Absent: The Clerk, Alderman Jones I The minutes of the last meeting were read and approved. The follwoing bills werepresented, approved i by the auditing committee, and on motion made by Alderman Harding, seconded by Alderman Drake, and passed by the unanimous,vote of all members listed as present and so declared by the Mayor, were ordered paid and the Clerk directed to issue warrants for the same: D.C. Thurman, $15.00; Dave 0ondra, $36.00,; Jno. Zillah, $15.00; Tropical Paint and Oil Co. $27.44:. A comrnkndhation from H.E. Jackson, County Collector, asking a refund of $138.14, on overpay*ent of del inquent taxes was received. Alderman Harding moved that the refund be allowed, and the Clerk instructed to issue a warrant for $138.14 to the collector. Alderman Drake seconded the motion which was passed by the unanimous vote of all members listed as present and so declared by the Mayor. On motion made by Alderman Drake, seconded by Alderman Bynem, passed by the unanimous vote of all members present, and so declared by the Mayor, a communication from Hayden Anderson, regarding the mov- ing of the Yates dwelling to west Dickson Street, was refferred to the City Engineer, who is to have full power to act in the matter. J.H. MoIllroy appeared before the Council in reference to Ordinance No. 658, authorizing a new asar essment in Sewer Improvement Distridt No. 1. On motion made by Alderman Drake, seconded by Alderman Harding and carried by the follwoing vote: ayes, Alderman Bynum, Drake, Harding, Fuller, Pearson, Scott, and Stanford, nays, none; absent and not voting, Alderman Jones, Oxdim and declared passed by the Mayor, Ordinance No. 658, authorizing a re -assessment on Sewer Improvement District No. 1 was called up for the thud reading and final passage. The Mayor now declared the•question to be " Shall the ordinance pass,"and called for the vote which was as follows: ayes, Aldermen Drake, Harding, Fuller, Pearson; nays Aldermen Bynum, Scott, Stanford; absent and not voting, Alderman Jones. The Mayor declared the Ordinance passed. A copy is as follows: ORDIHWNCE NO. 658. ORDIQNCE OF THE CITY COUNCIL, OF THE CITY OF FAYETTEVILLE, AUTHORIZING A RE-ASSESS11E14T AND AN ADDITIONAL ASSESSMENT OF THE REAL PROPERTY IN SEWER IMPROVEIIENT DISTRICT NUMBER ONE (1)0 OF THE CITY OF FAYETTEVILLE, I 11 ARKANSAS. WHEREAS, this City Council, by Ordinance 196, duly passed and published, organized, created, and laid , I off all of the property in the City of Fayetteville, and designated the same as Sewer Improvement District Number One (1), of the City of Fayetteville; and, WHEREAS, steps were taken by the City Council for the levy of assessments for raking said improvementand WHEREAS, this City Council on the Twenty -Sixth day of tlxy July, 1907, duly levied assessments in said District for the purpose of installing, maintianing and operating a system of sewers for the City of Fay= etteville, Arkansas; and, WHEREAS. by that ordinance the,assessments levied, and to be levied, were declared a lien upon the real property of said District; and, , WHEREAS,I a The Board of Improvement has found and determined that said assessments ware insufficient to complete the improvement authorized by the proceedings of the City Council and by the petition of the property owners in the original formation of said Improvement District; n and, WHEREAS, the said Board of Improvement has reported to this City Council the amount of the deficiency together with the plans and estimates of cast necessary to complete said original improvement as authorized , by the ordinances laying off the same, and creating the same; and, WHEtEAS, the petiton of the majority of the real proeprty owners within said District authorized said sewer system to be constructed, installed, maintained, sad operatied and extended; and, VITHEREAS, the said Boatd has determined and found that for the protection of said sewer system it is necessary to make the improvements reported by said Board, and that without said improvements the said Lights, Gunter Add. Culvert, Rebecca Ave 185 ft improvembnts the said sewer system will be useless and of no value whatever, and that the health and life of the citizens of Fayetteville will be endangered unless said improvements, extensions and rep lacements referred to to made at once; and, WHEREAS, said original improvement as authorized by the petitinne and by the proceedings of the City Council, has not been completed and paid for out of assessments heretofore maB&,xaad, THEREFORE, BE IT ORDAINED.BY THE CITY COUNCIL, of the City of Fayetteville: SECTION 1. That the report of the Board of Improvement of Sewer Improvement District Number One (1)i be, and the same is hereby approved. SECTION 2. That it is absolutely essential for the protection of the health and life of the inhabitants, of the City of Fayetteville, that the improvements originally planned by completed, and that additional assessments as provided by Section 5665 of Crawford and Moses Digest be made. an SECTION 3. That/additional assessment is hereby authorized, and directed, and required to be made for a sum sufficient to complete said improvement. SECTION 4. That said assessments be made by assessors, as required by law. SECTION 5. That F.P. Hall, and N.C. Hight and Clem Pearson, are hereby elected and appointed, as assess- ors to make the above assessment, as required by law, and to assess the benefits and assessments against all the real property in said District, and to make and file said assessment, as required by Section 5658 of Crawford and Hoses Digest. SECTION 6. That daid benefits, when so made by the assessors, shall be, and are hereby declared to be when made and filed, according to law, a charge and a lien against all the real property in said District, and the same shall be collected annually at the times and dates that said assessments have been collected under the original proceedings, and that Ten Percent (10%)i if pfd: necessary and only so much thereof as may be necessary to pay the obligations of sAid District of said assessments be collected annually. SECTION 7. All ordinances in conflict with this are hereby repealed. SECTION 8. It is hereby declared to be necessary and essential to preserve the health and life of the in habitants of Fayetteville that this ordinance be in effect and full force from and after its passage and pub- lication, and the City Council finds as a fact that the dondititon of the sewer sistem at Fayetteville is such that is said repairs are not made xaa} irreparable injury and damage will be done to the inhabi- tents of the City of Fayettevillvr, and the real property therein located. C.D: Atkinson appeared before the Council in regard to street lighting in aanter^s Addition and com- plained that several lights had been discontinued and asked the reason therefor. The Mayor explained why these lights had been discontinued and stated that this matter was in the hands of the Light Committee:, and. that when the final Peport of this committee shall have been made as many lights as possible will be placed in Gunter's Addition. oy Major Davidson appeared before the council regarding a culvert on N. College Ave. and Rebecca Ave. No action was taken. Ord. 657.1 Atftf An Ordinance authorizing the payinlr for of fire hose was read the first time. Aderman Drake moved that Ithe rules be suspended and the ordinance placed on its second reading. Alderman Scott seconded the motion, h received the following vote; ayes, Aldermen Bynum, Drake, Harding; Fuller, Pearson, Scott, and Stanford none; absent and not voting Alderman Jones. The Mayor declared the Motion passed and the ordinance was the second time. Alderman Drake then moved that the rules be further suspended and the ordinance placed its third reading and final passage. The Mayor declared the Ordinance passed. A copy is as follows: 186 Ordinance Number 657. AN ORDI&BNCE TO BE ENTITLED, n AN ORDIMNCE TO PROVIDE FOR TIM PAYL04T OF SIX HUNDRED FEET OF FIRE HOSE. BE IT ORDAINED By The City Council of the City of Fayetteville, Arkansas: Section One. That the City Clerk of the City of Fayetteville, Arkansaq., be and he is hereby authorized and directed to issue two (2)city warrants payable to the Eureka Fire Hose Mfg. Cc as follows: one warrant for th9 sum of Four Hundred Twenty Dollars, payable on demand, and one warren t for the aim of Four Hundred Forty-five ($.445.00)) payable June 22nd, 1928, from Fire Fund. Section Two. That the above warrants are for payment in full for the purchase of six hundred Seat of fire hose contracted for May 23rd, 1927. Section Three. That btis Ordinance be in force and effect from and after its passage, approval and publication, and all ordinances er parts bEereaf in conflict herewith be and the same are hereby repealed.
