REGULAR MEETING OF THE CITY COUNCIL HELD
SEPTEMBER 17th, 1928.

THE MINUTIIIS of the meeting of September 10th, 1828 were read and approved.
THE FOLLOWING BILLS against the City,bearing the proper vouchers and the approval of the Auditing Com
Imittee were allowed and ordered paid on motion by Alderman Fuller, Seconded by Alderman Hard -

REPORISS Annual reports were presented by the Commissioners of the following Improvement Districts; -

COMR'S: Douglas Street; University; North College, Annex to North College; and Plater Number Two.;
whereupon Alderman Pearson moved that the same by received and filed. This motion was duly
seconded by Alderman Fuller, and passed by the unanimous vote of the Council.
APPEAL OF The appeal of R.E. Kennard from the action of the Board of Assessors of Annex Number Two
PEKENNARD:
to East Street Improvement District Number One of the City of Fayetteville.,A rkansas was
' [presented. After full investigation by the Qouncil, Alderman Fuller moved that sold:: the

to 1$275. [assessment of benefits against R.E. Kennend owner of part of Lot 3, Block 6, Original Town
now City of Fayetteville, by reasin of the improvement made in said Improvement District
Ibe,and the same is hereby reduced to the sum of $275.00..Alderman Jones seconded the motion
(which received the following vote; ayes Aldermen Bynum, Drake, Fuller, Harding, Jones, Pear-
son, Scott, Stanford; nays none; absent and not votang none, and was declared pass'd by the
Mayor.

Alderman Harding, seconded by Aldermen Jones, said permit was granted, subject to supervision

the Rules be further suspended and the ordinance placed on its third reading and final

not voting none. The Utayor declared the motion passed. The Ordinance was read the third time.

The Mayor then announced the question before the Council is shall the ordinance pass, and
called for the vote on its passage, which resulted as follows; ayes Aldermen Bynum, Drake,
Fuller, Harding, Jones, Pearson, Scott, Stanford; nays none; absent and not voting none.

AN ORDINANCE LEVYING THE ASSESSMENTS OF BENEFITS IN CURB AND GUTTER DISTRICT NUMBER THIRTY-
EIGHT OF THE CITY OF FAYETTEVILLE IN I'IASHINGTON COUNTY, ARKANSAS AND PRESCRIBING HOPI THE
SAME SHALL BE PAID.
;the majority in value of the property holders owning property adjoining the locality to be
'affected and situated in Curb and Gutter District Number Thirty-eight,of the City of

Fayetteville,Washington County Arkansas organized for the purpose of grading, rolling and
constructing curb and gutter within the following streets or parts of streets,to-wit;
North Walnut Avenue from the North line of East Maple Street to the North line of John-
son street;North Olive Avenue from the North line of Gunter Street to the South line of John
son Street;Johnson Street from the East line of North Walnut Avenue to the West line of Nort
Mission.Avenue; and Gunter Street from the East line of North Walnut Avenue to the West line
of North Mission Avenue,have petitioned the council of the City of Fayetteville, for the
construction of said improvement,and that the cost thereof shall be assessed upon the real
propertyof said District according to benefits received;and
aid benefits received by each and every block, lot and parcel of real property situated in
said District equals or exceeds the local assessment thereon; and
; Ithe estimated cost of said improvement is $12,750.00;

That said several blocks, lots and parcels of rea'1 property. in said Dis trictbto be
assessed according to the assessment list for said Improvement District as the same now re-
mains in the office of the City Clerk, and that Six and two-thirds per centum.of the assess-
ment on each'of said blocks,lots and parcels of real property shall be paid annually on the '
15th day of February until the whole of said local assessment shall be paid.
Passed and approved this 17th day of September, 1928.

be suspended and the ordinance placed on its second reading. Alderman Scott seconded the.

Pearson, Scott, Stanford; nays none; absent and not voting none. The Mayor declared the
notion passed. The Ordinance was read the second time. Alderman Drake then moved that the

and passed by the unanimous vote of the Council, the Clerk was directed to issue to Mayor
Allan M. Milson, a warrant in the sum of $75.00,to be used by him, or so much thereof as may
be needed to defray his expenses while attending the special session of the Arkansas Legis-;
lature for the purpose of securing action by said Body favorable to Cities in the matter of
raod construction.
The matter of granting a permit to Fenner Stice for the installation of a curb gasoline pump
at Lot 5b, Block 2, Original Town,coming on for consideration, and no objection having been)
made'by any one to such installation, Alderman Jones moved that the permit issue, and the
Clerk be and he is hereby directed to issue a written permit granting to said Fenner Slice
permission to install a curb gasoline pump at Lot 5b, Block 2 Original Town,now City of

Fayetteville, Arkansas,location to be determined by the City Engineer, expenses of locating)
to be paid by said Fenner Stice. Alderman Scott seconded the motion which received the folle
owing vote; ayes Aldermen Bynum Drake Fuller Harding,Jones Pearson Scott Stanford;
and was declar ed passed by the Mayor.
The Cle k reported the filling of the appeals of B.F. Davidson and C.T Harding, from the
action of the Board of Assessors of Willow Avenue Improvement District,whereupon alderman
Scott moved that the hearing off said appeals be continued to October 8th, 1928. This motion
was duly seconded by Ald rman Stanford and passed by the unanimous vote of the Council.
IMPR.DISTR. A petition asking for the formation of an Improvement District for the purpose

1st Petition; of paving certain streets of the City of Fayetteville, Arkansas was presented
and on motion by Alderman Pearson, seconded by Alderman Harding, passed by the following
vote; ayes Aldermen Bynum, Drake, Fuller, Harding, Jones, Pearson, Scott, Stanford; nays none',
absent and not voting none, and so declared by the Mayor, was ordered received, filed and s}
