property. The general contour of the pabone pavement will be concave in order that drainage water which is delivered to the alleys amy be carried in the center of the pavemen to the outlet.
