HomeMy WebLinkAbout1925-11-30 Minutes1113 Regular meeting of the City Council held November, 30th, 1925. PRESENT: The Mayor, Clerk, Aldermen Drake, Harding,.Mintun;. Phillips, Pricw, Wages; absent None. MINUTES: ts110 the minutes ofX the/previous meetings were read and approved. BILLS: The following bills 9gainst the City having been approved by the Auditing Committee were allowed and ordered paid, and the Clerk was directed to issue warrants for the same, on motion made by Alderman Harding, seconded by Alde-man Price passed by the unanimous vote of the Council and so declared by the Mayor. BILLS• Jim Mitchell, $18.00; Andrew Munds,.$24.00; John Zillah $158.75, Wages Brothers Construction Co. 96.89; J.H.Phipps Lumber Co. 2.65; W.L.Crouch, 2.15; GRADES: The City Engineer was instructed to establish grades as follows; For sidewalk on Douglas between 4'lhittham to Leverett, on Whittham between Douglas and Taylor; For paving Alley'in Block 28 from College Avenue to the Alley running North-South. This action was taken on motion by Ald erman Harding, secmnded by Alderman Price passed by the unanimous vote of the Council and so declared by -the Mayor. REPORT: The report of the City Collector for the Month of November, 1925 was presented and on motion duly made and passed was ordered filed. EXTENSION OF TIME: The request of A.R.Kendrick for extension of the time for laying Gutter on School Street was denied. CITY ENGINEER was instructed to inform the Arkansas National Bank where and to what amount they ' would be allowed to get dirt to fill over their Oil Tank, in the alley North of their building. 7 NORTH COLLEGEAVENUE PROJECT: B.R. Davidson presented the proposal of the Citizens on North College Avenue for extending the paving North to the City limits; this matter was referred to the City Engineer for a report at his earliest convenience RESOLUTION: Alderman Harding introduced the following resolution and moved its adoption. This motion.was seconded by Alderman Price and received the follwoing vote; Ayes Aldermen Drake, Hardimg, Mintun, Phillips, Price, Wages; nays none absent and not voting none and was declared passed by the Mayor. WHEREAS: On the 19th day of October, 1925 there was filed.with the City Council of the City of Fayetteville, Arkansas, a petition purporting to contain a majority in value of the owners of ' real property within Watre Improve•ent District Number Two of the City of Fayetteville, Arkansas, WHEREAS: On the aforesaid date, at a regular meeting of the City Council of the City of Fayetteville, Arkansas, Alderman Harding moved that the City Clerk of said City be directed to cause to be published a notice that a hearing to determine.whether said petition did in fact contain such majority on the 2nd day of November, 1925, which said notice was so published; }UMEAS; ' At the meeting of said City Council held on the 2nd day of November, 1925, no data was provided whereby it would have been possible for said Council to so determine; WHEREAS: said City Council failed to provide by motion or otherwise for the continuation of said hearing; WHEREAS: On the 23rd day of November, at a regular meeting of said City Council a resolution was duly passed directing the City 6lerk to. cause to be published a notice that said petition had been so filed and that at a meetimg of the City Council to be held on the 7th day of December, 1925, said petition would be heard for the purpose.of determining whethersuch majority of said owners of real property in said Improvement District had signed the same; AND WHEREAS; it is now ascertained that said notice does not provide the full two weeks notice, as is required by the laws of the Htate of Arkansas in such case made and provided; Now, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: That the City Clerk of the City of Fayetteville, Arkansas be, and he is hereby directrd to cause to be published in some newspaper published,..and having a general circulation -in the City of Fayetteville, Arkansas, once a week for two.weeks, a notice stating that said petition has been so filed with said City Council, and that a.hearing will be had.on the same at a meet ing of said City Council, to be held on the 21st day of December, 1925, at 79.30 P.M. there of, in the office of the Mayor, at which meeting it will be determined whether such majority of said owners of real property within said water Improvement District Number !'wo ' have signed said petition.
