WHEREAS, the revenues of the City of Fayetteville, Arkansas are wholly inadequate for the proper maintenance of her streets, the policing of her territory and the safe.9Q21 of health and welfare of her citizens; WHEREAS,by reason of constitutional limitation the City is prevented from increasing her revenue by additional taxation; V'.'HEREAS,by far the greater portion of the gasaline and motor oils sold in said city are co sumed byears and trucks which use chiefly, the streets and avenues of said City; and !IIHEREAS;the revenue derived from the sale of said commodities is in lagge part paid by the citizens of said City, and is justly due to the treasury of said city, and would in large part overcome the aforesaid deficit; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE. ARKANSAS: SECTION ONE:That the General Assembly of the State of Arkansas be, and the same is hereby respectfully requested to divert to the use and benefit of Cities of the First Class within the State of Arkansas from the revenues derived from the tax on the sale of gasoline and Motor oils to the amount of One cent per gallon on gasoline and two cents par gallon on Motor Oils sold within the limits of each of said Cities of the First Class, SECTION TWO:That this resolution shall be in force and effect from and after its passage and approval, and that all resolutions in conflict herewith be, and the same are hereby re- pealed. Present The Mayor, Clerk; Aldermen Phillips, Price, Harding, Drake, Jones, Scott; absent Aldermen Bynum and 111a.tson. The reading of the Minutes of the meeting of October 18th, 1926 was deferred to the next regular meeting. AlderTan Price moved that pe mission be granted to the American Legion to bring a Carnival Company to exhibit in the City for the benefit of said Ameriaan Legion, free of the license charge therefor. Alderman Jones seconded the motion which received the following vote ayes Aldermen Phillips, Price, Harding, Drake, Jones, Scott; nays none; absent and not voting Aldermen Bynum and Watson. The Mayor declared the motion passed and the permit granted. The Chairman of the Fihance Committee presented a report on the financial condition of the City, which on motion duly passed was ordered received and filed. The hearing of appeals from the action of the Board of Assessors in District Number Thirty- two and in Annex Number One to Duglas Street Improvement District was continued at this time, whereupon Attorney C.D. Atkinson, representing several of the Appellants restated the grounds of their appeal. The Council having carefully considered the assessments as levied by the Board of Asses: ors for said Districts, first took up for decission the appeal of J.111. Robinson, whereupon AldermanJones moved that in as much as there was an evident and acknowledged error in said assessment of the property of the said J.ti. The Iviayor declared the motion nassed� and the reduction ordered. Alderman Jones moved that; The Appeals of C.S. Hickey, T.P. Hulsey, Mrs H.D. Miser, Idrs R.L.Potter. and Mrs M.J. God- dard having been full$Yuiivestigated,/and theirtassessmentsehaving been compared with the assessments made upon other properties in said District, and there being no evidence of any dsicrimination or injustice,the said Appeals be denied. Robinson/being presented Alderman Jones moved that because the frontage bf the property of the said J.iy. Robinson had been wrongly estimated as 82 feet when it was but 70 feet that the assessment upon said property be reduced from ;417.00 the $376.00: Ald erman Price seconded the motion which received she following vote; ayes Aldermen Phillips, Price, Harding, Drake, Jones, Scott, nays none; absent and not voting Aldermen Bynum and Watson.The Mayor deellred the mation passed. Alderman Jones moved that since the investigation of the matter showed that there had.been no injustice, nor any discrimination in the assessments of C.S. Hickey, T.P.Hulsey, Mrs. H.D. Miser, Mrs R.L.Potter and Mrs M.J. Goddard in Annex Number One to Dougkas Street Impr ovement District , that the appeals of said parties be denied. Alderman Price seconded the motion which received the following vote; ayes Aldermen Phillips, Price, Harding, Drake, Jones , Scott; nays none; absent and not voting Aldermen Bynum, Watson. The Mayor declared the motion passed. Mr Earl R. Lampher of Joplin Missouri addressed the Council on the matter of establishing a Iviotor Bus line in the City, whereupon the Mayor appointed a committee consisting of Price, Harding and Phillips to confer with Mr Lampher, and report to the Council at a subsec meeting. This action was had on motion duly passed. The Commissioners of Annex Number One to South College Avenue Improvement District Number One of the City of Fayetteville presented a report and requested the consideration of the matter of City Aid to said District. Alderman Drake seconded the motion which received the following vote; ayes Aldermen Phillips, Price, Harding, Drake, Bynum, Jones, Scott, Platson; nays none; absent and not voting none, and was declared passed by the Mayor. A petition for lights to be located on St Charles Street was presented to the Council I and on motion was referred to the Aldermen From Ward Two. j RENTAL I The rental contract for the rooms in the County Court House entered into by the Mayor on CONTRACT behalf of the City and the County Judge on behalf of the County wwas read to the Council, whereupon Alderman Harding moved that the said Contract be approved, received, filed and spread of record. Alderman Watson seconded the motion which received the following vote; Aldermen Phillips, Price,'Harding, Drake, Bynum, Jones, Scott, Watson; nays none; absent not voting none, and was declared passed by the Mayor. A copy is as follows; - RENTAL CONTRACT. This Contract made and entered into by and batween Washington County, Arkansas, hereinafter called"the County", and the City of Fayetteville, Arkansas, hereinafter called "The City", this 25th day of October, 1926, as follows, to -wit; For and in consideration of the terns and stipulations hereinafter entered into, the County agrees to let and lease, and by the execution of this contract, does let and lease unto the City the Two (2) rooms im the Southeast corner of the Washington County Court House, together with the Vault connected with the said rooms, for a period of FIVE (5). YEARS, from and after' December 9th, 1927. • 1.0 4 LANS OF BOARD OF MANAGERS WATER PLANT, PPROVAL: 1 -i I- The two rooms and vault hereby leased are to be used by the City as a Police Court, Mayor' Office,Council Chamber, Odgices of the City Collector, Office of the City Water Plant, and for any other official business. Heat, Light and Water are furnished with the said rooms during the term of this contract: Included in this lease, the County agrees to lease, and hereby does lease unto the City ground space sixty (60) feet long by twenty-five (25) feet wide, East and West, in the NortY. east corner of the Court House Grounds, for the purpose of stnning City Supplies, and it is agreed that the City shall have the right to cons.trucy a building on said space for the pu pose of storing*supplies; the Mayor. and at the termination of this contract, the City shall have the right to remove said building. For and in consideration of the above and foregoing, the City hereby agrees to pay unto the County, the sum of FORTY($40) DOLLARS each month in advance as rentals of the above de scribed premises, payment to be made not later than the 15th day of December, 1927, and each month thereafter during the term of this contract. It is agreed that this contract be made a matter of record upon the records of the Count Court. It is also understood and agreed that this contract shall begin on December 9th, 1 upon which date the present contract which was executed on June 19th, 1923 shall expire, and continue for a period of Five (5) Years. WGEREAS, at a meeting of the City Council of the City of Fayetteville, Arkansas, held on t 25th day of October in the yaar 1926,there was presented to said City Council by the Board of ImproUemrvnt of Water Improvement District Number One of the City of Fayetteville, Arkan and the Board of Managers of the City Water Plant of the City of Fayetteville, Arkansas, their report, together with the plans of the work to be done in the construction of the im- 1provements contemplated by said Board in the various improvements and exrensions to be made upon the City Water Plant and the said report having been read in open meeting and said plans having been fully explained to said Council and to each member thereof, and it appear- ing from said report and said plans that the total cost of said improvements is the sum of $228,913.92 and the said Council being satisfied that the plans are feasible and practicable and that the same are for the best interest of the citizens of Fayetteville, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: That said Plans and said report be, and the same are he reby approved and adopted and that said improvement be constructed according to said plans and at a cost not to exceed, exclu- sive of interest c)3arges,$228,913.92. This motion was seconded by Alderman Harding and received the following vote; ayes Hldermen Phillips, Price, Harding, Drake, Bynum, Jones, Scott, 17atson; nays none; absent and not venting none, and was declared passed by the Mayor. The ordinance was read the second time. Alderman Drake then moved that the Rules be further suspended and the Ordinance placed on its third reading and final passage. This motion was seconded by Alderman Scott and received the following vote; ayes Aldermen Phillips, Price, Harding, Drake, Bynum, Jones, Scott Watson; nays None; absent and not vot- ing none. WHEREAS, a majority in value of the property owners owning property adjoining the locality to be fiffected and situated in improvement District Number Thirty-two of the City of Fayette ville, Arkansas;organized for the purpose of grading, rmlling and constructing curb and gutter; have petitioned the City Council of the City of Fayetteville, Arkansas, for the construction of said improvement and that the cost thereof shall be assessed upon the real property of said District according to the benefits received; and WHEREAS,said benefits received by each and every block, lot and parcel of real property I situated in said District equals or exceeds the local assessment thereon, and WHEREAS, the estimated cost of said improvement is .?8,250.00, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE:That said several blocks, lot's and parcels of real property within said District) be assessed a ccording to the said assessment list of said Improvement District as the same now remains in the office of the City Clerk; and ten per centum (10%) of the assessment upon each of said blocks, lots and parcels of real property shall be paid annually between the Firzt day of January and the Fifteenth day of January of each year until the whole of said local assessment shall be paid. Communications from the mayors of the Cities of Little Rock and Pine Bluff, Arkansas, addressed to the mayor, and expressing approval of the action of the City Council of Fay- etteville, in the position taken with regard to the tax on Gasoline and motor oils were r to the Coundil. Paul Heerwagen presented to the Council his plans for re -modelling and improving his Filling Station and garege and asked for permission to proceed with the work, and for the approval of his plans. Ald rman Harding moved that the plans be approved and permission ed for the construction as planned, undr the supervision of the City Engineer. Alder man Scott seconded the motion which received the unanimous vote of the Council. Alderman Harding introduced an ordinance creating mprovement District Number Thirty - One which was read the first time. Alderman and called for Price moved that the Rules be suspen ded and tl Ordinance palced on its second reading. This motion was secoande by Alderman} Jones and re- ceived the followwinf vote; ayes Aldermen Phillips, Price, Harding, Drael,, Bynum, Jones, Scott, Watson; nays none; absent and not voting none; and was declared passed by the Mayor, The ordinance was read the second time.
