PRESENT: The Mayor, Clerk; Aldermen Harding, Drake, Bynum, Jones, Scott, Fuller, Pearson, Stanford; absent none. THE MINUTES of the meeting of October 17th, 1827 were read and approved. and THE FOLLOIVINGIBILLS Bynum, against the City, bearing the proper vouchers, the approval of the Audtdting Committee 00; Dixie Culvert Mfg. Co. $362.58; Pat Johnson $$5.00;Washington Transfer Co. ;;7.50 and Stanford; were ordered paid and the Clerk was instructed to issue warrants for the same on moton by , Ald.'rman Harding, seconded by Alderman Fuller, passed by the unanimous vote of the Council vote; ayes and so declared by the Mayor; to -wit; M.E. Oliver $1.50; American LaFrance Firs Engine Co. Bynum, $251* 00; Dixie Culvert Mfg. Co. $362.58; Pat Johnson $$5.00;Washington Transfer Co. ;;7.50 and Stanford; $$1.92; Washington Hardware Co. $3,60 John Zillah $$22.50;Ben Porter $25.00; A.C. COMMUNICATION from the Baord of Water Managers was read to the Council, in re, the matter of appro- priating $500.00 from the revehues of the Water Plant for City Purposes. On motion said communication was ordered received and filed. REPORT of Striet work, showing 14 blocks graded during the past week was read and ordered filed. VEST SPRIN STREET Commissioners were present and requested City aid in repairing the pavement in sa district, but were given to understand that the City had no money with which to render any assistance in the matter. The City Engineer being called on, gave an account of the con- struction which has rendered the crossing of Spring and Sckool streets so unsatisfactory, setting out plainly that the condition arose from no fault of the City, but in spite of the advice given at the time of the original construction. (School AvenueiCommissioners were present and reported that they had decided to make an extra assess- ( I menin their district for the purpose of repairing the pavement therein, and had directed Vk theipreparation of the necessary rapers for the levying of such assessment in the sum of 10%1 amounting to about $$3,500.00; ;PAY FOR Alderman Harding introduced an ordinance providing for contracting with the Halloran Iradtor TRACTOR & Co and the Arkansas Road Equipment Co. for the purchase of a Tractor and a Grader, which was (GRADER: read the first time. Alderman Drake moved that the Rules be suspend(�d and the Ordinance on its second reading. This motion was seconded by Aderman Scott and received.the fol II lowing vote; ayes Aldermen Harding, Drake, Bynum, Jones, Scott, Fuller, Pearson, Stanford; i nays none; absent and not voting none. The Mayor declared the motion passed. The Ordinance was read the second time. Alderman Stanford then moved that the Rules be further suspended the ordinance placed on its third reading and final passage. This motion was second ed by Aldlrman Jones and recieved the following vote;.ayes Aldermen Harding, Drake, Bynum, Jones, Scott, Fueler, Pearsom, Stanford; nays none; absent and not voting none. The Mayor declared the motion passed. The Ordinance was read the third time. The Mayor then announced the , question before the Council is shall the ordinance pass, and called for the vots on its passage, which resulted as follows; ayes Aldermen Harding, Drake, Bynum,. Jones, Scott, Fuller, Pearson, Stanford; naSrs none; absent and not voting none. The Mayor declarec the I Ordinance passed. A copy is as follows; - ORDINANCE NUMBER 672. 235 ORDINANCE NUMBER 672. AN ORDINANCE TO BE ENTITLED " AN ORDINANCE CONTRACTING WITH THE HALLORAN TRACTOR COMPANY AND THE ARKANSAS ROAD EQUIPMENT COMPANY TO FURNISH A CERTAIN TRACTOR AND STREET GRADER". BE IT ORDAINED BY THE CITY'COUNCIL OF THE CITY OF FAYFTTEVILLE, ARKANSAS: SECTION ONE: That the City of Fayetteville, Arkansas purchase of and from the Halloran Tractor Company and the Arkansas Road Equipment Company One Type Thirty Tractor and One Russell Super- Special Grader, for the purpose of working and grading dirt streets with- in the corporate limits of the City of Fayetteville, Arkansas. i SECTION TWO: The City of Fayetteville, Arkansas, by the City Council of said. City hereby contracts with the said Halloran Tr�ictor Company and the Arkansas.Road Equipment Company to purphase from them one Type Thir" Tractor and one Russell super -special Grader, for the price hereinafter mentioned, and the said Halloran ractor Company and the said Road Equip- ment Company hereby agree to furnish said above mentioned machinery for said price. The totla amount which the said City of Fayetteville, agrees to pay for said machinery is the sum of Six Thousand Two Hundred Twenty-four Dollars and Forty Cents ($6,224.40), which amount the said City Council of the said City of Fayetteville finds to be a fair and just compensation for said material and said machinery. SECTION THREE: The said City of Fayetteville agrees to pay the said Halloran Tractor Com- pany and the said Arkansas Road Equipment Company the said sum of $6,224.40, to be paid out of the General Revenue Fund of said City of Fayetteville, Arkansas,by warrants made payable to bearer, and to be paid in the following amounts and on the following dates,to-wit 1st ,year, October 25th, 1928, $1244.88 3rd year, October 25th, 1930, °1244.88 2nd year, October 25th, 1929, 1244.88 4th ,year, October 25th, 19310 1244.88 5th year, October 25th, 19322 $1244.88. If the City makes default in the payment of any one of said sumswhen the same becomes due and payable,the City of Fayetteville agrees and stipulates with the owner of the warrant representing the amount of the sum which the City has defaulted in the payment of,to pay the said owner of said warrant the sum of eight per cent interest per annum on said amount of said warrant, from the date of said default until the said sum is fully paid, as an agreed and stipulated penalty and as damages for failure on its part to carry out its contract with the said Halloran Tractor Company and the said Arkansas Road Equipment,or the owner'of said warrant. SECTION FOUR: The City of Fayetteville, Arkansas hereby pledges itself and all of its offi- cersto the faithful performance of this contract as herein set forth in this Ordinance, upor the,full performance of the contract herein set forth, on the part of the said Halloran Tractor Company and the Arkansas Road Equipannt Company. SECTION FIVE:That Ordinance 668, passed and approved on the 26th day of September, 1927,beir an ordinance to directand authorize the Idayor and City Clerk to issue four warrants f.-ttp*t—hg J)U1%*t9*e in payment for .the purchase of a Type Thirty Tractor, purchased from the Halloran Tractor Company, in the total sum of $4,209.00, each warrant for $'1,052025, due and payable one, two, three and four years from date, be and the same is hereby repealed, and the City Clerk is hereby ordered and directed to properly cancell said warrants. SECTION SIX: This Ordinance shall take effect and be in force from and sfter its passage, approval and publication. Passed and approved this 24th day of October, 1927, Approved; Allan M.
