The Minutes of.the meeting of October 25th, 1.026 were read and approved,
The following bills against the City, bearing the proper vouchers and the approval of the
Auditing Committee wrer allowed and orderdd paid on motion by Alderman Price, seconded by I
Ald rman Harding, passed by the unanimous vote of the Council and so declared by the Mayor..

The reports of the City Purchasing Agent, the City Collector, The Police Judge and the
Fire Chief were received and on motion were ordered filed,
The report of the Board of Improvement of Water Improvement District Number One of the
City of Fayetteville, Arkansas,in the matter of borrowing money, issuing bonds making
certain improvements and mortgaging the property was presented and Alderman Harding moved
that the
same be received,
approved and filed. Alderman Jones seconded the
motion
which
received
the following vote;

and was declared

ing MOTOR DRIVEN VEHICLES UPON THE PUBLIC SQUARE OF THE CITY OF FAY-

BE IT ORDAINED BY THE CITY COUNCIL OF THE CTY OF FAYETTEVILLE, ARKANSAS:
SECTION OIv'E:
It shall hereafter be unlawful for any person of persons to park any motor
driven vehiuleupon the public Square for a period of time longer that two (2) hours,between
the hours of 8 O'clock, A.M. and 6 )'clock P.M. upon all week days.
SECTION TWO:
All parking shall be in conformity witja the painted traffic lines, and no
vehicle shall be permitted to occupy any single parking space longer than the period stated
in Section One of this Ordinance.
SECTION THREE:
Nothing herein contained shall be so con strued as to apply to Public Taxi
Cabs occupying established Taxi Cab Stands, nor to public buses,occupying established stan
SECTION FOUR:
rAny person or persons violating any of the provisions of this ordinance shall
�be deemed guilty of a misdemeanor,and upon conviction thereof in the Police Court shall be
fined in any sum not less than Two nor more than Twenty-five for each offense.

SECTION FIVE: and parking
1, This ordinance shall be cumulative to all other traffic ordinances , and shall
repeal only such parts of ordinances that are in direct conflict herewith, and shall be in',
force and effect from and after November 15th, 1926, and the passage, approval and publicatle

placed on its second reading. This motion was seconded by Alderman Jones.and received the f

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF.FAYETTEVILLE, ARK.'LNSAS: '
SECTION ONE: That Section Two of Ordinance Number 577, passed and approved on the 5th day.,
of October, 1925, be amended to read as follows:
"-Section Two: PERMITi' REQUIRED. No wall,.,structure, building or part thereof, shall
hereafter be built, enlarged, altered, or repared, until a plan or clear description of the
proposed work, together with a statement of the materials to be used, and the cost thereof,
,
shall have been submitted to the Building Inspector, who shall, if in accordance with the
provisions herein contained, issue a --.permit for the proposed construction.
Provided, that no permit will be required for small repairs that do not.alter or inte
fere with the electric wiring, the heating sustem, the flues or chimneys, or -any other chanFIe
of the building that does not affect the fire risk, but for.repairs on flues, heating appli ncds
electric wiring, and roofing, a permit will be'required, and the charge for same including
the necessary inspection, shall be One (;•,`+1.00) Dollar.
Structures herei)mafter erected without permit, or not in conformity with this ordinance '
shall be removed.
No building shall be removed until a permit has been obtained from the Building In-
spector; and such official shai_1 not issue such permit, if in his judgment the proposed new
location of the building would seriously increase the fire hazard of the surrounding build-
ings.
SIDEWALK COVERINGS. All buildings over two stories in height, whether new or being re-
modeled or repaired, which frost on the Public Square of.the,City of Fayetteville, Arkansas,I
must have a covering over the sidewalk and extending two feet beyond the curb into the street,_
of sufficient strength to afford ample protection to workers and pedestriams, the other haljl
to be fenced off. The gutter shall have a tight box covering two feet wide, the same beighi�
as the curb, to act as a guard against sand and other building material chocking up said
gutter."
SECTION TWO:. That this Ordinance shall take effect -and be in force.from.and after its

ARKANSAS, FULL CONSENT OF THE CITY OF FAYETTEVILLE,AND FULL POWER AND AURHORITY TO TAKE THE

WHEREAS, the Board of Improvement of Mater Improvement District Number One has requested
that the City Council by a proper ordinance give the consent of the City of Fayetteville to
the Board of Improvement of Water Improvement District Number One, for the making of improv
ments described in the resolution of the Board of Improvement of said District, and describ
ed in the report of the Engineer of the District, dated October 22, 1926; and
WHEREAS, said report of the Engineer has been made, and 'is now, a part of the resolu-
tion of said Board of Improvement, and has been duly approved, ratified and confirmed by th
said Board of Improvement, which was on the 1st dair of November, 1926; and WHEREAS, the
City Council finds that it is absolutely necessary to make.said improvements described in
said resolution of the Board of Improvements, which said resolution has been filed with thi
City Council, and made a part of the record of the City Council, and is made a part of this
ordinance by reference; and 'WHEREAS, it is necessary to improve and eAlarge said water
as set forth in said resolution of said Board of Improvement; and *".IIHEREAS, there are not
sufficient funds on hand belonging to the City of Fayetteville which can be used for the
purposes named, or sufficient funds on hand belonging to the Water Improvement District-.
available for.that purpose; and WHEREAS, it is the opinion of the City Council, and the
City Council so finds, that said Board of Improvement of V'iater Improvement. District Number
one should provide for the raising of the necessary- money to make said improvements, and to
make the same; and
WHEREAS, the Legislature of the State of Arkansas by Act Number 45 of the Ge=neral
Assembly of 1907 passed and approved FeUruary 21, 1907, confirmed the purchase of the water
works and plant of the Fayetteville Water Company, giving and granting to the Board of Im-
provement of ,*later Improvement District Number One full and complete power and ownership
over said water plant; and
V¢FHEREAS, power is given to said Board of Improvement to mortgage the water works
system; and
V;HEREAS, the estimated cost of said repairs, together with the contingencies and in-
cidentals will be more that Two hundred Thousand (?f200,000.00) Dollars, as shown in the

above and foregoing report of the Board of Improvement; and
WHEREAS, it is necessary, and City Council sofinds, for the Board of Improvement.

NO�7 THEREFORE, BE IT ORDAINED by the City Council of the City of Fayetteville, as
follows:
Section 1. Said City Council hereby confirms, ratifies, and adopts the resolution
of the,.Board of Improvement of 17ater Improvement District Number One, which is on file with
this City Council, and. was passed and approved 1st day of Novemberii and which is made
a part of these minutes.
Section 2. That the City Council of Fayetteville hereby consents and gives its
full and complete assent to the making of said improvements by the Board of Improvement of
said ?later Improvement District N umber One.
Section 3. That the Board of Commissioners of water Improvement District Number
One of the City of Fayetteville, Arkansas, be, and it is hereby authorized, empowered and
directed to issue its bonds amounting in the aggregate, exclusive of interest, to the sum
of Two Hundred Thousand ($200,000.00) Dollars, and the City consents -and authorizes said
bonds to be in the denomination and amounts approved by the Board of -Commissioners of Mate
Improvement District Number One, of the City of Fayetteville, said bonds to cover a period
of fifteen years.
Section 4. There is hereby appropriated and set aside for the payment of the ob-
ligations of the Improvement District out of the operati ng expenses of said 'slater Improve-

The City Council hereby appropriates and set aside out of the revenues belonging
to said water works system the sums above named for the payment of the indebtedness made
necessary to make said improvements.

Section 5. The City of Fayetteville which has heretofore taken part in the oper+
ation of the water plant by the appointment 400 and action of a Board of tanagers, said
Board of Managers including representatives of the City and the Board of Improvement, hereby
consents and insofar as said City has the power, gives, grants, and authorizes the Board Oil
Improvement of slater Improvement, District Number One to take all necessary stepb and pro-
deedings for the purposes of making a legal, binding and valid mortgage bg said Board of
Improvement of Water Improvement District Number One to the Trustee for the use and benefit)
of the holder of the bonds, and to pledge for the purposes named in this ordinance, and that
of the resolution of the Board of Improvement, and to mortgage all of the property of said
Board of Improvement including the uncolledted benefit assessments, if there are any.
Section 6. The City of Fayetteville does not undertake to pay any interest on its
own obligations, nor to pay any interest on the obligations of the Water Improvement
District Number One of the City of Fayetteville, not having the power to nay any such in-
terest but does hereby give full power and its full consent without limitation or restra
except
as provided by law,
to the exection of all proper apaers necessary to enable
said

Number One to secure the funds necessary for making said
im-
provement, and the said City of Fayetteville hereby obligates and binds itself to make
the payments from the operating revenues of the water plant and on the dates set forth
above.
Section 7. The City of Fayetteville hereby grants to the holders of said bonds the
right and privilegg to take over said plant and operate the same as security for the pay-
ment of the bonds in the event that such action becomes necessary for the protection of
the holders of said bonds, and the.City hereby consents and gives,authority and power to
the Trustee and to the holders of said bonds to operate the plant if default be made in
the payment of the bonds and interest which operation shall continue until all bonds and
interest thereon are paid, and further full power is given to the Trustee and holders of
said bonds to collect rentals and pay the same on the debt and interest on said bonds,
and to make an accounting to the City of Fayetteville and the Board of Improvement at the
end of the operation.
Section 8. The I'liayor and City Clerk are hereby authorized and empowered to'execute
and acknowledge any agreements that may be necessary for the purpose of carrying into
effect this ordinance.
Section 9. This ordinance is neeessary.and an emergency is hereby delcared for the
reasons that the water yJorks.system above.described is in danger of being damaged for
lack of improvements., and,it is inade.quate,.and there is great danger of fire for lack of
sufficient water pressure.;, and, further it is necessary, for the preservation of.,the public
health and safety, and it. is, necessary to have sufficient viater for sanitary purposes,
and an emergency is. hereby.dellared, and this ordini.3nee shall take effect and be in force
from and 'after its.passage and publication.

The undersigged, your petitioners, would
respectfully
represent and
show that a
petition signed by more than ten property owners
in the City of
Fayetteville,
Arkansas, and
within the territory described within said petition, was presented to your Honorable Body
on the 8th day of 10arch, 1926, praying that your Body take all necessary steps for the e-
rection of an Improvement District, embraced in the territory described in said petition,
for the purpose of improving by grading, rolling and paving with asphaltic or concrete as
the commissioners may hereafter decide, the following streets and parts of streets as hereii
after described; Davidson Street from the West line of North College Avenue to the East lin
of Highland avenue, and North College Avenue (sometimes called the Springdale Road) from th
North line of Davidson Street to the North City limits of the City of Fayetteville, Arkansa
That your Honorable Body passed an ordinance No. 638, laying off the territory des
cribed in said petition, and herein set forth, which ordinance was duly passed on the 25th
day of October, 1926.
o That said ordinance was duly publiabdd in the "Fayetteville Democrat" within twent;
days after its passage, under the hand of the Cl rk of the said City of Fayetteville, Ark-
ansas;
Wherefore, the undersinged, claiming to be a majority in value of the owners of
real property within Impr6vement District Number Thirty -One of the City of Fayetteville,
Arkansas, and described within said Petition and ordinance herein set forth, pray that such
improvement be undertaken and that the cost thereof be assessed and. charged against the rea:
property situated within such District and that the said District be established and main-
tained for the purpose of carrying out the improvement herein set forth.
And said peitioners ask that said improvement shall not exceed in cost forty per
cent of the assessed valuation of the property within said District which District is to be
bounded as follows; Beginning at the intersection of the North line of Davidson Street with
the "lest line of North College, Avenue(Sometimes called the Springdale Road) and running
thence East along the North line of Davidson Street to a point on the North line of said
Davidson Street which is 210 feet and 6 inches East of the East line of North College Ave
(Sometimes called the °pringdale Road), and running thence North parallel with the Bast 1
.of North College Avenue (Sometimes called the Springdale Road), to the South line of an un-
known street which lies one block North and parallel with Rebecca Street; thence in a North
