REGULAR MEETING OF THET CITY COUNCIL
HELD MARCH 8th, 1926.
PRESENT:
The Mayor, Clerk; tildermen Drake, Mintun, Phillips, Price; absent Aldermen Hard-
ing and Wages.
MINUTES:
The minutes of the three previous meetings were read and approved.
' BILLS:
The accounts of the Street Cleaners, Jim mitchell X18.00; and Ahdrew Munds 424.00
together with the bills listed below, havinfg been approved by the Auditing Committee,
were allowed and the Clerk was directed t6 issue warrants for the same;
Heerwagen Bros. Co. $15.15 and 17.01; Read's $3.75;Abshier-Bryan Motor Co. x;41.60;
' G.E.Norwood $24.95; Southwest Bell Tel. Co. $29.50;Fayettevile, Democrat •.61.92; J.W.
Shelley 4.10.50;James Dinwiddie ?33.00;Fayettevile Republic $14.50;Snow Bird Coal Co.

REPORTS:
The morthly reports of the Fire Chief, The Police Judge, The City Collector and
The City Purchasing Agent were presented, covering the month of February, and on motion
were ordered received and filed.
PERMITS
Jack Hight applied for permission to build a driveway on South College Avenue
into his property thereon, which application was/ referred to the Street Committee and
the City Engineer.
A.M.STICE applied for permission to cut pavement on North College Avenue, which was
referred to the City Engineer and the Mayor, with power to act.
SIDE'JALK GRADE:
' Dr. Hotz requested that grade for sidewalk be established at his property
on Ozark Avenue; On motion the City Engineer was directed t6 establish the required
grade alongthe block.
HARING IN ANNEX TO SOUTH COLLEGE AVENUE:
Because of lack of sufficient data the Council was unable to determine as to the
majority in said Annex and on motion by Alderman Price, seconded by Alderman Mintun and
passed by the following vote; Ayes Aldermen Drake, Mintun, Phillips. Price; nays None;
absent and not voting Aldermen Harding and Wages, and so declared by the Mayor, the said
hearing was continued to March 15th, 1826. at 7;30 P.M.
14ARGPeStV Heerwagen was granted a permit to drive a car on the streets of Fayetteville.
ROAD PETITION:
A petition for a Road from North College Avenue to North Leverett Avenue
was presented and referred to the Street Committee for report.
CARNIVAL:
I
The Local Post American Legion applied for the privilege of bringing a Carnival
Company to the City for one week, free from the license. On motion by Alderman Price,
duly seconded and passed, the request was granted.
DUNCAN STREET LIGHT:
A request for a street light on Duncan Street was denied because of
lack of funds.
SOUNDING THE SIREN:
Alderman Price introduced the following resolution and moved its ad-
option, This motion was seconded by Alderman Drake, and received the following vote;
ayes Aldermen Drake, ihintun, Phillips, Price; nays none; absent and not voting Aldermen
Harding and Wages, and was declared passed by the Mayor.

A RESOLUTION TO BE ENTITLED " A RESOLUTION TO REGULATE THE BLOWING OF THE SIREN".
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLEt ARKANSAS:
SECTION ONE: That the Fire Siren be sounded only upon the request of the officersop?

of the Fayetteville Fire Department when in their opinion a fire is of a dangerous and
serious nature and the aid of the general public is needed,
SECTION TWO:
That the Chief of the Fite Department id hereby directed to inform the Tel-
ephons Company and the Southwest Power Company of the passage of this resolution and
to make the necessary arrangements for sounding the Siren as provided in Section One of
this resolution,
S-CTION THREE:
That this resolution be in force from and after its passage and approval,
and all -resolution or pal,ts thereof in conflict hereqith be and the same are hereby re-
pealed.

was read the first time. Alderman Phillips moved that the Pules be suspended and the ord
inance palced on its senond reading, This motion was seconded by Alderman Mintun and rec
eived the following vote; ayes Aldermen Drake, Mintun , Phillips, Price; nays none; ab-
sent and not voting Aldermen Harding and Wages; and was declared passed by the Mayor,
The ordinance was read the second time,
Alderman Price then moved that the Rules be further suspended and the ordinance placed
on its third reading and final passage. This motion was seconded by 'alderman Drake and
received the Bollowinf vote; ayes Aldermen Drake; Mintun, Phillips, Price; nays none; ab
sent and not voting Aldermen Harding and Wages; and was declared passed by the Mayor.
The Ordinance was read the third time,
The Mayor then announced the question before theACouncil to be Shall the Ordinance pass,

AN ORDINANCE TO BE ENTITLED." AN ORDINANCE TO LEVY THE ASSESSMiENT UPON THE REAL PROPERTY
WITHIN ANNEX NUMBER ONE TO NORTH COLLEGE AVEINE IMPROVEMENT DISTRICT PUMBER ONE OF THE
CITY OF FAYETTEVILLE, ARKANSAS,"
WHEREAS,
The majority m$ property holders owning real property adjoining the locality to
be agfected, and situated in Annex Number One to North College Avenue Improvement Dis-
trict Number One of the City of Fayetteville, Arkansas organized for the purppse of
grading, rolling and paving with concrete pavement East Spring Street from the East
line of North College avenue to the East Line of Willow Avenue, in the City of Fayette-
ville, Arkansas, have petitioned the City Council of the City of Fayetteville, Arkansas
for the construction of said improvement, and that the cost thereof be assessed and charg
ed against the real property within said District, according to the benefits to be receiv
ed, and
WHEREAS;
The benefits received by each Lot, block or parcel of land situated within said
District equals or exceeds the local assessent tiWAZ f/ and
WHEREAS,
The estimated cost of said improvement is $8,014.43;
NO'W, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION ONE:
That said several Lots Blocks or parcels of land within sai Annex number One
to North College Avenue Improvement District number One of the City of Fayetteville, Ark -

remains in the office of the Recorder or City Clerk of said City ofFayetteville, Arkansas
and that ten per centum ( or such part thereof as shall be sufficient to pay such debts
or obligations of said District as shall mature each year, together with t\e accrued
interest thereon) on said Lots, Blocks or parcels of real property shall be paid annually
on or before the first Monday of November in each year, beginning with the year 1926,
until the whole of the indebtedness of said District shall have been paid.
SECTION TWO:
That all Ordinances or parts of Ordinances in conflict herewith be, and the SRI
same are hereby repealed, and this Ordinance shhll be in force and take effect from and pI
after its passage, approval and publication.

At the request of Cu).'F.Davidson, for a statement of the approximate amount of assist -
ante to re expected from the City in furtherance of the proposed extension of pavement
on North College Avenue to the City Limits, Alderman Drake moved that the Mayor appoint
a committee to investigate the City finances in regard t.: the matter, to interview the
Commissioners of Road District No. 2. and the County Judge as to securing aid from the
said District and from the County, and to report at the earliest poasible time. Alderman

The Mayor appointed as such committee Aldermen Drake, Phillips and Mintun.
Alderman Phillips moved that, in response to the offer of Mr. A B. Stane to donate land
for a street leading from Wall Street to Stone Street, The City Engineer be directed to DRi
make the necessary surveys. Alderman Mintun seconded the motion which was passed by the un
animous vote of the members present.
In response to the appeal of Mr. Fallin on his own behalf and others for relief
in the matter of the sidewalk grade on the south side of Rock Street near College Avenue
the Street Committee was directed by motion to view the situation and report.
Alderman Drake reported the payment of Warrant No. 10163, for $763.00, for Fire
hose from the funds of the City Funding Account, at a discount of about $40.00.

Alderman Mintun introduced the following resolution and moved its adoption. This motion
was seconded by Alderman Price,and received the following vote; ayes Aldermen Drake,

WHEREAS,
REEROVAL OF PLANS,
at a meeting of the City Council of the City of Fayetteville, Arkansas, held on
the 8th day of March, 1926 there was presented to said City Council, by Tom Taylor, ALL.
Trent and J.P.Harter as the Board of Improvement of Water Improvement District Number
Three,of the City of Fayetteville, Arkansas, their report together with the plans and
specifications of the wook to be done In the construction of the improvement contemplated
in said. Improvement District, and the said report having been read in open meeting of
said Council, and said plans and specifications having been,exhibited to said Council,
and to each member thereof,with a full and complete explanation of all the details thereof
of the construction
and it appearing from said plans and specifications that the estimated cost/of said im-
provement , exclusive of interest charges, but inclusive of contingencies, is the sum of
1,112,000.00, and the said Council being satisfied that said plans will best subserve the
purpose of said improvement District, and that the same are correct;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS.

SECTION ONE,
That said plans and said specifications, and said report, be, and the same are
hereby approved and adopted, and that said improvement be constructed according to said
plans and specifications, and at a cost not to exceed, exclusive of interest charges, Jd7d
and inclusive of contingencies, the sum of $12,000.00.
SECTION TWO:
That all resolutions and parts of resolutions in conflict herewith be, and t
the same are hereby repealed, and this resolution shall take effect and be in force from
and after its passage and approval.

Alderman Price introduced an ordinance providing for licensing certaing
privileges, which was read the first time.
Alderman Phillips moved that the Rules be suspended and the ordinance placed on its
second reading. Alderman Price seconded the motion which reci&ved the following vote; ayes
Aldermen Drake, Mintun, Phillips, Price; nays none; absent and not voting Aldermen Harding
and Wages; a d was declared passed by the Mayor. The Ordinance was read he second time.
After discussion Aldrman Mintun moved that the Rules be fmrther-suspended and the Ordinance
placed on its third reading and final passage. This motion was seconded bt AldermanPrice
and received the following vote; ayes Aldermen Drake Mintun, Price; nays Alderman Phillips;
absent and npt voting Aldermen Harding and wages. The Mayor declared the motion passed.
The Ordinance was read the third time.
The Mayor then announced that the question before the Council was Shall the Ordinance V

as Improvement District s�51 of the City of Fayetteville, Arkansas was presented and read
to the council; whereupon Alderman Price moved that the same be received, filed and spread
of record. This motinn was seconded by Alderman Mintun and received the following vote;
ayes Aldermen Drake, Mintun, Phillips, Price- nays none; absent and not voting,Alde.rmen
Harding and Wages, and was declared passed by the Mayor. A copy is a s follows;

MINUTES:
The reading of the minutes was deferred by order of the Mayor.
LICENSE ORDINANCE:
The Mayor announced that the Ordinance providing for the licens&ng of certain
privileges, which was considered at the previous meeting, being of a permanent and
general nature had failed of passage, by reason of its failure to secure the votes
of the necessary 2/3 majority.
BILLS:
The following bills having received the approval of the Auditing Committee were
ordered paid and the Clerk was directed to issue warrants for the same;on mbtion duly
it made,secodded and passed, and so declared by the Mayor.
Fayetteville Printing Co. $10.25;Southwest Power Co. $391.25; Same $4.25; W.G.Ownbey Drug
Co. •x„5.40;Fayetteville, Democrat 48.16; John Zillah $22.50;
GRADE FOR ALLEY:
At the request of J.F.Moore it was ordered that the City Engineer es-
tablish the grade of the Alley running North-South in Block 13 Original Town.
The lity Engineer was requested to confer with the Building Inspector in regard
to certain proposed building and Zoning Ordinances.
IMPROVEMENT DISTRICT N0.31.
Alderman Phillips introduced an ordinance providing for the formation of
an improvement District which was read the first time. Alderman Price moved that the
Rules be suspended and the Ordinance palced on its second reading. This motion was
seconded by Aldrman Phillips and received the following vote; ayes Aldermen Drake,
Mintun, Phillips, Prdce; nays none, absant and not votin Aldermen Harding and Wages,
and was declared passed by the Mayor. The OrdinanceX was read the second time.
