it is necessary that a sidewalk shall be constructed along the East froi of lots 5 and 6,'
Block 18, Gunter Addition to the City of Fayetteville, Arkansas;
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS*
That the City Clerk of said City be and he is hereby directed to notify the owners of ,
said above mentioned lots.to construct a concrete sidwwalk along the West side of North Oliv
Avenue in front of lots 5 and 6 of Block 18, Gunter Addition to the City of Fayetteville, Ar
according to the plans and specifications set forth in Ordinances thereto pertaining, within
60 days from the date of the service of the said notice, under penalties as specified in the

WATER BONDS: A contract by and between the Commissioners of the City Water Plant and I.H. Nakdiman
for the sale of $50,000.00!in bonds of the City Water Plant was read to the Council;-
.
'Whereupon Alderman Harding introduced an Ordinance approving the issuance of said Bonds, which
was read the first time. Alderman Pearson moved.the the RulA& be suspended and the Ordinance
placed on its.second reading. This motion was seconded by Alderman Drake and received the
1following vote; ayes Aldermen Bynum, Drake, Fuller, Harding,.Jones, Pearson, Scott, Stanford;
Inays none; absent and not voting none. The Mayor declared the motion passed, The Ordinance
was read the secor4Ltime. Alderman Brake then moved that the Rules be furthed suspended and
the ordinance.placed on its third reading and final,passage..This motion was seconded by
'Alderman Pearson and received the following vote; ayes Aldermen Bynum, Drake, Fuller,.Harding,
Jones, Pearson, Scott, Stanford; nays_nones absent and not voting none. The Mayor declared the
motion passed. The Ordinance was read the third time.
The Mayor then announced the question before the Council is shall,the ordinance pass, and call
for the vote on its passage, which resulted as follows; ayes Aldermen Bynum, Drake, Fuller,
Harding, Jones, Pearson, Scott, Stamford; nays none; absent "and not voting none. The Mayor

ORDINANCE OF THE CITY OF FAYETTEVILLE,ARKANSAS,GIVING AND GRANTING TO THE BOARD OF
IMPROVEMENT OF WATER IMPROVEMENT DISTRICT NUMBER ONE OF THE CITY OF FAYETTEVILLE,
' ARKANSAS,THE FULL AND COMPLETE CONSENT OF THE CITY OF FAYETTEVILLE TO THE ISSUANCE
AND SALE OF ADDITIONAL BONDS OF THE WATER IMPROVEMENT DISTRICT NUMBER ONE. IN THE
SUM OF FIFTY THOUSAND DOLLARS ($50,000.00) AND CONSENTING THAT SAID BOARD OF IM-
FRuVEMENT OF WATER IMPROVEMENT DISTRICT NUMBER ONE UA' THE CITY OF FAYETTEVILLE

WHEREAS,
under ordinance number 642 of the City of Fayetteville,duly passed and approved Nov-

to the•borrowing of money by the Board of Improvement as recited in that ordinance;and,
WHEREAS,
It is necessary that the Board of Improvement borrow additional money to make neeessa-
' ry extensions and to complete said Water Works System;and,
IkkREAS,
the report of the engineer and the findings of the Board of Managers and the findings
of the Board of Improvement show that it is necessary that said Water Works System be complet!
ed by making the extensions and completing the construction of additions to said Water Works,
system;, and,
I WHEREAS,
the.City Council of the City of Fayetteville finds that it is absolutely necessary '

to make said additional improvements and to make the additional.extensions contemplated;and,
WHEREAS,
it is necessary.to enlarge .said water plant by making said additional extensions an
improvements; and,
RPMEAS,
there are not sufficient fund's on hand belonging.to the City of Fayetteville and to
the Board of Improvement of said District to make said necessary improvements; and,
WHEREAS,
it is necessary for the Board of Improvement to make said additional improvements,
NOW, THEREFORE, BE IT ORDAINED by'the City Council of the City of Fayetteville as follo
SECTIONX l,the said City Council hereby confirmstratifies and adopts the action of the Boa
of Improvement of Water Improvement District Number One looking to the making of said Addit

power to proceed with said improvements and to borrow the money necessary to make the same.
SECTION 2.The said Board of Improvement of Water Improvement District Number One of the City
of Fayetteville,9rkansas,be., and it is hereby authorized,4empowered and directed to issue
its bonds amounting in the aggregate, exclusive of interest,to the sum of Fifty Thousand
Dollars ($50,000sOO), and the City of Fayetteville consents to the issuance of said bonds,
said bonds to be issued in the sum of Fifty thousand Dollars ($50,000.00), and to mature
serially in the years 1942 to 1946,both inclusive, and said bonds to be dated June 1, 1928,
and to mature in the sum of Ten Thousand Dollars ($10,000.00) in each year, the interest to
be paid semi-annually.
SECTION 3.There is hereby appropriated and set aside for the payment'of the obligations of
said Water Improvement District out of the operating fevenues of saidoWater Improvement
District Number One the following sums in the following years,said sums..to be used in the
payment of the interest and principal of

I SECTION 4.
I The City of Fayetteville which has heretofore taken part in the operation of the
water plant by the Appointment and action of aBoerd of Managers,hereby consents to the issue
of said bonds,and in so far as -sail City has the .power, gives,grants and authorizes the said
Board of Improvement of Water Improvement District Number One to take all necessary steps

for the purpose of issuing said bonds and securing the payment of the same and making,ex-
ecuting and delivering a valid mortgage to secure the payment of said bonds and the interest
thereon.
(.SECTION 5.This consent does not obligate the City of Fayetteville to pay tho said bonds or
any dnterest thereon:
SECTION 6.The City of Fayetteville heAeby grants to the holders of said bonds the right and
privilege to take over said plant and operate the same as security for the payment of the
bonds in the event that sash action becomes necessary for the protection of the holders of
said bonds, and the City hereby consents and gives authority and power to the Trustee and

to the holders of said bondsto operikte the plant if default be made in the payment of the
and
bonds a*bDte interest,which operation shall continue until all bonds and interest thereon
are paid;and full power is ***Obi given by the City of Fayetteville to the Trustee and the
holders of said bonds to collect rentals and pay the same on the debt,and to operate said p1w

plant,and to make an accounting to the City of Fayetteville, and the Board of Improvement at
the end of the operation.

This ordinance is necessary for the protection of the health -of the inhabitants
of the City of Fayetteville,and an emergency is hereby declared for the reasons that the
water works system above described is without the additional contemplated extensions and
im rovements,and without said improvements the said system is inadequate and there • is great
danger of fire for lack of stffioient water pressure,to some of the buildings in the City
of Fayetteville,and
said improvements
are
necessary for
the protection of
the health
and
safety of the people
of Fayetteville,
and
this ordinance
shall take effect
and be in
full
force from and after its passage and publication.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
(Sec. 1. That hereafter it shall be unlawful for any person to shoot,hunt, kill, chase, wpund

for molest any squirrel or squirrels within the corporate.limits.of:the City of Fayetteville,
Arkansas.
isec.2.Any person violating any provision of this ordinance shall be fined in any sum not less
than Five Dollars nor:more than Twenty -fibs Dollars. '
Sec.3. That this ordinance shall be in force and effect from and after its passage, approval
and publication, and all ordinances or parts of ordinances in conflict herewith be, and the
same are hereby, repealed.

Alderman Drake was chosen as President pro tempore, by motion duly put and passed.

HEARING, ( The time having arrived for the hearing of the Second petition for the formatdon of Curb and
CURB &
GUTTER, Gutter District Number Thirty-eight , the President pro tempore announced that pursuant to

the Order of the Council at'its ;aeeting of May 28th, 1928, and in accordance with the notice
thereunder published on the 30th day of May and the 6th day of June, 1928, said petition will
now.be considered to determine wheth/,er the signers thereof do constitute a majority in value,
of the owners of real property within sAid'District, and that any person wishing to be.heard
in the matter now has opportunity.
After a thonough investigation of said petition A-Id+wwn by
the Council, Alderman.Harding introduced the following resolution and moved its adoption.
