REGULAR MEETING OF THE CITY COUNCIL
HELD MARCH 22nd, 1926.
PRESENT:
the Clerk; Aldermen Drake, Mintun, Phillips, Price; absent the Mayor and Aldermen
Harding and Wages. Alderman Phillips was duly elected'President pro tempore.
MINUTES:
The minutes of the meetings of March 8th, 9th and 15th were read add approved.
' REPORT:
The financial report of the City Clerk for the month of February, 1926 was pre-
sented and filed.
RESIGNATION:
The resignation of W.V.Cochran as member of the Board of Improvement for
Water Improvement District Number Two was presented, and on motion by Alderman Price,
' seconded by Alderman Drake was accepted.
MRS. WILLIAM RREP:
Alderman Drake introduced a resolution and moved its adoption, which
motion was seconded by Alderman Price and received the following vote; ayes; Aldermen
Drake, Mintun, Phillips, Price; nays none; absent and not voting Aldermen Harding and
Wages, and was declared passed by the President pro tempore.

WHEREAS, there exists a vacancy in the.membership of the Board of Improvement for Water
Improvement District Number Two, of the City of Fayetteville, Arkansas, by reason of the
resignation of W.V.Cochran therefrom, which resignation has this day been duly presented
and accepted,
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF.FAYEETEVILLE,
ARKANSAS:
That Mrs. William Reep, a qualified elector of the City of Fayetteville,
Arkansas, be, and she
is hereby
appointed
as a
member od
said Board of
Improvement
for

said Water Improvement
District
Number Two
of
the City of
Fayetteville,
Arkansas.
And
that all resolutions in conflict herewith be, and the same are hereby, repealed, and this
resolution shall take effect and be in force from and after its passage and approval.

FALLIN-GRAUE SIDE'"BALK:
The Committee appointed to view and report concerning the condition
of the sidewalk at the properties of C.A.Fallin and Mr. Graue reported that the grading
for the pavement of the Street had rendered the said properties inaccessable from the
street; that said walk had been orriginally laid according to the grade then established
by the City, and that the said owners were entitled to relief. Alderman Drake moved that
the City Engineer be authorized and directed to enter into a contract for the lowering
of the said walks to the proper grades, the work to be done at the expense of the City.
Alderman Mintun seconded the motion which received the following vote; ayes Aldermen
Dralb, Mintun, Phillips, Price; nays none; absent and not voting Aldermen Harding and
Wages and was declared passed by the President pro tempore.
STREET GRADES IN ROSE HILL:
On motion by Alderman Price, seconded by Alderman Drake and
passed by the unanimous vote of the members present the City Engineer was directed to
establish the street grades in Water Improvement District Number Two of the City of
Fayetteville in which ,"later Mains were to be laid.
SIDEI'IALK GRADES, NuRTH COLLEGE:
On motion by Alderman Price, seconded by Alderman Drake and
duly passed, the City Engineer was directed to establish grades for sidewlks on the West
side of North College 'l venue for one Block North from Davidson Avenue.

JACK HIGHT:
The Committee appointed to investigate the matter of a driveway in the the
property of Jack Hight on South College Avenue reported favorably, and on motion by
Alderman Price, seconded by Alderman Mintun and duly passed, permission was granted
for the construction of said driveway, under the supervision of the City Engineer,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF•FAYETTEVILLE, ARKANSAS: '
That P.R.Green, W.L.Crouch and R.L.Vaughan, three qualified electors of the City of
Fayetteville, Arkansas, be and they are hereby appoitted to constitute a Board of
Assessment of the benefits to be received by each Lot, Block or PX#l other sub-
division of land within Water Improvement District,Number Three of the City of Fayett
eville, Arkansas, by reason of the proposed improvement.

Alderman Price introduced the following resolution and moved its adoption. Alderman
Drake seconded the motion which received the following vote; ayes Aldermen Drake,
Minbun, Phillips, Price; nays none; absent and not voting Aldermen Harding and Wages '
and was declared passed by the President pro tempore, and the resolution adopted.

1' WHEREAS,
at a meeting of,X the City Council of hthe City of Fayetteville, Arkansas,
held on the 11th day of January, 1926 there was presented to said City Council by
J.A.Peterson, J. Ewing and W.V.Cochran as the Board of Improvement for Water Improve-
ment District Number Two of the City of Fayetteville, Arkansas, their report, together
with the plans of the work to be done in the construction of the improvement contempla
ted by said Improvement District, and the said report having been read in open meeting
of said Council, and said plans having been exhibited to said Council, and to each
member thereof, with a full and complete explanation of all the details thereof, and
it appearing from said plans, that the estimated cost of the construction if said
improvement, exclusive of interest charges, and inclusive of contingencies, is the '
sum of $6,340,87, and the said Council being satisfied that said plans will best sub -
serve the purposes of said Improvement District, and that the same are correct;
NOW, THEREFORE, BE TI RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARK'•,
ANSAS:
SEDTION ONE: That said plans, and said report, be, and the dame are hereby approved ,
and adopted,and that said improvement be constructed according to said plans, and at
a cost not to exceed, exclusive of interest charges, and inclusive of contingencied,
the sum of $6.340.87.
Section Two; That all resolutions and parts of resolutions in conflict herewith be,
and the same are hereby, repealed, and this resolution shhll take effect and be in

Alderman Drake introduced the following Ordinance which was read the first time.
Alderman Price moved that the Rules be suspended and the Ordinance Placed on its
second reading. This motion was seconded by Alderman Mintun and recieved the follow-

PROPERTY WITHIN WATER IMPROVEMENT DISTRICT NUMBER TWO OF THE CITY OF FAYETTEVILLE,
ARKANSAS"2
WHEREAS,
The majority in value of the property holders owning property adjoining the
locality to be affected, and situated in Water Improvement District Number Two ofpf
the City of Fayetteville, Arknsas, organized for the purpose of constructing and
maintaining an adequate Water System for the benefit of tXfl property owners
within said District, have petitioned the City Council of the City of Fayetteville,
Arkansas,for the construction of said improvement, and that the cost thereof shall
be charged and assessed against the real property within said District, according to
the benefits to be received; and
WHEREAS, said benefit received by each lot, block or parcel of real property situated
within said District, equals or exceeds the local assessment, and
WHEREAS: the estimatod cost od said improvement is the sum of $6,340.81;
NOVI, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, A^KANSAS
SECTION ONE:
That said several lots, blocks and parcels of real property within said
District,be assessed acording to the assessment list for said Improvement District,
as the same now remains in the office of the Recorder or City Clerk; and that ten
ner centum on said lots, blocks and parcels shall be paid annually on or before
the first Monday in November, until the whole of said local assessment shall be
paid.
SECTION TI.q10: That all ordinances or parts of ordinances in conflict herewith be,y1
and the same are hereby repealed, and this ordinance shall take effect and be in
force from and after its passage, approval and publication,

v WHEREAS;
a petiit ion, claiming to represent the majority value of the owners of
real property on South College Avenue from the South l of East Rock Street to
the South line of Jennings Addition to the City of Fayetteville, Arkansas, was
duly filed with the City Council of the City of Fayetteville, Arkansas, on the
8th day of Febryary, 1926, asking that said property be O&lA01 created into
an Improvement District, to be known as Annex Number One to South College Avenue
Improvement Distroct Number One of the City of Fayetteville, Arkansas;
WHEREAS:
on the 15th day of February, 1926, the said City Council of the said City yS
of the said City of Fayetteville, Arkansas, duly passed a resolution, directing the
City Clerk of the City of Fayetteville, Arkansas,to give notice by publication for
two weeks, in some newspaper published and having a general cir uulation in the
City of Fayetteville, Washington County, Arkansas, that such petition had been
filed, and that it would be considered at a meeting of the City Council of the CX'P
said City of Fayetteville, Arkansas, on March 8th, 1926, at 700 P.M.;
WHEREAS:
said City Clerk did so give such notice, in the manner provided by law;
WHEREAS:
on the said 8th day of March, 1926,the said City Council continued said
hearing until March 15th, 1926; and
WHEREAS:
on said March 15th, 1926 said City Council failed to hold a meeting, and it
is necessary to fix a new date for said hearing;
NOW, THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS:
SECTION ONE:
That the City Clerk of the 6ity of Fayetteville, Arkansas, be, and he is
hereby, ordered and directed to give noticeby publication for two weeks, in some news
paper having a general circulation in the City of Fayetteville, l'lashimgton County, Ark-
ansas, that such petition has been filed,and that it will be considered at a meeting of
the City Council of said City of Fayetteville, Arkansas,which will be held in the Mayor's
Officeon Monday April 12th, 1926. at 7;30 P.M., and that all property owners within said
Improvement District may appear before said City Council on said date, and show cause for
or against such annexation.
SECTION TWO:
All resolutions and parts of resolutions in conflict herewith be, and the same
are hereby, repealed and this resolution shall.take effect and be in force from amd after
its passage and approval.
