REGULAR MFFTING OF THE CITY COUNCIL HELD APRIL 25th, 1927.
PRESENT, The Mayor, Aldermen Harding,Bynum, Jones,Scott, Pearson, Stanford; absent Aldermen
Drake and Fuller.
The Minutes of the meeting of April, 18th, 1927 were read and approved.
BILLS: The following bills against the City, bearing the proper vouchers and the approval of the
Auditing Committee were allowed and ordered paid and the Clerk d4fteted to issue warrants
for the same on motion by Alderman Harding, seconded by Alderman Bynum, passed by the unani=
mous vote of the members listed above as present and so declared by the Mayor; W.A. Gregg
$10.00; Dave Condra $36.00; Jim McKinney, $15.000J.H. Rlooins, $1.00;Democrat Pub. Co. $6.12;
Ed Poore, x'0.82; and $2.16;John Zillah $115.15;J.H. Phipps Lumber Co. $13.80; Ellis Sutton
$27.50;
' Alderman Harding moved that the hearing in the matter of the appeals from the action of
the Board og Assessment in Improvement District Number Thirty-three be continued to the next)
regular meeting of the Council, Alderman Bynum seconded the motion which receited the follow-
ing vote; Ayes Aldermen Hardingii, Bynum, Jones, Scott, Pearson, Stanford; nays none; absent
and not voting Aldermen Drake and Fuller. The Mayor declared the motion passed.
CITY The application of the Arkansas National Bank to be designated as the City Depository fo
DEPOSITORY:
the ensuing two years was received, and being the only application before the Council, Alder-
man Harding moved that the proposition of said bank,viz; to pay three and one half per cent
per annum interest on City Funds and to carry such City warrants as was necessary at the
rate of Six per cent per annum, be accepted and that said bank be designated as the deposi-i
tory for the City Funds of the City of Fayetteville, Arkansas for the period of two years
beginning on the First day of May, 1927. Alderman Jones seconded the motion which received
vote; ayes Aldermen Harding, Bynum, Jones Scott, Pearson, Stanford; nays none; absent and
not voting Aldermen Drake, and Fuller. The Mayor declared the motion passed.
' Action on the request of Mr, Jas. Dinwiddie for the establishment of the grade on Gunter
Avenue was defedred for further investigation.
ORD. Alderman Jones introduced an Ordinance to prohibit tho loitering and prowling, which was

LOITERING read the first time. Alderman Harding moved that the Rules be suspended and the ordinance
PROWLING: placed on its second reading. Alderman Scott seconded the motion which received the follow
vote; ayes Aldermen Harding, Bynum, Jones, Scott, Pearson, Stanford; nays none; absent and
not voting Aldermen Drake and Fuller. The Mayor declared the motion passed. The ordinance
was read the second time.After some discussion of the merits and meaning of the proposed
Ordinance, Alderman Harding moved that the Rules be further suspended and the ordinance
palced on its third reading and final passage. Ald=rman Pearson seconded the motion which
received the following vote; ayes Aldermen Harding, Bynum, Sones, Scott, Pearson, Stanford;
nays none; absent and not voting Aldermen Drake and Fuller. The Mayor declared the motion
passed. The ordinance was read the third time. The Mayor then announced the question before
teh Council to be shall the Ordinance pass, and called for the vote on its passage. which
resulted as follows; ayes Aldermen Harding, Bynum, Jones, Scots, Pearson, Stanford; nays r
absent and not voting Aldermen Drake and Fuller. The Mayor declared the ordinance passed.

SECTION ONE:
That hereafter it shall be unlawful for any person or persons to loiter or
)about property other than his or their own and to enter into the house or place of business
or upon the premises of another for any unlawful.purpose.
SEMON TWO:
Any person or persons found upon property other than his or their own shall be
deemed to be loitering and prowling unless he or they shall be able to, and do, give to any
peace officer inquiring a lawful excuse for his or thibr presence.
SECTION THREE:
This ordinance shall take effect and be in force from and after its passage,
approval
and publication, and any
person found
guilty
of
villatirig
the same
shall be deemed
guilty of
a misdemeanor and shall
be fined in
any sum
not
exceeding
Fifteen
Dollars.

The matter of the rental of the City Wagon Yard came on to be heard at this time, and AttorN
ney J.W. Walker, representing Mr. A.M. Byrnes, denied the validity of the action of the Gott
Council in attempting to extend the contract for lease of said property for a period of
five years, contending that the lease having expired, the City was without any rights in
matter. The City Attorney replied, taking the ground that the renewal and extension of the
lease
was
valid, and the
City
well
within her
rights. However,
a proposition
being
made to
lease
the
property direct
to
Eason
& Company,
reserving to the
City the free
use of
such
part of said property for use as a public Wagon Yard as is now so used, ahving been made,
the matter was deferred , to allow time for the perparation of the contract, which shall
be submitted to the Council for approval.
The matter of controlling the drainage at the corner of South College and Rock Street was
referred to the Street Committee and the City Engineer for report.
A request for street light on North Leverette Street was referred to Aldermen Bynum and J
The Sewer Committee was directed to take up with the Engineer and the Health authorities
the matter of forcing property owners to make sewer connections.
No further business appearing the Council adjourned.
