Bynum, Present, The Mayor, Clerl;; Aldermen Phillips, Price, Harding, Drake, Jones, Scott, Watson absent none. The Minutes of the meetings of October 11th, and 15th, 1926 were read and approved. The following bills against the City ,bearing the proper vouchers and the approvall of the Auditing Committee were allowed and ordered paid and the Clerk was directed to issue warrants for the same on motion by Ald-rman Price, seconded by Alderman Scott, passed by t the unanimous vote of the Council and so declared by the Mayor; Dave Condra -0;36.00; Goss - Rogers Electric Co. $1.m0; John Zillah x$85.00. 1 On motion by Alderman Harding, seconded by Alderman Price and passed by the unanimous vote I of the Council the C6ty Collector was directed to secure bids for License tags for the year] 1927. Alderman Price moved that the hearing of the appeals in Annex Number One to Douglas Steeet Ijprovement District Number One and also the appeals in Improvement District Number Thirty- two be continued to October 21st, at 7;30 P.M. This motion was seconded by Alderman Jones and receivecd the following vote; ayes Aldermen Phillips, Price, Harding, Drake, Bynum, Jones, Scott, Watson; nays none, and was declared passed by the Mayor. The application of Heerwagen Bros. Co. for permission to reconstruct their front entrance byalterations in the sidewalk was allowed after certain changes in their proposed plan had I been agreed upon,requiring that the entrance driveways should show a slope in the outer 222 feet of the walk, and 3224 feet of level walk on the inside thereof, the portion of the walk between the driveways to be clearly distinguished from the street by the usual curb. This ac tion was had on the motion of Alderman Harding, seconded by Alderman Price and passed by the unanimous vote of the Council. .D.ATKIN- Mr. C.D. The second Petition for the formation of Improvement District Number Thirty-three (33) was presented, claiming to represent the majority in value of the owners i of real property within, said Distric t and on motion by Alderman Jones, seconded by Alderman Harding,was ordered received, filed and placed of record, the vote on said,.motion being as follows; ayes Alder- men Phillips, Price, Harding,•Drake,•'Bynum,"Jones, Scott, Watson; nays none; absent and not voting none. The motion was declared passed by the Mayor. The following is a copy of the petition; - TO THE MAYOR AND CITY COUNCIL OF THE CITY CF FAYETTEVILLE, ARKANSAS: The undersigped, your petitioners, would respectfully repeesent and show that a petition signed by ten property owners in the City of Fayetteville, Arkansas, and within the tlrritory describgd within said petition was presented to your Honorable Body on the 7th day of September 1926, praying that your Body take all necessary steps forl the creation of an Improvement District embracing the territory described in said petition for the purposes of improving by grading, rolling and paving the following Streets and Parts of Streets as hereinafter described, to -wit: I 96 East Rock Street from the East line of South College Avenue to the East line of Mill Avenue and Mill Avenue from the South line of East Hock Street to the junction of the Huntsville Road and Huntsville Road from the junction of P+Iill Avenue to the west line of the alley which lies between Lots Seven (7) and Eight (8), Block Two (2), Norwood's Second Addition to the City of Fayetteville, Arkansas. An ordinance to regulate the parking of motor vehicles on the public Square was introduced by Alderman Price and read the first time. Whereupon Alderman Harding moved that the Rules be suspended and the Ordinance placed on its second reading. Alderman Jones seconded the mo: tion which received the following vette; ayes Aldermen Phillips, Price, Harding, Drake, Bynum, Jones, Scott, Watson; nays none, absent and not voting none, and was declared passed by the Mayor. The Ordinance was r read the second time;and Placed on the calender. Alderman Phillips introduced a resolution proposing a plan for increasing the revenues of the City, and moved 4ts adoption. WHEREAS, the revenues of the City of Fayetteville, Arkansas are wholly inadequate for the maintenance of her streets the g y e.9g01xi proper , policing of her territory and the saf of health and welfare of her citizens; WHEREAS,by reason of constitutional limitation the City is prevented from increasing her revenue by additional taxation; WHEREhS,by far the greater portion of the gas1line and motor oils sold in said city are co sumed byears and trucks which use chiefly, the streets and avenues of said City; and !YHEREAS;the revenue derived from the sale of said commodities is in lagge part paid by the citizens of said City, and is justly due to the treasury of said city, and would in large part overcome the aforesaid deficit; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUiNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE:That the General Assembly of the State of Arkansas be, and the same is hereby respectfully requested to divert to the use and benefit of Cities of the First Class within, the State of Arkansas from the revenues derived from the tax on the sale of gasoline and Motor oils to the amount of One cent per gallon on gasoline and two cents per gallon on Motor Oils sold within the limits of each of said Cities of the First Class, SECTION TWO:That this resolution shall be in force and effect from and after its passage and approval, and that all resolutions in conflict herewith be, and the same are hereby re- pealed. Present The Mayor, Clerk; Aldermen Phillips, Price, Harding, Drake, Jones, Scott; absent Aldermen Bynum and Watson. The reading of the Minutes of the meeting of October 18th, 1926 was deferred to the next regular meeting. Alderipan Price moved that pe mission be granted to the American Legion to bring a Carnival Company to exhibit in the City for the benefit of said American Legion, free of the license charge therefor. Alderman Jones seconded the motion which received the following vote ayes Aldermen Phillips, Price, Harding, Drake, Jones, Scott; nays none; absent and not voting Aldermen Bynum and Watson. The Mayor declared the motion passed and the permit granted. The Chairman of the Fihance Committee presented a report on the financial condition of the City, which on motion duly passed was ordered received and filed. Phe hearing of appeals from the action of the Board of Assessors in District Number Thirty- two and in Annex Number One to Duglas Street Improvement District was continued at this time, whereupon Attorney C.D. Atkinson, representing several of the Appellants restated the grounds of their appeal. The Council having carefully considered the assessments as levied by the Board of Asses: ors for said Districts, first took up for decission the appeal of J.l"•/. Robinson, whereupon AldermanJones moved that in as much as there was an evident and acknowledged error in said assessment of the property of the said J.1% Robinson in Improvement District Number Thirty - 0 two of the City of Fayetteville, lrkansas in that the frontage was reckoned as being 82
