The time having arrived for the hearing of the Second petition for the formation of Alley
paving District Number 40 of the City of Fayetteville, Arkansas, the Clerk presented said
Petition together with the abstracter's list of the real property embraced in said District.)
After some discussion of the matter, Alderman Harding moved that the hearing be continued to
henext regular meeting of the Council to be held on the 14th day of January, 1928. This
lotion was seconded by Alderman Jonee and received the following vote; ayes Aldemmien Bynum,
Harding, Jones, Pearson, Scott, Stanford; nays none; absent and not vot$ng Aldermen Drake and
Fuller. The Mayor declared the motion passed and the hearing accordingly continued.

lots in Blocks C and B. Maplewood Addition,viz; N. 30 feet Lots 6,7,8,9 at $500.00;
N. 165 feet Lots lo,11,12,13, at $670.00 (all in Block B andN. 165 feet Lots 1 to 8 inc.

The Appeal of the St Louis and SanFransisco Railway Co., was presented, whereupon Aldermar.
Jones moved that in as much as an agreement had been entered into between the City of Fay-
etteville, and the Commissioners of the Sewer Improvement Dtsbrict of one part and the said
Railway Company of the other part to the effect that foe and in consideration of the grant-
ing of passage over the Right-of-way of the said Railway Company for the laying of the Sewer
main the assessment of benefits to and against said Company should be set at the nominal afc

Jones moved that said assessment be reduced•to the sum of $600.00. Alderman Scott seconded

Scott, Stanford; nays none; absent and not voting Aldermen Drake and Fuller. The Mayor de-
clared the motion passed and the assessment fixed in the sum of $600.00,

absent and not voting Aldermen Drake, and Fuller. The Mayor declared the motion passed and
the reduction so.made.
PORTER: The appeal of W.T. Porter asking a reduction of the assessment of $300.00 against lots
7, Outlots Rose Hill was presented. After investigation Alderman Jones Moved that said appeal

be denied. Alder man Harding seconded the motion which received the following vote; ayes Aldi
ermen Bynum, Harding, Jones, Pearson, Scott, Stanford, nays none; absent and not voting Alder-
men Drake and Fuller. The Mayor declared the motion passed and the appeal denied.

The appeal of F'.H. Carl asking for a reduction of the assessments of 300.00 on N 76feet of
W. 162 feet Lot 9,and $575.00 on Lots 10,11, except N 50 feet,all.in Blk. 8 Davidson's 2nd
Addition, was presented, and after due consideration Alderman Jones moved said appeal be de
nied. Alderman Bynum seconded the motion which received the following vote; ayes Aldermen
Bynum, Harding, Jones, Pearson, Scott, Stanford, nays none; absent and not voting Aldermen
Drake and Fuller. The Mayor declared the motion passed and the appeal denied.
The appeal of F.P. Logue setting forth what he considered the injustice of the assess-
ment against hie property was presented. After investigation, Alderman Jones moved that the
appeal be denied. Alderman Pearson seconded the motion which receibed the following vote;
ayes Aldermen Bynum, Harding, Jones, Pearson, Scott, Stanford; nays none; absent and not vot
Ing Aldermen Drake and Fuller. The Mayor declared the motion passed and the appeal denied.
Alderman Jones introduced an ordinance levying the assessment of benefits in Annex
Number One to Sewer Improvement District Number One of the City of. Fayetteville, Arkansas,
which was read the first time. Alderman Jones moved that the Rules be suspended and the
ordinance placed on its second reading. This motion was seconded by Alderman Harding and
received the following vote, ayes Aldermen Bynum, Harding, Jones, Pearson, Scott, Stanford;
nays none; absent and not voting Aldermen Draek and Fuller. The Mayor declared the motion
passed. The Ordinance was read the second time.

WHEREAS:
The majority in value of property holders owning property adjoining the locality to be affected
and situated in Annex Number One to Sewer Improvement District Number One of the City of Fay!

etteville, Arkansas,have petitioned the County Court of Washington County,Arkansas, to amke
an order authorizing and directing the Commissioners and Assessors of said Improvement Dis-
trict to refund the bonded indebtedness against said District,and to issue new bonds to run
fora period of twenty years instead of ten years,as originally provided in the formation ofl
said Improvement District;
WHEREAS:
The said County Court of Washington County,Arkansas,did so make said Order as prayed for;
WHEREAS:
The Board of Assegsment of said Improvement District,have re -assessed said property in accord
WHEREAS:
ante with the orders and.directions of the County Court of Washington County, Arkansas,and
,have filed the same with the City Clerk of the City of Fayetteville, Arkansas; and
he City Council of the City of Fayetteville, Arkansas,has caused to be published in the Fay-
etteville Democrat,a daily newspaper of bona fide circulation in Fayetteville, Washington
County,Arkansas,a notice to all of said property owners that said re -assessment has been so

the office of the Recorder or City Clerk;and'that five per centum on said Lots,Blocks and
Parcels shall be•pa.id-annually'on or before the first Monday of November until the whole of
said local assessment -shall be paid.

A communication from the Commissioners of Douglas Street Improvement District Number One
of the City of Fayetteville,, Arkansas, requesting the appointment of G.P. Stoker as a member
of the Board of Improvement for said District was presented; whereupon Alderman -Jones intro-
duced the following resolution,making said appointment, and moved its adoption. Alderman Rest
Pearson seconded the motion which received the following vette;`ayes Aldermen Bynum, Harding., '
Jones, Pearson, Scott, Stanford; nays none; absent and not voting Aldermen.Draek and Fuller.
The Mayor declared the motion passed and the resolution adopted. A copy is as follows;-
RESOLUTION.
WHEREAS:
There is a vacancy in the membership of the Board of Improve-
ment of Douglas Street Improvement District Number One of the City
of Fayetteville, Arkansas,by reason of the removal from said District
of Fenner Stice,heretofore a member of said Board;
THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
That G.P. Stoker,a qualified elector of the City of Fayetteville,
and a property holder,owning real property within the limits of said
District,be, and he is hereby appointed to be a member of the Board ,
of Improvement of Douglas Street Improvement Number One of the City of
Fayetteville, Arkansas; and that this resolution shall be in effect
from and after its passage and approval; and all resolutions in con-
flict herewith be, and the same are hereby, repealed.

of the St. Louis and SanFransisco Railway Company with Dickson street of the City of
Fayetteville, Arkansas;and
WHEREAS:
The St. Louis and SanFransisco railway Company desire a•joint contract with the City of
Fayetteville, Irkansas,and the Board of Improvement of Sewer Improvement District Number One
of the City of Fayetteville, Arkansas,and the St Louis and SanFransisco Railway Company,
NOW,THERFFORE,BE,IT ORDAINED BY THE CITY COUNCIL OF THE.CITY OF FAYETTEVILLE, ARKANSAS:
SECTION ONE:
That the Mayor of the.City of Fayetteville, Arkansas and the Board of Improvement of Sewer
Improvement District Number One of the City of Fayetteville; Arkansasare hereby authorized
and directed to sign a lease contract for the use of certain Rights-of-way belonging to the
St.Louis and SanFransisco Railway Company for the construction of sewer pipe line and for the
