Present; the Mayor, and Clerk; Aldermen Phillips, Drake, Bynum, Scott and Watson; absent Aldermen Price, HardAng and Jones. The Minutes of the meeting of December 20th, 1926 were read and approved. The following bills against the city were allowed and ordered paid; said bills bearing the prpper vouchers,and having been approved by the Auditing committee,- on motion by Alderman Phillips, seconded by Alderman Scott, passed by the unanimous vote of the members present and so declared by the Mayor#- Washington Transfer,$1.28 and $2009;John Zillah $87.40;Dave J Condra 36.00; Jim Mitchell $15.00;Universal Traffic Control Co. $18.00;Ellis Sutton $7.50; O.K. Transfer tp14.00; W.J. McCoy $8.50; The time having arrived for the hearing on the Second Petition for the formation of Improve ment District Number Thirty-five, and the same having duly and properly had, Alderman Bynum introduced the following Resolution and moved its adoption. This motion was seconded by i Alderman Phillips, and received the following vote; Ayes Aldermen Phillips, Drake, Bynum, Scott, Watson; nays none; absent and not voting Aldermen Price, Harding and Jones. The Mayor declared the motion passed and the resolution adopted. A copy is as follows;- RESOLUTION. WHEREAS, a petition, claiming to represent a majority in ownership in value of owners of real property within Improvement District Number Thirty-five of the City of Fayetteville, Arkansas,said District being laid off, declared and designated under Ordinance Number 634 W the City of Fayetteville, Arkansas,for the purpose of improving by grading, rolling and paving Duncan Avenue from the South line of West Dickson Street to the North line of Putman Streetwas duly filed with the City Council of the City of Fayetteville, Adkansas, on the 6th day of December, 1926, asking that said improvement be undertaken, and that the cost thereof be assessed and charged against the real property situated within said District WHEREAS, said City Council of said City of Fayetteville, Arkansas did, on the 6th day of December, 1926, order and direct the City Clerk of said City of Fayetteville,Arkansas, to give notice by publication in accordance with the laws of the State of Arkansas, that such petition had been filed and that it would be considered at a meeting of the City Council i of said City of Fayetteviklle, Arkansas,to be held at the Mayor's office on the 27th day of December, 1926, beginning at 700 P.M. of said day, and that all property owners might appear before said City Council and show cause for or against the creation of such Distri bt and the making of said improvement; WHEREAS,said notice was so published by said Clerk in accordance with laws WHEREAS, said time for said hearing has arrived and said hearing has been duly and paoper- ly had; AS NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANS I SECTION ONE: That, after careful consideration the City Council of the City of Fayetteville, Arkansas, finds that there is a total assessed valuation of $20,750.00 on said real property within said Districtaccording to the last assessment on file in the office of the County Clerk of Washington County, Arkansas, and that persons signing said petition own real property within said District of the assessed valuation of $16,885.00 according to said assessment. SECTION TWO: That it is the finding of said City Council ofsaid City of Fayetteville, Arkansas that more than 75 % in assessed valuation of owners of real property within Improvement District Number Thirty-five of the City of Fayetteville, Arkansas,have signed said petition and the said District is formed by the said City Council of said City of Fayetteville, Arkane 136 COMRS. FOR 35; fULVERT ON WALL STREET: PIARKING. ORD. 647; SECTION THREE: It consideration of said above mentioned petition the said City Council of sa and Recorder City of Fayetteville, Arkansas,has been guided by the CerifiCate of the Circuit Clerk of of Washington County as t6 the ownership of said real property, and by the Certificate of County Clerk of said County, as to the assessed valuation of said real property. SECTION FOUR: That all resolutions or parts of resolutions in conflict herewith bed, and the same are hereby repealed and this resolution shall be in force and effect from and after -it Passed and approved this 27th day of December, 1926, Attest; J.C. Alderman Scott seconded the motion which received the following vote; ayes Aldermen Phillips, Drake, Soo Bynum, Watson; nays none; absent and not voting Aldermen Price, Harding and Jones. The Mayor declared the -motion passed and the resolution adopted. A copy is as follows - G} yjp RESOLUTION. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: That G.F. Ripley, W.F. Dunn and F.N. Gray, three property owners of real property within the limits of Improvement District Number Thirty-five of the City of Fayetteville, Arkansas be and they are hereby aeop appointed as a Board of Improvement for said District. The City Engineer filed his report on the bids which had been submitted for the constructi of the concrete drainage on the extension od Wall Street, whereupon Alderman Drake moved the City Engineer be authorized to contract wroth the lowest bidder for such construction.,. Alderman Watson seconded the motion which received the following vette; Ayes Aldermen Philli Drake, Bynum, Scott„\ atson, nays none; absent and not voting Aldermen Price, Harding and Jones. The Mayor declared the motion passed. Alderman Scott introduced an.ordinance providing for the amendment of Ordinance Number 639 which was read the first time. Alderman Phillips moved that the Rules be suspended and the ordinance placed on its second reading. Alderman Wats6n seconded the motion which received the following vote; ayes Aldermen Phillips, Drake, Bynum, Scott, Watson; nays none; absent and not voting Aldermen Priced, Harding, Jones. The Mayor declared the motion passed. The ordinance was read the second time. Alderman Drake then moved that the Rules be further sus pended and the ordinance placed on its third reading and final passage. Alderman Scott seconded this motion which received the following vote; ayes Alder4len .Phillips, Drake, Bynum, Scott, Watson; nays none; absemt and not voting Aldermen Price, Harding and Jones. The Mayor declared the mation passed. The Ordinance was read the third time. The Mayor ther called for the vote on the passage of the ordinance which resulted as follows; ayes Alder= men Phillipe, Drake, Bynum, Scott, Watson; nays none; absent and not voting Aldrmen Price, Harding and Jones. AN ORDINANCE TO BE ENTITLED AN ORDINANCE TO AMEND SECTION ONE OF ORDINANCE NUMBER 638 , PASSED AND APPROVED ON THE 1stDAY OF NOVEMBER 1926, AND RECORDED IN RECORD "C” OF THE PROCEEDINGS OF THE CITY COUNCIL AT PAGE 109. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE# ARKANSAS: SECTION ONE: That Section One of Ordinance Six Hundred Thirty nine (639), passed and appro- ved on the 1st day of November, 1926, and recorded in record "C" at page 109.of the Pro - R7 at Ds �i k 137 ceedings of the City Council of the ity of Fayetteville, Arkansas,be, and the same is amended to read as follows;"It shall hereafter be unlawful for any person or persons to park any motor driven vehicle upon.the public square or upon either side of East Center Street between East Street and College Avenue, or upon either dide of Block Street between Center Street and Meadow Street for a period of time longer than Two (2) hours between the hours of 8 o'clock A.M. and 6 o'clock P.M. upon all week days. SECTION TWO;That this ordinance shall be in force and effect from and after January 1st, 194 and a€ter- itspassage, approval and publication and.all ordinances or pa^rts thereof in conflict herewith,specially Section One of ordinance number 639,be, and the same are hereby repealed. The Minutes of the meeting of December; ,017, 1926 were read and approved. The following bills against the City, bearing the proper vouchers,together with the bills of the street sweepers, Condra and Mitchell and the bill of the City Engineer,were ordered paid and the Clerk was directed to issue warrants for the same on motion by Alderman Phillips seconded by Alderman Harding passed by the unanimous vote of the members listed above as present, and so declared by the Mayor;-E.M. Ratliff $158.15;John Zillah $85.00; Allan M. Wilson $10.00;Jim Mitchell x$15.00; dave Coadra $36.00. The reports of the City Purchasing Agent; the City 611ector, The PoXlice Judge and the REPORTS• Fire Chief, and the monthly report of the City Clerk were filed, on motion duly passed, OATHS The Clerk reported that the members of the Board of Improvement of Improvement District , COMRS: Number Thirty-five (35) of the City of Fayetteville, Arkansas had filed with him their IIMPR. DISTR.I 35 1 oaths as such Board._ The report of the Committee charged with the duty of devising a plan for the better man- agement of the matter of assessing Improvement Districts of the City made was presented and informally discussed by members of the Council, and the Clerk was directed to prepare copies thereof for the use of the members of the Council.
