THE MINUTES of +:he Meeting of Oxtober 15th,and 22nd, 1928 were read and approved.

THE FOLLOWING BILLS against the City, bearing the proper vouchers and the approval of the Auditing
Committee were allowed and ordered paid and the Clerk vias directed to issue warrants for the
same on motion by Alderman Pearson, seconded by Alderman Scott passed by the unanimous vote o
the Council and so declared by the Mayor; -Washington Transfer Co. 82.09;Sid Burnip 822.50
and ;17.50; Ben Porter $22.50 and $17.50;Ed malone 813.50 and 813.50;John Zillah 848.75 and
$39.25; Dave Condra $36.00.
COMMUNI- The following communications were read to the Council; From P!.E. Graham requesting appointment

of commissioner in Annea to Mont Nord, to succeed V!,C, Hight. As Mr Hight had not resigned,
no action was taken;

On October 5th, 1928, the Honorable H.L. Baker, County)
(Judge of '7ashington County,Arkansas,sitting as the 17ashington County Court,issued an order
with reference to re -funding the Bonds of Annex Number One to Sewer Improvement District
,Number One,to the City of Fayetteville, Arkansas,a certified copy of which order is herewith'
,attached and made a part hereof.

In said order the said Court,among other things,ordered and directed that the entire
indebtedness of said Improvement District be re-funded,and that a new issue of bonds be made)
to cover a period of t-,20ty pears instead of t10 ,years.
This was done for the sole purpose of granting relief to the Tax Payers within.ff:x�tl',i?3 ti s
Ithe said Improvement District,and the Board of Improvement of said Improvement Distriet,there'-
Ifore,respectfully asks that ,your Honorable Body order the Board of Assessment of said Improve-
ment District to re -assess the benefits within said Improvement District,to the end that the
Bond issue may cover a .period of 20 years inbtead of 10 .years as originally provided.

ORDER.
Mow on this day comes on for hearing the petition of certain property owners within Annex
Number One to Sewer Improvement District Number One of the Cs,ty.of F gyetteville, .Arkansas,
tasking for an order directing the Board of Improvement of said Improvement District to refund;
the bonded indebtedness of said District, and the Court being well and fully advised in the
premises;
That in accordance with the provisgions of Act Number 126 of the Acts of Arkansas for
the ,year 1927 certain property owners duly published in all the newspapers published and
;circulated ^+ithin the City of Fayibtteville,F!ashington Counyty,Arkansas,in which said Improve)
ment District is located, a notice of their intention to file a petition asking that said
,bonded indebtedness of said Improvement District be refunded,and that said bonds be made to I
(cover a period. of twenty ,years instead of ten ,years.
That proof of such publication has been duly made and duly filed; and that said notice I
has been published in all the newspapers published within said City of Fayetteville in which'
said. Improvement District is located for a period of at least thirty days before the filing
of said petition.

The Court further finds that the pebitmoners represent fifty-one per cent or more of the
ssessed value of the real estate within said improvement District,and further finds that the
rayer'of said petitioners should be granted.
It is therefore by the court ordered,adjudged and decreed that the prayer of the petition- '

eriod of twenty instead of ten years,as originally issued,and that said bonds be made due
nd payable in twenty annual installments instead of ten annual installments. And that it is
urther ordered that,where taxes extended against any lands within said improvement District
ave already been paid the same shall be refunded. out of the funds created by the new bond
ssue.

Alderman Bynum introduced a resolution directing the Board of Assessment of Annexl ,
Number One to Sewer Improvement District Number One of the City of Fayetteville, Arkansas,
o re -assess the benefits in said District and moved its adoption. Alderman Harding seconded
he motion which received cl:e following vote; ayes Alddrmen Bynum, Drake, Fuller, Harding,
ones, Pearson, Scbtt, Stanford; nays none; absent and not voting none. The Mayor dmclared
he motion passed and.the Resolution adopted. A copy is as follows; -

f the City of Fayetteville, Arkansas, has this day presented to the City Council a petition
etting forth the fact that -on October 5th, 1928,the Honorable H.L. Baker, County Judge of
ashington County, Arkansas,sitting as the County Court, issued an order with reference to
e -funding the bonds of Annex Number One to Sewer Improvement District Number One of the Cit
f Fayetteville, Arkansas; and
said petition contains with it a certified copy of said order of said Court;and
said order of said Court,among other things, ordered and directed that the entire in- ,
ebetedntt deb�tedness of said Improvement District be re -funded and ordered said Commissioners
o issue a new bond for the original amount of said indebtedness-- said bonds to cover a
eriod of twenty ,years instead of ten years as originally issued and that said bonds be made

OW, THEREFORE, BE IT RESOLVED BY THE CITY COUP?CIL OF `SPE CITY OF F:AYETTEVILLE, ARKANSAS,

ereby ordered to re-assessthe benefits of said Improvement District in order that the said
ssessed benefits might provide for,and take care of a bond issue of twenty years instead.of

No further business appearing the Council adjourned.
