Massie, Alder,em Bynum, Drake, Fuller, Hardimg, Jones, Pearson, Scott, Stanford; Attorney Don Trumbo, Engine^r,.F.W. Ratliff. THR MINUTES of the meetings held on the 9th day of April, 1928 were read and approved. THE FOL OWING BILLS against the City 94PO bearing the proper vouchers, and having the approval of luditing Committee, were allowed and ordered paid and the Clerk was directed to issue Warr for the same on motion by Alderman Harding, seconded by Aldo -man Scott, passed by the una imous vote of the Council and so declared by the Mayor;-A.C. Hart, %$30.00; Ben Porter %$30. John Zillah %$20.00; Central Auto Company %$1.00;Ed Malone $18.00; Dave Condra $$36.00;J.'J. Shelley %$12.00;.PdcIntosh Studio %$4.00;Democrat Publishing Co. 4P5.82; Southwest Power Compa X467.36; VJ.'i.Gregg $4.00. Cravens The City Engineer reported his findings in the matter of the application of O.H. Cravens Sewer; for permission to cut pavement for th purpose of making sewer connection, to the effect that the sewer main is about 3 feet below the floor of the proposed basement, amd that connection could be made by means of a tunnel. No definite action .vas taken by the Council. STREET The report of the Mayor showing work done by the street grading crew was ordered received UJORK, and filed. CASES It being represented that because of the death of J.W. Grabiel, Mr Don Trumbo, the City PEATDING IN STI Attorney was burdened with the necessity of attending to the legal. matters under Mr Grabi COURT: GRADING OLIVE: RANK SETTLE- MENT: $80316o2 MUNICI- PAL LEAGUE: Mrs Reep H.M. Cop Comrs. Water no practice,and was unfamiliar with the several cases appealed to Circuit Court from the City Police court, and that said cases would probably suffer by reason of these conditions, Alderman Drake moved that the Mayor be authorized to appoint a committee charged with the duty of securing assistant legal service for the prosecution of said cases. Alderman Bynum seconded the motion which received the unanimous vote of the Council. VIhereupon the Mayor appointed as such committee Aldermen Drake and Jones.�°°��� Mr Geo A, Hurst proposed to the Council that if the City would grade Olive Street from the end of the pavement on said Street North to the City Limits, the PPOOVty:� he would, by arrangements already made, gravel the same. This matter was ref@rred to the Street Committ with power to act. Alderman Drake moved that the money received from the Plater Plant, amounting i to x}8,316.201 be applied to the payment of outstanding warrants of the City. Alderman Jones seconded the ; I motion which received the unanimous vote of the Council. On motion, the Mayor was authorized to attend the meeting of the Municipal League to be held Alder mcT introduced the following resolution and moved its adoption, Alderman Scott seconded the motion to adopt, which received the following vote; ayes Aldermen Bynum, Drake, 2; Fuller, Harding, Jones, Pearson, Scott, Stanford; nays nose. The Mayor declared the motion passed and the resolution adopted. A copy is as follows; RESOLUTION. PJHERE.AS, There are two vacancies in the membership of the Board of Improvement of Water Improvement Ditrict Number two of the City of Fayetteville, Arkansas by reason of the resig•. nation of IvTrs William Reep and the removal from the City of Mr H.A. Smith; and P.`HEREAS, It is necessary that these vacancies be filled in order that the affairs of the District be properly attended to; and PJHEREAS, ' It is reported to the Council that Mrs IVilliam Reep and Mr H.M. Cope have expressed a willingness to serve as such members of said Board; r NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYPsTTr.VILLF, ARK.%NSAS: That the said Mrs William Reep and the said H.M. Cope be and they are hereby appointed to be members of the Board of Improvement of Water Improvement District Number Two of the City of Fayetteville, Arkansas. Massie, Aldermen, Bynum, Fuller, Harding, Jones, Pearson, Scot , Stamford; City Attorney Don Trumbo, Alderman Drake entered later. On motion duly passed Alderman Harding was chosen President Pro Tempore, in the absemce of the Mayor, Allan 14, Wilson. The reading of the Minutes of the meeting of April 16, 1928, was deferred to the next r meeting. Alderman Jones introduced an ordinance providing for the levying of the assessment in Pav-I ing Improvement Distrivt Number 36, which was read the first time. llderman Jones then moved that the Rules be suspended and the ordinance placed on its second reading. This motion was seconded by Alderman Scott and 1�eceived the following vote; ayes Aldermen Bynum, Fuller, Harding, Jones, Pearson, Scott, Stanford; nays none; absent and not voting Alderman Drake. The President pro tempore declared the motion passed. The Ordinance was read the second time. Aderman Pearson then moved that the Rules be further suspended and the ordinance placed on its third reading and final passage. Alderman Bynum seconded this motion which re- ceived the following vote; ayes Aldermen Bynum, Fullar, Harding Jon S. 8earson, Scott, Stanford; nays none; absent and not voting Alderman Drake. The NQ clared the motion passed. The ordinance was read -the third time. The President pro tempore then announced the question before the Council is shall the ordinance pass, and called for the vote on its passage, which resulted as follows; ayes aldermen Bynum, Fuller, Harding, Jones, Pearson; Scott, Stanford, absent and not voting Alderman Drake. AN ORDINANCE LEVYING THE ASSESSMENT IN PAVING IIeIPROVEMFNT DISTRICT NUMBER 36 OF THE CITY OF FAYETTEVILLE, ARKANSAS. WHEREAS a majority in value of the property owners owning property adjoining the locality to be affected and situated in Paving Improvement District number 36 of the City of Fayette- ville, Arkansas,organized for the purpose of grading, rolling and paving have petitioned t City Council of the City of Fayetteville for the making of said improvement,and that the cost thereof shall be assessed against the real property of said District according to the benefits rec&ived; and WHEREAS said benefits received by each and every block,lot and parcel of real property situated in said District equals or exceeds the local assessment thereon; and WHEREAS the estimated cost ofXsaidimprovement is $34,000.00; .NOWITHEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION L.tZhatsald That said several blocks, lots and parcels of real property within said District be assessed according to the said assessment list of said District as the same now remains in the office of the City Clerk; and W ten per centum (10%) of the assessment upon each of said blocks, lots and parcels of real property shall be paid annually on or before the first day of August,beginning August 1, 1928, until the whole of said local assessment shall be paid. SECTION 2. That this ordinance 533 be in full force and effect from and after its passage, approval and p;blication and that all ordinances and parts of ordinances in conflict herewith be, and the same are hereby repealed. Wilson entered at this time, and signed the above ordinance instead of the President protempore, Alderman Harding. Lderman Jones introduced a resolution directing the Clerk to burn all calcelled warrants, which vas duly passed; A copy is as follows; RESOLUTION: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: That the City Clerk be, and he is hereby authorized and difected to destroy,by burning, all cancelled City vpavvent-g of Fayetteville,Arkansas warrants now in his possession,issued prior to April 3021927.
