PRESENT: The Mayor, Clerk; Aldermen Drake, Harding, Phillips, Price, Wages; absent Alderman Mintun. MINUTES: the Minutes of the Previous meeting werse read and approved. BILLS: The accounts of the Street Clean6rs, Jim Mitchell, $18.00; and Andrew Munds, $24.00; and the following bills, which had been approved by the Auditing Committee were allowed and ordered pai ' and the Clerk was dorected to issue Warrants for the same on.motion by Alderman Phillips, seconded by Aldrman Drake and passed by the unanimous vote of the members present, and so declared by the Mayor; Gardner's Office Supply Co. $36.44; John Zillah, $172.50; Dr. A.S4Gregg $3.90; Dr Harrison Hale $4.00; Dr. W.L.Bleeker $28.00. IMPROVEMENT DISTRICT COLLECTIONS: Alderman Price moved that the City Attorney and the City Collecto be appointed as a committee to investigate on the feasibility of re-aranging the dates of the col- lection of the assessments in the various Improvement Districts so as to avoid a long delay between the collection of said funds and the disbursement of the same. Rhis motion was seconded by Alder- man Harding and received the following vote; ayes Aldrmen Drakerp Hard7hng, Phillips, Price Wages; nays none. absent and not voting Ald:�rman Mintun; and was declared passed by the Major. CAMPBELL STREET: The City Engineer reported that the records in the Office of the Circuit Clerk show that Campbell Street is 23 feet wide, and exrends from Dickson to Lafayett. Alderman Harding moved that the report be received, approved, filed and spread of record. This motion was seconded by Alderman Price and received the following vote; ayes '.ldermen Drake, harding Phillips, Price, Wages; nays None, absent and not voting Ald rman Mintyn and was declared passed by the Mayor. Report; Fayetteville, Arkansas ' December 21st, 1925. Mayor and City Council, Fayetteville, rlamsas. Gentlemen; In compliance with your request I have investigated the matter of Campbell St. and find the width to be Twenty-three (23) feet. This width is shown on the Official County Court Plat as filed in the Office of the Circuit Clerk. This Street as shown by the Plat extends from Dickson Street to West Lafayett. Respectfully submitted, E.I�l Ratliff. A communication from C.F.Armistead, City Collector was read to the Counc il, reporting the action of the Board of Managers of the Water Plant providing for the depositing of the funds of the Water Plant with the City Depository, DYKE LUMBER CO.; Application of said Company forpermission to cut pavement for sewer connection was referred to the City Engineer for report. CHURCH STREET PAVEMENT: The plans for the Church Street Pavement from West Mountain to Rock Street were presented to the Council and on motion by Alderman Harding, seconded by Alderman Price were approved. BUDGET, for 1926. The committee in charge of the matter of preparing a Budget for 1926, for the City expenses 12 submitted its report. Alderman Harding moved that the repobt bad the proposed plan of putting it into operation be approved. This motion was seconded by Alderman Phillips and received the following vote, ayes Aldermen Drake, Harding, Phillips, Price, Wages; nays none; absent and not voting Alderman Mintun, and was declared passed by the Mayor. WATER IMPROVEMENT DISTRICT NO 2. The time for the hearing on the second petition for the formation ¢f of Water Improvement Dostrict Number 2 having arrived, the Council carefully investigated the report 1122 of the totAl Assessments in said. District and the assessments of those 1vho had signed said petition, whereupon Alderman Harding introduced the following resolution and moved its ad- option; this motion wqs seconded by Alderman Price and received the following vote; ayes Aldermen Drake, Harding, Phillips, Peice, Wages, nays none; absent and not voting Alderman` Mintun and was declared passed by the Mayor. SECTION ONE: That,.after careful.' consideration, the City Council of the City of Fayettevil Arkansas,.finds.that there is a total assessed valuation of $19,665.00, of real property within said District, according to the last assessment on file in the office of the County Clerk of Washington County, Arkansas,and that persons signing said petition own property within said Dsirtict of the assessed valuation of $11,475.00 according to said assessment. SECTION TWO; That it is the finding of the said City Council of said C6ty of Fayetteville, Arkansas, that the majority in assessed valuation of owners of real property within Water Improvement District Number Two of the City of Fayetteville, Arkansas, have signed said petition; and that said District is hereby formed by said City Council of said Coty of Fay etteville, Arkansas . SECTION THREE: In consideration of said petition the City Council has been guided by the certificate of the Circuit Clerk of said County as to the ownership of said real property, and by the certificate of the County Clerk of said County as to the assessed valuation of said.real property. SECTION FOUR; That all resolutions or parts of resolytions in conflict herewith be, and the same are hereby, repealed, and this resolution shall be in force and effect from and after its passage and approval. J. Ewing and W.V.Cochran, three owners of real property within the limits of Water Improvement District Number Two, of the City of Fayetteville, Arkansas,be, and they are hereby, appointed as the Board of Improvement for said District. WHEREAS, on the 14th day of December, 1925 there was duly filed with the City Council of the City of Fayetteville, Arkansas, a petition purporting to contain the signatures of a major- ity in value of the owners of real property situated within Watre Improvement District Num- ber Three of the City of Fayetteville, Arkansas; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE: That a hearing of said petition to determine whether those persons who have signed said petition constitute a majority in value of the owners of real property situated within said Improvement District will be held by said City Council at the Mayors Office in said City of Fayetteville, Arkansas on the 11th day of January, 1926, beginning at 7;30 P.M. of said Day. ORDINANCE: Alderman Price introduced an Ordinance which was read the first time, whereupon ' Alderman Harding moved that. the Rules be suspended and the Ordiaance placed on its second reading. This motion was seconded by Aderman Drake ansd received the following vote; ayes Aldermen Drake, Hardimg , Phillips, Price, Wages; nays none; absent and not voting Alderman Mintum and was declared passed by the Mayor. The Ordina nce was read the second time; Alderman Phillips moved thst the Rules be further suspended and the Ordinance placed on its third reading and final passage. This motion was seconded by Alderman Price and received the following vote; ayes Ald-rmen Drake, Harding, Phillips, Price, Wages; nays none; absent and not voting Alderman Mintun. and was declared passed by the Mayor. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE: That the Mayor and the City Clerk of the City of Fayetteville, Arkansas, be and and they are hereby authorized and directed to issue warrants for the payment of one thousand , feet of fire hose bought from the United States Rubber Company, Eureka Fire Hose Department of New Jersey, on the 15th day of January, 1925 amounting to the sum of Fifteen hundred and Twenty-six Dollars (1526.00). SECTION TWO:4 That said Warrants shall be issued in accordance with the terms of a certain wri tten contract entered into on the 15th day of January, 1925 by and between the said United States Rubber Company, Eureka Fire Hose Department, of New Jersey., and the City of Fayette- ville, Arkansas,•through its duly constituted Board of Public Affairs. This motion was seconded by Alderman Drake and received the following vote; ayes Aldermen Drake Phillip , Price, Wages,; nays none; absent and not voting Alderman Mintun and was declared passed by the Mayor. The Ordinance wast read the second time. Alderman Drake then moved that Section Six (6), known a#/ as the Emergency Clause, be read. This motion was duly seconded by Alderman Phillips and received the following vote; ayes Aldermen Drake, Harding, Phillips, Price, Wages; nays none; absent and not voting Ald- erman Mintun, and was declared passed by the Mayor. AN ORDINANCE FIXING THE TIME FOR THE FILING OF REFERENDUII PETITIO14B PROVIDED FOR BY AMhNDhMNT N0. 13 TO THE CUNSTITUTUIN OF THE STATE OF rRKANSAS, AND FOR REGULATING THE PROCEDURE THEREON. BE IT ORDAINED BY THE CITY COUNDIL OF THE CITY OF FAYETTEVULLE: Section 1. All referendum petitions under Amendment No. 13 to teh Constitutdon of the State of•Arkansas, appearing on pages 481 to 489, inclusive, of the General Acts of the Genernl Assembly of the State of Arkansas of the year 1919, must be filed with the City Clerk within thirty days after the passage of such ordinance. Section 2. Whenever any referendum petition is filed the City Council shall give notice by publication for one insertion in a newspaper published =n this city of a time not less then five days after the publi- cation of such notice at which they will hear all persons who wish to i,e heard on the question whether such petition issigned by the requisite number of petitioners. At the time named the City Council shall meet and hear all who wish to be heard on the question, and its decision shall be final, inless suit is brought in the chancery cou t of Washington County within thirty days to review its action. Section 3. If the City Council finds that such petition is signed by the requisite number of petitioners, it shall"order a special Alection to determine by a vote of the qualified electors whether theordinance shall stand or be revoked. The date for such election shall be not less than ten days after the order therefor has been made by the Council, and said election shall be had and conducted as general municipal elections held in the City of Fayetteville. Section 4. If any ordinance referred to the people is defeated at the polls, the city council shall make note of such fact and shall expunge such ordinance from its files by erasing the same with red ink. ' Section 5. If any provision of this ordinance is held to be void, it shall not affect the validity of the remainder, bi.rt the remainder shall stand. Section 6. It is hereby ascettained and declared that by reason of the heavy indebtedness hanging over the City ofnFayetteville and accruing prior to the adoption of Amendment No. 11 to the Constitution of the. State of Arkansas, the said City is unable to procure or maintain proper facilitied for the extinction of fires, proper police protection of proper safeguards for the public health, and therefore in order that there may be a prompt referendum on any ordinances necessary for the protection oflthe public peace, health and safeth, it iw declared that an ememgenoy exists, making it necessarjr that this ordinance should take effect immediately for the preservation of the public peace, health and s afety, and this ordinance shall take ef- feet and be in force from and after its passage. Alderman Drake introduced an Ordinance providing for the issuing of Funding bonds by the City of Fgyetteville, Arkansas, which was read the first time. Alderman Price moved that the Rules be suspended and the Ordinance placed on its second reading; Alderman Drake seconded this motion lwhich received the following vote; ayes 'ldermen Harding, Drake,/Phillips, Price, Wages; nays none; absent and not voting Alderman Mintun, and w as declared passed by the Mayor. Alderman Harding moved that the Rules be fuhPher suspended and that Section Six of the Ordinance, known as the Emergency Clause,, be read. This motion was duly seconded by Alderman Harding Wages and received the following vote; ayes Aldermen Drake,/Phillips, Price, Wages; nays none absent and not voting Alderman Mintun, and was declared passed by the Mayor. ' Fayetteville hereby covenants that it is a City of the First Class of the State of Arkan- sas, and that in the issuing of this bond it has proceeded in accordance with the provi- sions of said Amendment No. 11 and in accordance with the laws of the State of Arkansas, including the provisions of Act No. 210 of the Acts of the General Assembly of the State of Arkahsas for the year 1925, entitled " An Act to facilitate the funding of the debts of Counties, Cities and Incorporated Towns,"approved March 23, 1925, and under Ordinances of the City Council of the City of Fayetteville and resolutions of its Board of Public Affairs duly adopted;that said sum of $76,000 was justly due and owing by the said City of Fayette- ville on the date of the adoption of said amendment, and was still due and owling when this bond was issued, and that all things necessary to the validity of this bond under the laws f of the State of Arkansas, and particularly under the said Amendment to the Constitution and the said Act, have been done, have happened and have been performed as required by law; and that a Tax sufficient to pay the bonds aforesaid has been levied in accordance with the er ' provisions of said constitutional amendment and Act,and payable annually until the last ov said bonds been fully paid and discharged. For the prompt payment of this bond and the interest thereon, the said City of Fayetteville hereby pledges its full faith, credit and taxing power, including the three mill additional tax authorized by said'Amendment No, 11 to the Constitution and applicable solely to the payment of this bond and the other bonds issued to pay indebtedness outstanding at the time of adoption of the amendment. FREE AUTO LICENSE: On motion by Alderman Price seconded by Alderman Harding and passed by the ' unanimous vote of the Council the mayor was authorized to furnish the City Collector with a list of City Officiald, elected and appointed to whom free Auto License shluld be granted. CITY STREET TAX: On motion by Alderman Price, seconded by Alderman Drake the City Collector was authorized to devise ways and means for the more efficient and systematic collection of Street Tax due the City under the State laws. A communication from John Carlisle was read to the Council, but no action wasrtaken. r FIRE BENEFIT: Alderman Price moved that the Fire Department be granted the privilege of putting on a benefit Show, free from the City Tax thereon.Alderman Mintun seconded the motion which received the unanimous vote of the Council.
