PRESENT: The Mayor, Clerk; Aldermen Harding, Drake, Bynum, &OR49y Scott,Fuller, Pearson, Stanford, absentne„& Minutes, I The minutes of the meetinlof May 16th, 1927 were read and approved. BILLS;jThe following bills against the City , bearing the proper vouchers and the approval of the Auditing Committee, were allowed and ordered paid on motion by Alderman Harding, seconded (Alderman Scott, passed by the unanimous vote of the Council and so declared by the Mayor; Dave Condra $,36.00;John Zillah $,20.00; and 42.16,J.I. Holcomb Mfg Co. $12,289 Impr. Alderman Harding introduced the following resolution and moved its adoption. Alderman Drake Distr. #33; seconded the motion which received the following vote; ayes Aldermen Harding, Drake; Bynum, Y (Scott, Fuller, Pearson, Stanford; nays none; absent and not voting Aldrman Jones,. The Mayo idedlared the motion passed and the resolution adopted, A copy is as follows; RESOLUTION. WHEREAS, at a Regular meeting of the City Council of the City of Fayetteville, Arkansas, he Ion the 14th day of February, 1927, there was presented to said City Council by E.E. Trippe, M.W. Moore and H.M. Hudgens, as the Board of Assessment of Improvement District Number Thirty-three (33) of the City of Fayetteville, Arkansas,their report of the assessment of benefits against the real property within said Improvement District, WHereas, on the 14th day of February, 1927, by resolution duly passed and approved, the sai City Council ordered the City Clerk of said City of Fayetteville, Arkansas,to publish a no- tice stating that said assessment Roll had been so filed and was subject to inspection; VfliEREAS, said notice was so published on the 15th day of February, 1927, according to law; I WHEREAS,the said City Council has failed, in the manner and form and at the time reuqired b I ,law, to take final and definite action thereon and pass and cause to be published an Ordina Ilevying said Assessment; jNOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE: That the City Clerk of the City of Fayetteville, Arkansas, be, and he is hereb directed and regtLired to cause to be published a notice stating that the assessment Roll of (Improvement District Number Thirty-three (33) of the City of Fayetteville, Arkansas has bee (duly filed by the Board of Assessment of Improvement District Number Thirty-three (33) of t City of Fayetteville, Arkansas, and that the same is now subject to inspection. Armis#ead was read tm the Council, rela- HAND DEALERS: tive to the matter of licenses for Second Hand dealers, with the request that an effort be made to state definitely the meaning of the terms of the ordinance assessing said license. Whereupon it was ordered that the matter be referred to the Ordinance for investigation and report. C.D. Bates requested that the grade for sidewalk be established along the Northside of Ila for a distance of 130 feet westward from Vandeventer; this request was granted and t: (Avenue City engineer was directed to establish said grade. (PETITION A petition signed b 6 A nue g Y property owners on Ozark reet asking that sidewalks be ordered FOR SIDE* constructed along the east side of said RPM was presented and on motion duly passed ION OZARK: the Clerk was directed to issue the necessary legal notices to the property owners along said Avenue. This motion was made by Alderman Harding, secohded by Alderman Pearson and I passed by the unanimous vote of the members present. WHEREAS,at a meeting of the City Council of the City of Fayetteville, Arkansas, held on the 16th day of May, 1927, there was presented to said City Council, the report of W.N. Gladson, A.M. Harding andJ.R. Bates as the Board of Assessment of North Leverett Avenue Improvement D District Number One of the City of Fayetteville, Arkansas, their report of the re -assessment of benefits in said Improvement District; NOW,TH=ORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: That the.City Clerk of the City of Fayetteville, Arkansas be and he is hereby directed and required to cause to be publidhed a notice ststing that said report has been so filed, and that the same is now subject to inspection; ' and that all resolutions or parts thereof in conflict herewith be and the same are hereby repealed and this rezolution shall take effect and be in force from and after its passage and approval. In the matter of the purchase of additional Fire Hose, the Fire Committee reported taht in FIRE Itheir judgment it was improtant that additional Fire Hose be purchased, and submitted the HOSE* recommendation of the Board of Public Affairs that an Ordinance be passed authorizing the said Board to advertize for bids on 1000 feet of Fire Hose,and contract for same. Alderman Scott introduced an Ordinance authorizing the Board oe Public Affairs to so adver- and to pthrchase tize for bids, for 600 feet of Fire Hose, which was read the first time. Alderman Drake moved that the Rules be suspended and the ordinance placed on its secind reading. Alderman Bynum seconded the motion which received the following vote; ayes Alder- ' men Harding, Drake, Bynum, Scott, Fuller, PearsBn, Stanford; nays none; abserlt and not vot- ing Aldrman Jones. The Mayor declared the motion passed; The Ordinance was read the second time. .Alderman Harding then moved that the Rules be further suspended and the Ordinance placed on its third reading nd final passage. Aldritam Drake seconded the motion whoch re- ceived the folluving vote; ayes Aldermen Harding, Drake, Bynum, Scott, Fuller, Pearson, Stanford; nays none; absent and not voting Alderman Jones. The Mayor declared the motion pas sed. The Ordinance was read the third time. The Mayor then called for the vote on the passag of the Ordinance which resulted as follows; ayes Aldermen Harding, Drake, Bynum, Scott, Fuller, Pearson, Stanford; nays none; absent and not voting Alderman Jones. The Mayor ed the Ordinance passed. A copy is as follows; - ORDINANCE NUMBER 652. AN ORDINANCE TO BE ENTITLED " AN ORDINANCE TO AUTHORIZE THE BOARD OF PUBLIC AFFAIRS TO PURCHASE SIX HUNDERD FEET OF FIRE HOSE." BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS ' SECTION ONE: That the Board of Public Affairs of the City of Fayetteville, Arkansas, be and they are hereby authorized and directed to advertize for bids and award a contract for the purchase of Six Hundeed (600) feet of Fire Hose at a cost not to exceed Eight Hundred and Forty ($840.00) Dollars. SECTION TWO; That this Ordinance be in force and effect from and after its passage, approv- al and publication, and all ordinances or parts thereof in conflict herewith, be and the Sam! are hereby repealed. Alderman Harding moved that the Mayor appoint a committee composed.of the Mayor, Aldermen Drake, Pearson and Scott whose duty it shall be to investigate the matterof providing a City Hall and report their findings. This motion Was seconded by Alderman Bynum and receiv the unanimous vote of the Council. The Mayor appointed the committee as suggested and added -the name of Alderman Hardixig, with the consent o tthe Council. Alderman Drake moved that the Rules be suspended and the Ordunance•.placed on its second reading. This motion was seconded by Alderman Stanford and received the following vote; At men Harding, Drake, Bynum, Scott, Fuller, Pearson, Stanford; nays none; absent and not vot Alderman Jones. The Mayor declared the motion passed. The Ordinence was read the second time. Alderman Harding then moved that the Rules be further suspended and the Ordinance placed on its third reading and final passage. Alderman Pearson seconded the motion which received the following vote; ayes Aldermen Harding, Drake, Bynum, Scott, Fuller, Pearson, Stanford; nays none; absent and not voting Alderman Jonae, and was declared passed by the Mayor. The Ordinance was read the third time. The Mayor then announced the question before the Counil is shall the ordinance pass; and called for the vote on its passage, which re- sulted as follows; ayes Aldermen Harding, Drake, Bynum, Scott, Fuller, Pearson, Stanford; nays none; absent and not voting Alderman Jones. The Mayor declared the ftdinance passed. A copy is as follows; ORDINANCE NUMBER 651 AN ORDINANCE TO BE ENTITLED " AN ORDINANCE TO PROVIDE FOR THE PERMANENT OF THE INTERSECT OF CERTAIN STREETS WITHIN THE CITY OF FAYETTEVILLE, ARKANSAS, AND FOR OTHER'PURPOSES." WHEREAS, there has been formed and created within the City of Fayettecille, Arkqnsqs„ a certain Improvement District known as Improvement District Number Thirty-five (35) of the City of Fayetteville, Akransas; WHEREAS, it is the policy of the City of Fayetteville to aid in the constructing and main- tainingpermgnent streets constructed under the Improvement District Plan; and WHEREAS, the said City of Fayetteville, has assumed part of the expense of improving stree in other improvement Districts; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE:That there is hereby appropriated out of the General Fund of the City of Faye ville, Arkansas, the sum of $3,575.00, to be used by the Board of Improvement of Improve District Number Thirty-five (35) of the City of Fayetteville, Arkansas,in permanently Im paving the intersections of all streets within said Improvement District, and otherwise permanently improving the same. SECTION TWO:that the City Clerk of the City of Fayetteville, Arkansas be, and he is hereby instructed to draw five. warrants of equal amounts, in favor of whomsoever said Board of Im- provement may designate, and at such times as such Board may request, not to exceed in the aggregate, however, the sum of $3,575.00. Said Five Warrants shall be drawn serially so that one warrant shall become due and payable each year after date of issue. SECTION THEE: that this ordinance shakk take effect and be in force from and after its passage, approval and publication. Passed and approved this 23rd day of May, 1927. Attest; J.C. Massie Clerk. Wilson, Mayor, FILLING STATION jEaAeGibson., having obtained a permit to construct a Filling Station at the corner of Spring SPRING & COLLEGE Street and College Avenue, requested permission to cut the curb for the purpose of making a driveway into the same. On motion by Alderman Harding, seconded by Alderman Star and passed by the unanimous vote of the Council, such permission was granted, subject to ' supervision by the City Engineer: APPEAL OF Pn motion by Alderman Harding, seconded by Alderman Pearson, and passed by the unanimous SUIT ' VS of the Council, the City -Attorney was directed to file an appeal in the suit of the MCI] LAFAYETT Banking Company against Lafayett Avenue Improvement District, now pending in the Circuit Court of Washington County..
