AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF FAYETTEVILLE, ARKANSAS AND THE BOARD OF
IMPROVEMENT OF SEWER IMPROVEMENT DISTRICT NUMNER ONE OF THE CITY OF FAYETTEVILLE, ARKANSAS
TO SIGN A PEASE CONTRACT FOR THE USE OF CERTAIN RIGHTS-OF-WAY BELONGING TO.THE ST.LOUIS
AND SANFRANSISCO RAILWAY COMPANY TO CONSTRUCT SEWER THEREON.

WHEREAS:
In the reconstruction of the sewer plant for the City of Fayetteville, Arkansas,it has become
necessary to locate a sewer pipe line on the right-of-way of the St.Louis and SanFransisco
(Railway Company from a point at or near York.Street to the intersection of the Right-of-way 1
of the St. Louis and SanFrinsisco Railway Company with Dickson Street of the City of
Fayetteville, Arkansas;and
WHEREAS:
The St. Louis and SanFransisco Railway Company desire a joint contract with the City of
jFayetteville, 'rkansas,and the Board of Improvement of Sewer Improvement District Number Onel
lof the City of Fayetteville, Arkansas,and the St Louis and SanFransisco Railway Company,
NOW,THEREFORE,BE•IT ORDAINED BY THE CITY COUNCIL OF THE.CITY OF FAYETTEVILLE, ARKANSAS:
SECTION ONE:
That the Mayor of the.City of Fayetteville,
Arkansas and the Board of Improvement of Sewer

Improvement District Number One of the City of Fayetteville; Arkansasare hereby authorized
I
and directed to sign a lease contract for the use of certain Rights-of-way belonging to the
i
St.Louis and SanFransisco Railway Company for the construction of sewer pipe line and for the

operation and maintnance of the same.

SECTION TWO:
1 That this ordinance be in full force and effect from and after its passage,approval and
publicationand all ordinances and parts of ordinances in conflict herewith be and the same are

hereby repealed.

moved its adoption.- Alderman Pearson seconded the motion which received the fmllowing vote; e

WHEREAS:
There is a vacancy in the membership of the Board of Assess-
ment of Douglas Street Improvement District Number One of the City
of Fayetteville, Arkansas,by reason of the resignation of N.F.Drake
therefrom;
THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE,ARKANSAS:
That Geo.N.Cade, a qualified elector of the City of Fayetteville,
Arkansasbe, and he is hereby,appointed to be a member of the said
Board of Assessment of Douglas Street Improvement District Number
One of the City of Fayetteville, Arkansas,in place of N.F. Drake
resigned;that this resolution be in force from and after its pass-
age and approval;and all resolutions or parts thereof in conflict
herewith be, and the same are hereby,repealed.
