REGULAR MEETING OF THE CITY COUNCIL HELD 7LULY 19th, 1926a sent; the Mayor Clerk; Aldermen Phillips, Price, Harding, Drake, Bynum, Scott and Watson; sent, Alde man Jines. The Minutes of the meeting of July, 12th, 1926 were read and approved. The following bills against the City, having proper vouchers attached, and being approved by the Auditinf Committee, were ordered paid, and.the Clerk was directed to issue warrants for the same, on motion by Alderman Harding, secomded by Alderman Price, passed by the unanimous vote of the members present, and. so declared by the Mayor; -Dave Condra, $36.00, John Zillah $146.25;Washington Transfer $3.49;Pollard-Pettigrew Abstract Co. $10.00; The Fayette ille Democrat 51.22; Dan Cotton $25.00. The time set for the hearing on the petition -to Annex certain.territory to Douglas Stre Improve ent District Number One of the City of Fayetteville; Arkansas, said hearing was duly and properly had; and all persons.who desired to be heard.having been heard, and no question of the accuracy of the evidence supporting the claim of the petitioners to con- stitute a majority in assessed valuation of the owners.of.real.property within the territo- ry set forth and described in said petition, Alderman Watson introduced an ordinance de- claring the finding of the Council, which was read the first time. Alderman Harding moved that the Rules be suspended and the ordinance.placed on its second reading. This motion was seconded by Alderman Price and received the following vote; ayes Aldermen.Phillips:p Price, 5 ing, Drake, B um, Scott, Watson; nays none; absent and }iot voting Alderman Johes.The Mayor o -r a�nrv`ovw c2 k/� nL 0A_7 r -v eclared the motion passed.AAlderipan Phillips them moved that the Rules be further suspended and the ordinance placed on its third reading and final passage. Alderman Drake seconded the motion which received the following vote; ayes Aldermen. Phillips, Price, Harding, Drake, ynum, Scott and Watson; nays none, absent and not.voting Alderman Jones; and was declared passed by the Mayor. The ordinance was read the third time. The Mayor then announced the question before the Council is, shall the Ordinance pass, and ca;lled for the vote on its passage, which resulted as follows; ayes Aldermen Phillips, Price, Harding, Drake, Bynum, scott and Watson; nays none; absent and not voting Alderman JAnes. The Mayor declared the Ordinance passed. A copy is as follows;- ORDINANCE NUMBER 628. AN ORDINANCE TO BE ENTITLED " AN ORDINANCE DECLARING THE FINDING OF THE CITY COUNCIL OF THE ITY OF FAYETTEVILLE, ARKANSAS,ON THE PETITION TO ANNEX CERTAIN.TERRITORY•TO DOUGLAS STREET IMPROVEMENT DISTRICT NUMBER ONE OF THE CITY OF FAYETTEVILLE, ARKANSAS,ANNEXING THE SAME, DE* CRIBING THE BOUNDARIES THEREOF AND NAMING THE SAME." WHEREAS,on the 21st day of June, 1926, there was filed with the city council of the cit, fayetteville, Arkansas,a petition purporting to contain the signatures of a majority in sessed valuation of the owners of real property within the territory therein dewcribed and t forth, and praying that said territory be annexed to Douglas Street Improvement District mber One of the City of Fayetteville, Arkansas,and created into an improvement District to known as Annex Number One to Douglas Street Improvement District Number One of the City Fayetteville, Arkansas,for the purpose of grading, rolling and paving Douglas Street from e West line of Storer Avenue to the West Line of Lindell Avenue, and Oakland Avenue from th line of West Maple Street to the South line of Douglas Street and Lindell Avenue from e North line of West Maple Street to the South line of Douglas Street; HWEREAS.on the 28th day of June , 1926, the City Council of the City of Fayetteville, sas,did, by resolution duly passed and approved, direct the City Clerk of said City to gi tice by publication once a week for two weeks in some newspaper. having a general circtilat said City of Fayetteville, Arkansas, that such petitton.had been filed,describing the to tory therein set forth,and that on the 19th day of July, A.D.1926,at 700 P.M. thereof,a ing of said City Council would be held in the office of the Mayor, at which meeting said petition I. would be considered,and that all persons owning real property within the territory ,r c R 57 ----------- - --- -- - - -------3u1y--19,-1926 -- --- � ---- 1 1 therein described might appear and show cause for or.against such annexation, and WHEREAS such notice was so published by said Clerk,_ according to law; and WHEREAS,the said time for said hearing has arrived and said hearing has been duly and roperly had by said City Council; NOW, THEREFORE, BE IT ORDAINED BY THE CITY CIINCIL OF THE CITY OF FAYETTEVILLE, ARKABSAS, SECTION ONE: That after hearing all persons who desired to be heard ; and after due in- estigation and consideration of the petition hereinabove mentioned, in which consideration said City Council has been guided by the certificate of the Circuit Clerk of Washington , Arkansas, as tb the ownership of the lands described in said petition, and by the icate of the County Clerk of said County as to the assessed valuation of said lands described in Section Two of this ordinance, the finding of said City Council is as to -wit;- The total assessed valuation of said lands, according to the last assess - t of the same for State and County purposes,now on file in the lffice of the.County Clerk Washington County, Arkansas,is the sum od $16,505.00; and the assessed valuation of the ds in said territory belonging to the persons whose names appear subscribed to the said ition is the sum of $9,060.00, according to said assessment , and that therefore bald ition is signed bythe majority in assessed valuation of the owners of real property in id territory. Wilson, AThe::timeHfor the hearing on the Second petition for the formation of District Number 32 having arrlted, the Council took up the consideration of said petition, and after hearing all persons who desired to be heard„ and after due investigation , Alderman Harding i ntro- duced the following resolution and moved its adoption. This motion.was seconded by Alderman Price and received the following vote, ayes Aldermen Phillips, Price, Harding, Drake, Bynum, Scott, Watson; nays none; absent and not voting Alderman Jones. The.Mayor declared the motion passed and the resolution adopted. A copy is as follows;- RESOLUTION. WHEREAS, on the 21st day of June, in the year 1926,a.petition signed by ten owners of real property was presented to the City Council of the City df Fayetteville, Arkansas,pray- ing that certain territory described therein be•foAmed.into an improvement district; and WHEREAS, onpth6t21nday of June in the year 1926, the City Council of the City of Fay- ettevillib, Arkansas, passed an Ordinance, Number 622 creating said Improvement District I s set forth in the description of the above referred to Petition.and in said Ordinance de- signating the same Improvement District Number Thirty::Two of the City of Fayetteville, Ark- ansas, xkaxziximx and Whereas, a petition signed by owners of real.property within Improvement District Num- ber Thirty-two of the City.of Fayetteville, Arkansas, who claim to constitute a majority in assessed value of real property within said Improvement.District eas presented to the City Council of the City of Fayetteville, Arkansas, on the 28 day of June in the year 1926; and WHEREAS, the City Council of the City of Fayetteville, Arkansas, did upon the 28 day of June in the year 1926, pass a Resolution directing the City Clerk of the City of Fayette- ville, Arkansas, to publish a notice once A week for two weeks in a daily news paper in the City of Fayetteville, Arkansas, stating that said Petition had been filed with the City Council and that a hearing would be hf2d by the City Council on the 19 day of July in the year 1926, to determine whether or not said signers of said Petition do constitAte a maj- ority in assessed value of real property within said District; and WHEREAS, said hearing has been had and all persons who desire to be hears have been heard by the City Council NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE.CITY OF FAYETTE9'ILLE, SECTION ONE: That the total assessed value of the real.property within said Improvemen District Number Thirty-two to the amount of $16,505.00 SECTION TWO: It is the finding of the City Council that thoses signing said Petition own real:'porperty within said.Distri.ct of the assessed valuation of $9,060.00 and constitut r. 1 rI 7 L� WNTON 0ON^^^ EAST �J SPRING STREET HOSP TIDE* WALK MENT [ZJ 59 a majority in assessed value of real property within Improvement District Numbdr Thirty- two of the City of Fayetteville, Arkansas. SECTION THREE. That the findings of the City Council referred to.in Section Two of this Resolution was based upon a certificate of the Circuit Clerk and Ex -Officio Recorder o. Wqshington County, Arkansas, as to the record ownership of said real property and a cer-i tificate of the Countv Clerk of Washington County, Arkansas, as to the assessed value of the real property situated in Improvement District Number Thirty-two of the City of Fay- etteville, Arkansas. SECTION FOUR: That all Resolutions or parts of Resolutions in conflict herewith be, an the same are hereby repealed and this Resolution shall be in force and a ffect from and after its passage and approval. WHEREAS, preparations are about completed for.the paving of East Spring Street from the Res East lin$ of College Avenue to Willow Avenue; Whereas,said paving does not include the construction of curbs; WHEREAS,the majority of the property owners, wh&se property abuts upon said Street have constructed curbs along the front of thiir respective properties, and WHEREAS, certain owners of real property abutting upon said.street have.not so consbbucted curbs; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OFf THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE: That the City Clerk of the City of Fayetteville, Arkansasbe, and he is hereby directed to issue notices to the owners of Lots One (1), Two (2), Three (3) and Four (4), in Block One (1), Valley View Addition to the City of Fayetteville, Arkansas; and of Lots Six (6), Seven (7), Eight (8), andd Nine (9), in Blco Two (2) said.Addition , also of part of Lot Seventeen, County Court Plat of the North-west Quarter of Section Fifteen (15), in Township Sixteen (16) North Range Thirty (30) West, abutting upon East Spring Street, direct Ing said Owners to construct such curbs within 30 days from the date of the service of said notice upon said owners or their agents. Section Two; That in case any of said owners reftse or fail to comply with the requirement set forth in Section One hereof, the City of Fayetteville may contract with some suitable personto construct said curbs after first having given ten days notice of their intention to do so, and the cost thereof together with 6 penalty shall be charged against said owners and shall constitute a lienagainst said property under the provisions of Section 77489 Crawford & Moses Digest of the Statutes of Arkansas Section Three;That this resolution shall take effect and be in force drom and after its passage and approval. Pdilson, Mayor. � a�ddL Aderman Harding moved that the expense of paving in front of the City Hospital Pro- perty be paid out of the Permanent Street Fund, Alderman Watson secomded the motion, which recieved the unanimoue vote of the Members present, and was declared passed by the Mayor, On motion by Alderman Harding, seconded by Alderman Watson, and passed by the unanimous vote of the membbrs present and so declared by the Mayor, Alderman Drake, as Chairman of the Finance Committee was authorized to effect a settlement witl� the First National Bank for all City warrants now outstanding .
