Present; The Mayor, Aldermen Drake, Harding, Mintun, Phillips, Price, Wages; absent, the Clerk. The Council was called to order by the Mayor, and on motion duly made -and passed, Alderman Harding was elected to be Clerk of the Meeting. ' The Mayor stated the purpose of the meeting to be the opening and consideration of the bids for the proposed issue of City Bonds, refunding the outstanding indebtedness of the City of Fay- etteville, at the time of the adoption of Amendment Number Eleven to the Constitution oftthe Stat of Arkansas, received in response to the following telegram sent to the "Southern Contractor". a weekly trade journal published at Memphis, Tenn44401Qy//7�J/7g?7 // "Fayetteville, Ark. Nov. 16th, 1925. Southern Contractor, Memphis, Tennessee, Run the following advertisement in the next issue. Bonds for sale. Fayetteville, Arkansas Funding bonds $73,000.00 5%, one to seventeen years. Bids received at 2;30 P.M., Nov 23rd, 1925. Council reserves right to reject any and all bids. Buyer to pay all expenses. Contract to be awarded on condition that transcript and bonds finally approved. N.F.Drake Chairman Finance Committee, Fayetteville, Arkansas Council." The bids received were from R.W.Hall, representing J.B.Tigert & Co. of Memphis, Tenn. and from Geo. B. Walton representing M.R4 Elkins & Co, of Little Rock, Arkansas. Alderman Price moved that the successful bidder be required to deposit a certified Check ' for $1,000.00,payment condmtioned upon the perBormance of the contract to be entered into. Alderman Drake seconded the motion which received the fiollowinf vote; ayes, Aldermen Drake, Harding, Mintun, Phillips, Price, Wages, and was declared passd by the Malyor. On motion duly made and passed the Council went into executive session. The matter before the Council having been fully discussed, and an agreement having been reached, Alderman Mintun moved that the Finance Committee be requested to present a formal report•to the Council at the Regular meeting to be held at 7;30 P.M. of this day. This motion was duly seconded and passed by the unanimous vote of the Council 9 d so declared by the Mayor. Present the MMyor, Clerk, Aldermen Drake, Harding, Mintun, Phillips, Price, Wages. The.Minutes of the Meeting of November 16 1925 were read and approved. The bills against the City listed below having been approved by the Auditing Commi ttee, were ordered paid and the Cler k was diredted to tissue warrants for the same on motion made by Alderman Harding,•seconded by Alderman Mintun, passed by the unanimous vote of the Council and so declared by the Mayor. Jim Mitchell, 6 days work $18.00 Andrew Munds _days work, $24.00; John Zillah, Street laborer $k115.00; W.A. Gregg, Specia 1 Police $7.00. The Finance Committee made its report on the bids for the sale of the Funding Bonds , awarding the contract for the purchase of the same•to MA Elkins & Co. of Little Rock, Arkansas, Alderman Harding moved that the report of, the Committee be accepted, and approved, and that the Committee be discharged 1001 as a special Committee, This motion was seconded by Alderman Phillips 1110 and received the following vote; ayes, Aldermen Drake,.Harding,.Mintun,. Ph llips, Price, Wages nays none, absent and not voting none, and.was_declared passed .by. the Mayor, Dr. A.S.Gregg, City Health Officer reported on the condition of the well -water in the City Park, his report showing that all such water is unfit for human consumption. 6n motion duly made and passed the report was ordered received and filed. A communication from D.Y.Thomas et al was referred to the S#reet Committee. Alderman Harding introduced the following resolution and moved its adoption; Alderman Mint tun seconded the motion which received the following vote; ayes Aldermen Drake, Harding, Min. tun, Phillips, Price, Wages; nays none, absent and not voting none and was declared passed by the Mayor. RESOLUTION. �1 WHEREAS.on the 19th day of October, 1925 there was duly filed with the City Council of the City of Fayetteville, Arkansas, a petition purporting to contain the signatures of a majority in value of the owners of real property situated in Water Improvement District Number Two of the City of Fayetteville, Arkansas, NOW; THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THT3 CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE: Thht a hearing of said petition to determ@ne whether those persons who have signed said petition constitute a majority in value.of the owners of real property situated in said Improvement District will be held by said City Council at the mayor's Office in said City of Fayetteville, Arkansas, on the 7th day of N"#Xp11 December, 1925, beginning at 7;30 P.M. of said Day. SECTION TWO: That the City Clerk of said City og Fayetteville,•Arkansas, be and he is hereby instructed and directed to cause to be published a notice, inaccordance with Section One of Act 125, Acts of Arkansas,1913, advising all owners of real property within Water Improvement District Number Two of the City of Fayetteville, Arkansas, that a petition was presented to said Council on the 19th day of October, 1925, requesting that the contemplated improvement be undertaken, and that the.costs thereof be charged and assessed against the real property within said District; and that on the 7th day of December, 1925, the said City Council will determine whether or not said petition is signed.by such majority in assessed valuatiom. The request of H.C.Evins et al for grading of Oakland Avenue was referred to the Street Committee, on motion by Alderman Harding, seconded by Aldrman Drake, passed by the unanimous v vote of the Council and so declared by the Mayor. Alderman Phillips moved that the Mayor and the City Clerk be authorized and directed to enter into a contract, in the name of the City of Fayetteville, Arkansas with M -#.Elkins & Co. for the sale of the proposed Funding Bonds of said City. Alderman Drake seconded the motion, which received the following vote; ayes Aldermen Drake, Harding, Mintun, Phillips Price, Wages; nays none; absent and not voting none and was declared passed by the Mayor. Alderman Drake introduced the following resolution and moved its adoption. This motion was seconded by Alderman Harding and received the following vote; ayes Aldermen Drake, Harding, Mintun, Phillips, Price, Wages; nays none; absent and not voting none and was declared passed by the Mayor. RESOLUTION. WHEREAS: On the 16th day of November, 1925,there was duly filed with the City Council of the City of Fayetteville, Arkansas, a petitio+urporting to contain the signatures of a majority in value of the owners of real property in City Park Improvement District Number One of the City of Fayetteville, Arkansas; 111 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLEI,ARKANSAS: SECTION ONE: That a hearing of said petition to determine whether those persons who have signed said petitionconstitute a majority in value of the owners of real property situated in said Improvement District will be held by said City Council at the Mayor's office in said City of Fay etteville, Arkansas, on the 14th day of December, 1925, beginning at 7;30 P.M. of said day. SECTION TWO: That the City Clerk of the City of Fayetteville, Arkansas, be instructed and diredte ' to cause to be published a notice, in accordance gith Section One, Act 125, Acts of Arkansas, 1913,advising all owners of real property within City Park Improvement District Number One of Xx the City of Fayetteville, Arkansas,that a petition was presented to the said City Council, November 16th, 1925,requesting that the contemplated improvement be undertaken, and that the ' cost thereof be charged and assessed against the real property within said District, and that on the 14th day of December, 1925,.the said City C uncil will determine whether or not said peti- tionis signed by such majority in assessed valuation. Alderman Price introduced the foll owing Ordinance which was read the f&rst time. Alderman Phillips moved that the Rules be suspended snd the ordinance placed on its second realing. This motion was.seconded by Alderman Harding and received the following vote, ayes Aldermen Drake, Hardi ng}, Mimtun, Phillips, Price Wages; nays none; absent and not voting none; and was declared passed by the Mayor. The Ordinance was read the second time. Alderman Mintun then moved that the Rules be further suspended and the Ordinance placed on ' its third reading and final passage, This motion was seconded by Alderman Price and received the following vote; ayes Aldermen Drake, Harding, Mimtun, Phillips, Price,.Wages; nays none; absent and not voting none and was declared passed by the Mayor. The ordinance was read the third time. The*Mayor then announced that the question before.the Council was, Shall the OMxxx Ordinance pass. The vote on the passage of the Ordinance was yyes Aldermen Drake, Harding, Mintun, Phillips, Price, Wages; nays none; absent and not voting none; and the Mayor declared the ordinance passed. A copy is as follows;- ORBINANCE NO. 586. AN ORDINANCE TO BE ENTITLED " AN ORDINANCE CONTRACTING WITH C.A.MORENO TO Rt i REPAIR AND MAKE IMPROVEMENTS ON CERTAIN STREETS WITHIN THE CITY OF FAYETTEVILLE, ARKANSAS, AND TO FURNISH THE NECESSARY MATERIAL, WORK AND LABOR FOR THE SAME, AND TO PROVIDE FOR THE PAYMENT OF SAID MATERIAL, WORK AND LABOR." t BE IT ORDAINED BY THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION ONE: That repairs and improvements be made on the following nam streets in the City of Fayetteville, Arkansas, at the places herein named, to -wit;- \�A East Mountain Street and South College Avenue; n\•,J' \ \� ' East Rock Street and SouthlCollege Avenue; �l \ South Easjt Avenue and East Rock Street; South Block Avenue and West Rock Street,(. SECTION TWO: That said improvement shall consist of paving the intersections of the above named streets with the same material and in the same manner that the Streets in So uth c College Avenue Improvement District Number One of the City of Fayetteville, Arkansas are to be paved. SEDTION THREE: The City of Fayetteville, Arkansas, by the City Council of said City hereby contracts with C.A. Moreno for the said C.A.Moreno to do and perform the work and labor, and ,1112 furnish the necessary material for the repair and construction as herein set forth, on said §treets and at said intersections of streets as herein mentioned- said improvements to be according to the'plans and specifications on file in the office of the City Engineer of the City of Fayetteville, Arkansas, The City of Fayettevli& agrees to pay the said C.A.Moreno ¢� for the same as follows; The total amount which the City of Fayetteville agrees to pay for all the necessary work -mentioned labor and material furnished for the paving of the above/intersections in the manner above provided is the sum of Four Thousand ($,'4,000.00) Dollars, which amount the said City Council of the said City of Fayetteville, Arkansas, finds to be a fair and just compensation for sai material furnished and work and labor to be performed in.such improvement. SECTION FOYR: Upon the completion of sXXXI the repairs and.improvements upon said streets as above mentioned and at the places hereinbefore desrcribed,.by said C.A.Moreno, and the accep tance of said material used and work and labor done in said repairs and improvements by the City Council of the City of Fayetteville, Arkansas,said City of Fayetteville agrees to pay` said C.A.Moreno the sum of Four Thousand ($p4,000.00) Dollars, to be paid out of the General Revenue Fund ofsaid City of Fayettevilleby warrants drawn in favor of said C.A.Moreno,'or X� bearer,payable in the following amounts and on the following dates, to -wit;- 1st year, November 25th, 1926, $800.00 2nd year, November 25, 1927, $800.00 3rd year, November 25, 1928 $800.00 4th year, November 25, 1929 $800.00 5th year, November 25, 1930,, x$,`800.00. If the C ty of Fayetteville makes default in the payment of any one of said sums when the same becomes due and payable,the City of Fayetteville, Agrees and stipulates with the owner of the warrant, representing the amount of the sum which the City has defaulted in'the pay- ment of, to pay said owner of said warrant the.sum.of eight per cent interest per annum on �j said amount of said warrant, from the date of such default until the sum is fully paid, as p1 /IJ an agreed and stipulated penalty and as damages for failure on its part to carry out its contract with said C.A. Moreno, or the owner of said warrant. SECTION FIVE: This contract shall be binding upon the City of -Fayetteville, Arkansas, from and after the passage, approval and publication of this ordinanceand the acceptance of the same bysaid C.A.Moreno, in writing, filed in the office of the City Clerk of the City of Fayetteville, Arkansas,and compliance with its terms by said C.A.Moreno, on his part. SECTION SIX: The City of Fayettevuille, Arkansas,hereby pledges itself and all its officers, to the faithful performance of this contract as herein set forth in this ordinance, upon the full performance of the contract herein set forth, on the part of the said C.A.Moreno. SECTION SEVEN: This ordinance shall take effect and be in force from and after its pasage, approval and publication. Passed and approved this 23rd day of November, 1925. Attest; J.C.Massie, Clerk.
