REGULAR MEETING OF THE CITY COUNCIL
HELD DECEMBER 14th, 1925.
PRESENT: The Mayor,Clerk, Alderipen Drake, Harding, Mintun, Phillips, Price, Wages.
MINUTES of the Precious meeting were read and approved.
BILLS: The following bills against the City were presented with the approval of the Auditing
Committee endorsed thereon, and together with the accounts of the Street Cleaners, were allowed
ordered paid and the Clerk was directed to issue warrants for the same, mn.motion made by Ald-
erman Harding, seconded by Alderman 'Plages and passed by the unanimous vote of the Council, and
so dec;ared by the Mayor; Jim mitchell Street cleaning, $18.00; Andrew Munds, do. $24.00 ;

• WATER IMPROVEMENTDISTRICTIRITN The s and petition for the formation of Water Improvement
District was p esente d es on motion by Alderman Harding seconded by Alderman Drake that
the same be received, filed and spread of record, was so ordered, the vote for the motion being;
ayes�Aldermen Drake, Harding, Mintun, Phillips, Price, Wages; nays none; absent and not voting
none, and so declared by the Mayor. A copy is as follows; -
"To the Mayor and City Council,
City of Fayetteville, Arkansas;The undersigned, your petitioners would respectfully represent
and show that a petition signed by more than ten property owners in the City of Fayetteville,
Arkansas,and within the territory described within said petit ion was presented to your Honorab
Body on the 19th day of October, 1925 praying that your body take all -necessary steps and pass
all necessary Ordinances, Resolutions or Orders for the creation of an Improvement District
embraced in the territory described in said petition for the purpose of constructing and
maintaining an adequate water system for the benefit of the property owners within the terri-
tory hereinafter described-- said District to be bounded as follows, to -wit;

That your Honorable Body passed an Ordinance Numbered g$gl 580 laying off the territory
described within said Petition and herein after set forth, which Ordinance was duly passed
on the 3rd day of November, 1925.
That said Ordinance was duly published in the Fayetteville, Demicrat'within twenty days
' fifter ita passage under the hand of the City Clerk of the said City of Fayetteville, Arkansas.
Wherefore, the undersigned claiming to be a majority in value of the owners of real pro-
perty within said Improvement District Number Three of the City of Fayetteville, Arkansas,
and described within said Petition and Ordinance herein set forth,pray that such improvement be
undertaken and that the cost thereof be charged and assessed against the real property situated
within such district and that the district be for the purpose of carrying out the improvement
herein set forth. And said Petitioners ask that said improvement shall not exceed in cost
fobty per cent (40%) of the value of the property within said District, which District is
to be bounded as follows, to -wit; -

Alderman Rrice moved that the hearing on the second petition for the formation of City
Park Improvement Districts be continued to December 21st, 1925, This Motion was duly
seconded by Alderman Harding and received the following vote; ayes Aldermen Drake,
Harding, Mimtun Phillips, Price, Wages; nays none; absent and not voting none and was
declared passed by the Mayor.
A communication in reference to payment for Fire Hose was referred to the City Atty.
E.M,RATLIFF City Engineer filed his report as to theproposed pavement of North C611ege
Avenue to the City Limits, whi hh on motion was ordered received and filed.
A communication from the Sewer Commissioners was read to the Council and on motion by
Alderman Harding seconded by Alderman Price and duly passed was ordered received and filed.
Alderman Harding moved that the Commissioners of the Sewer District be authorized to
negotiate with the Frisco Railway for a lease of.a portion of the Right -of -Way through
the Cut for laying a sewer main through the same. Alderman Price seconded the motion
which received the following vote; ayes Aldermen Drake, Harding Mintun, Phillips
Price Wages; nays none; absent and not voting none and was declared passed by the Mayor.
At this time the Council went into Executive Session on motion duly made and passed.
4 communication from the "Board of Water Commissioners" reporting their action in the
matter of the p1rchase of additional equipment for the water plant was read to the Council..
Alderman Phillips introduced the following Resolution and moved its adoption. This
motion was seconded by Alderman Price and received the following vote; ayes'Aldermen
Drake, Harding, Mintun, Phil ips, Price, Wages; nays none; absent and not voting none
and was r1eclered passed by the Mayor. A copy is as follows;-

Be it resolved by the City Council of the City of Fayetteville, State of Ariansas, meeting
in regular session in said City on this the 14th day of December, 1925,that the contract
fo purchase of one 240 horse power Diesel engine and one twelve inchby 18 inch Ocp pover
pumpwith fittings and equipmentf as per specifications therein set out, entered into by the
Board of Commissioners and the Board of Managers of Water Improvement.District Number One of
Fayetteville, Washington County, Arkansas,on the 14th day of December, 1925,together
with the resolution of said Board of Commmissioners and Board of Managers accepting t
the bid and proposal for the purchasing thereof from Fairbanks, Morse and Company,
of Chicago, Illinois, by and on behalf of the Water Improvement District Number One
of the City of Fayetteville, Arkansas,be and the same hereby is approved, and Allan
Wilson Mayor of the City of Fayetteville and C.W.Appleby, Secretary of the Board of
Commissioners of Water Improvement District Number One of the City of Fayetteville, are
hereby authorized, empowered and directed to make and execute said contract in the form
presented in said proposal by Fairbanks, Morse and Company, to sign notes for the defer
red payments, as set out in said proposal, to sign and execute a pledge for Water Im-
provement District Number Oneof the City of Fayetteville, Arkansas in accordance with
the terms and conditions of said proposal and contract, to deliver copies to the said
Fairbanks, Morse and Company and file copies and make true report of their actions
hereunder to the Board of Commissioners and to the Council of said City of Fayetteville
at their next regular meeting after the same shall have been done.
And whereas it is the purpose of the City of Fayetteville, Arkansas to make pro-
vissions for the payment of said obligations as they respectively mature.
Therefore be it resolved and ordained that, to pay the principal of the series of
warrants or notes issued or to be issued to the said Fairbanks, Morse and Company in
payment for said machinery and the installation of the same, as in said contract set
forth,there is hereby appropriated and set aside all sums of money received from the
operation of the Water Plant of Water Improvement District Number One of the City of
fayetteville over and above the operating expenses and said sums so received monthly pig
over and above tXX/operating expenses as aforesaid shall be applied monthly to the payor
ment of said Warrant or notes as the same mature, being 37 notes, each for the sum of
1,036.089 the first falling due October 1st, 1926, and one note on the first day of
each month thereafter for 37 months, until the whole sum. of $38,335.12 shall have been
paid; that the aforesaid warrants or notes are not a general obligation of the said
City of Fayetteville but are a special obligation confined to the net earnings of the.
Water Plant of said District Number One which are pledged for security for the payment
thereof; that said anticipater9 receipts from said sources are and will be sufficient
to make payment of the above debt and amount of said warrants as they respectively
mature.

A communication as to the use of a portion of Campbell Street for the enlaggement of
a Fillinf Station was referred to the City Engineer for report.
A request for an extension of the time for takinf down of the "Tabernacle" was granted
to January 15th, 1940
Application for permission to erect a pole for an Out -door Telephone West of "Tony's"
was referred to the City Engineer with power to act..
The matter of -the disposal of the walbe water from Vicker's Cleaning Establishment
was referred to the City Engineer for report.
No furtherer business appearing the Council adjourmed to December 21st, 1925
